ROLO President writes to State Rep Lori Berman on Sober Homes

Comment Up

Representative Berman,

I was cc'd on your reply to Robert Waples in the ROLO neighborhood association concerning sober homes. My name is Katie McGiveron. I am now the president of the ROLO neighborhood here in Lake Worth.

My neighborhood is suffering under the addition of new sober homes in our neighborhood. Our quality of life is, quite frankly, going down the tubes. So forgive me, but your answer to Robert "Sober homes, per the Americans with Disabilities Act and the Federal Housing Act cannot be regulated" is just not acceptable.

What do I expect you to do? I expect you and the rest of the Florida representatives in Tallahassee to DEMAND that this law be changed to protect the people of Florida by any means necessary.--talk shows, T.V appearances, whatever. Stop saying we can't. That's NOT why we put you and other people like you into office. I don't want excuses Ms. Berman. I want action. Period. If we people out here don't fix problems, we get fired. Time to FIX the problems Ms. Berman.

The people in sober homes are paying high prices to live their. Many of them have no programs to help them remain sober and drug free. It is all on paper only with inexperienced staff running them. The majority of them are not well maintained. The only people who are benefiting from them are the people that are running them. They are raking in thousands of dollars a month, drive expensive cars, live in expensive homes. They are bilking the government and with no control they are getting out of hand. I totally agree that they need control of the owners of these homes and stop using the Americans with Disabilities Act as an excuse. The Americans with Disabilities are being abused by the current system.

As stated before, my cousin just sold her house in ROLO after living there for decades. She was seeing the neighborhood run down and a sober home moved in right next door, owned by a woman from South America. Even foreigners are taking advantage of our government tax credits, etc. and dumping addicts into our neighborhoods by the tons.

Katie needs to talk to the Constitution Lady and she can explain to her how the Supremacy Clause works. Sorry Katie, but just because "you want it and you want it now..." won't make it happen. :'( In the meantime, we are making millions off your run down old neighborhood. Muhhahahahahaa

Laws can be changed in this country. Did you know that? If there was enough will and pressure from the Florida legislators,at least a conversation would start at the federal level.Eventually, the loop holes could get closed. It would take an effort. Just saying oh well is not good enough. Anybody else out there getting pissed (Hi Shelley Vana) about reps that love to use the word can't? These people can move mountains to get elected by us, but when we request an effort, oh well. Too bad,so sad.And it is TOTALLY disgusting that Joey's law has NOT been passed by these reps because they might loose some funding for their campaigns from the American Medical assoc. Constitution Lady here...to explain to
anon @ 9:49 how the Supremacy Clause works.

The fed gov laws ONLY TRUMP states rights
when it is specifically listed in the
Constitution (or bill of rights amendment)
or simply put - their 'job description.'.
The rest is a word salad and needs to be tossed!

The individual is the smallest minority and protection
of ALL Our rights is any governments 1st job.

When mission creep - creeps in and we are sliced and
diced up into 'protected GROUPS' and not individuals
problems arise. It's how we are divided and then conquered.

I have a pocket Constitution for you with the Declaration of
Independence and the Bill of Rights included. Borrow the federalist
papers from the Mayor and like minutes of a meeting, the
original intent is there. There are very few real laws we the
people must follow but a huge list of "Codes" that fee and fine
US into compliance with politically correct BS of the day!

None of this explains why Florida is the supreme Sober Home capital of the U.S. Why is it that in other states it is difficult to even find a place for drug rehab? Why is Florida the capital of insurance scams?

To the person who attempted to post here and called someone a "slut," I want to let you know that yes, I do know that sober homes can locate in condos or just about anywhere. But it seems like we have a disproportionate amount of them in Lake Worth. Our anointed ones should be going to Tallahassee or Washington and using their time in better ways rather than ruining a county park. Maybe they can put our Washington lobbyist to good use for whom we spend $5,000 a month.

Sad that our elected officials give out wrong information. While sober homes cannot be regulated, per se, they are still subject to the same laws and ordinances that the rest of us are subject to.

So, first the City of LW has a short term rental law, it is valid and it is grandfathered in. Which means that all these sober homes who are renting by the month are in violation of that ordinance. Why won't the City enforce our short term rental law? That's another question, but I suspect it has to do with the realtors and property owners who are running vacation rentals. Because in order to not run afoul of the ADA, our short term rental law would have to be enforced uniformly.

Similarly, our ordinances for occupancy rates, nuisances, noise, etc. are all still applicable to sober homes. So, neighbors need to be vigilant and call code, the police, take photos, log police calls, etc. Then they need to get the City to take action under our codes and nuisance abatement laws.

We are not powerless.
