Biden Administration’s ‘Catch and Release’ Border Policy Struck Down by US Judge

Florida Attorney General Ashley Moody, a Republican, sued the government in 2021 over the policy

The federal government’s program of releasing many illegal immigrants rather than holding them until their cases are resolved violates federal law, a U.S. judge ruled on March 8.

“The evidence establishes that Defendants have effectively turned the Southwest Border into a meaningless line in the sand and little more than a speedbump for aliens flooding into the country,” U.S. District Judge Judge T. Kent Wetherell said in the ruling.

Wetherell struck down Alternatives to Detention, a program through which President Joe Biden’s administration has released more than one million aliens into the U.S. interior.

Florida Sues Biden Over Catch-and-Release Policy

Florida is suing President Biden’s administration over the “illegal” catch-and-release immigration policies at the Southern border. Florida Attorney General Ashley Moody filed the suit as part of a joint effort with Gov. Ron DeSantis to “uphold the rule of law despite the Biden administration’s decision to violate the law.”

The lawsuit alleges that Biden officials deliberately violated federal law or abused their parole authority.

“Many of the aliens illegally released by the Biden administration are arriving, or will arrive in Florida, harming the state’s quasi-sovereign interests and forcing it to incur millions of dollars in expenses.”

Franklin County MA shuts ICE detention center

Says closure was a financial, not a political, decision

Costs in FY19 were anticipated to be $124 per individual/per day for those in adult detention and $319 per individual/per day for those in family detention.

The American Civil Liberties Union called on the Biden administration to shut down 39 ICE detention facilities nationwide, including the facility in Bristol County Massachusetts run by Sheriff Thomas Hodgson, a strong supporter of former president Trump and his immigration policies.

"The number of detained people is currently lower than it’s been in two decades,” said Naureen Shah, senior advocacy and policy counsel at the ACLU.
