Now it seems the whole time they must have been counting on the DOJ betrayal Pam Bondi's prosecutors just shocked Washington with in the Biden autopen case.

The House Oversight Committee spent months building the case. Fourteen depositions. Forty-seven hours of testimony. A report documenting how Biden's inner circle – Annie Tomasini, Anthony Bernal, and Dr. Kevin O'Connor – exercised presidential power while Biden declined behind closed doors.

All three aides pleaded the Fifth Amendment rather than answer a single question under oath. And Pam Bondi's DOJ just shrugged.

CBS News confirmed that prosecutors in Jeanine Pirro's DC US Attorney's office dropped the criminal probe because they "were never able to find a legal hook" to pursue the matter. The New York Times called it the latest sign that DOJ could not convert Trump's demands into prosecutions.

That's not a legal problem. That's a failure of will.

Another political storm is brewing as the Trump administration just slammed the brakes on former President Joe Biden’s attempt to shield controversial documents tied to his administration’s use of an autopen.

The crux of this saga is the Trump administration’s rejection on Tuesday of Biden’s request for executive privilege to protect records that Congress is itching to scrutinize over allegations of autopen misuse on official documents, as Fox News reports.

Let’s rewind to the start of this paper trail, when concerns over Biden’s mental sharpness began bubbling up among conservatives, long before any public admission from media or Democratic allies.

Fast forward to June, when the Senate Judiciary held a hearing with the eyebrow-raising title "Unfit to Serve," digging into whether Biden’s team obscured his capacity to lead.

By Oct 1, Biden fired off a letter to the National Archives, asserting executive privilege over specific documents, claiming their release could harm the presidency’s ability to function candidly.

"I am concerned that disclosure of these materials would damage important institutional interests of the Presidency," Biden wrote in his letter to NARA.

But let’s be real -- hiding behind privilege starts to look like dodging accountability when Congress is already knee-deep in investigating potential misuse of a signature machine.

House Oversight: Biden's Executive Actions With Autopen 'Illegitimate'

The GOP-led House Oversight Committee on Tuesday called on the Justice Department to investigate every executive action taken during the Biden administration, saying it found evidence that some of former President Joe Biden's orders and clemency decisions may have been issued without his personal approval.

In a 91-page report released early Tuesday, the committee said its investigation found no record that Biden authorized several executive actions, including presidential pardons and commutations.

It further said his aides may have used the presidential autopen, a mechanical device that replicates signatures, to sign off on actions "without his knowledge."

"Because of this," the report said, "the Committee deems those actions taken through use of the autopen as void," and it "finds numerous executive actions, particularly clemency actions, taken during the Biden administration were illegitimate."

Former Biden Aide Neera Tanden Does Not Know Who Ordered President’s Autopen Signatures

She admitted that aides were allowed to sign for pardons

Neera Tanden, a former top aide for President Joe Biden, told Congress that she had authorization to direct autopen signatures for the president but does not know who gave the final order.

Tanden served as the director of Biden’s Domestic Policy Council and she told Congress during a testimony on Tuesday that the president used an automatic signature tool allowing for aides to sign pardons, memos, and other official documents in the White House. Tanden said she did not know who authorized those signatures. Per Fox News:

During Tanden’s interview before Congress, which lasted more than five hours, she told lawmakers that, in her role as staff secretary and senior advisor to the former president between 2021 and 2023, she was authorized to direct autopen signatures on behalf of Biden, an Oversight Committee official told Fox News.

Tanden, who reportedly said during her testimony that she had limited interactions with Biden in her role, according to sources familiar with her testimony, described an approval process that left her – at least partly – in the dark about who specifically was giving final approval on the decisions to use the automatic signature tool, even though she simultaneously insisted Biden was in charge.

Tanden reportedly testified that to get approval for the use of autopen signatures she would send decision memos to members of Biden’s inner circle. However, she added that she was not aware of what actions or approvals took place between the time she sent the decision memo and the time she received it back with the necessary approval, according to the source familiar.

President Trump's administration has opened an investigation into whether Joe Biden 'was competent' when he used an autopen to issue lame duck pardons to family members and death row inmates.

Ed Martin - Trump's pardon attorney - said the Justice Department has been directed to investigate clemency granted by Biden in the waning days of his presidency, including the December pardon of his troubled son Hunter.

Martin's probe was revealed in a Monday email to staffers that was obtained by Reuters.

The attorney said the investigation involves whether Biden 'was competent and whether others were taking advantage of him through use of AutoPen or other means.'

House Oversight Committee Chair James Comer has launched an aggressive investigation seeking to interview five former Biden administration officials about alleged cover-ups of the former president's cognitive decline.

According to Newsmax, the Kentucky Republican sent letters requesting voluntary transcribed interviews in June with Dr. Kevin O'Connor, former Domestic Policy Council Director Neera Tanden, and three prominent White House aides.
