Trump administration blocks Biden's bid to hide autopen records

Another political storm is brewing as the Trump administration just slammed the brakes on former President Joe Biden’s attempt to shield controversial documents tied to his administration’s use of an autopen.

The crux of this saga is the Trump administration’s rejection on Tuesday of Biden’s request for executive privilege to protect records that Congress is itching to scrutinize over allegations of autopen misuse on official documents, as Fox News reports.

Let’s rewind to the start of this paper trail, when concerns over Biden’s mental sharpness began bubbling up among conservatives, long before any public admission from media or Democratic allies.

Fast forward to June, when the Senate Judiciary held a hearing with the eyebrow-raising title "Unfit to Serve," digging into whether Biden’s team obscured his capacity to lead.

By Oct 1, Biden fired off a letter to the National Archives, asserting executive privilege over specific documents, claiming their release could harm the presidency’s ability to function candidly.

"I am concerned that disclosure of these materials would damage important institutional interests of the Presidency," Biden wrote in his letter to NARA.

But let’s be real -- hiding behind privilege starts to look like dodging accountability when Congress is already knee-deep in investigating potential misuse of a signature machine.

Trump Campaign: Biden 'Politicized' Executive Privilege

The Trump campaign Thursday accused President Joe Biden of hypocrisy with executive privilege after refusing to release audio of his interview with special counsel Robert Hur.

Biden asserted executive privilege over the audio of his Hur interview that is at the center of a Republican effort to hold Attorney General Merrick Garland in contempt of Congress, the Justice Department told lawmakers earlier in the day.

"Crooked Joe Biden and his feeble administration have irretrievably politicized the key constitutional tenet of executive privilege, denying it to their political opponents while aggressively trying to use it to run political cover for Crooked Joe," Trump campaign spokesman Steven Cheung wrote in a statement.

You can see how this would be very damaging to Joe Biden if the public heard these tapes. As a reminder...

According to the report, investigators found Joe Biden’s “memory was significantly limited” in interviews they conducted with him in 2023 as well as interviews with his ghostwriter.

Because of that, special counsel Robert Hur wrote in the report, investigators concluded that it “would be difficult to convince a jury that they should convict him – by then a former president well into his eighties – of a serious felony that requires a mental state of willfulness.”

“Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” they wrote, adding that Biden “is someone for whom many jurors will want to identify reasonable doubt.”

White House has invoked executive privilege

over 200 records related to Hunter Biden’s business dealings during his father’s tenure as Vice President

America First Legal (AFL), a prominent legal advocacy group, recently launched a lawsuit to obtain records from the National Archives (NARA) pertaining to Hunter Biden’s business interactions during the Obama administration.

The lawsuit specifically sought communications between January 2011 and December 2013 that mentioned Hunter Biden’s company, “Rosemont Seneca.” AFL’s aim was to shed light on any potential conflicts of interest and undue influence that may have existed between the Office of the Vice President and Hunter Biden’s business ventures.

In response to AFL’s records request, NARA refused to release the majority of the requested documents, citing executive privilege. NARA claimed that disclosing these records would reveal “confidential advice” exchanged between then-Vice President Joe Biden and White House advisers.

These ventures included partnerships with entities linked to the Chinese Communist Party and significant financial transactions involving the state-controlled Bank of China. One of the most notable joint ventures was BHR Partners, in which Hunter Biden’s company, Skaneateles LLC, held a ten percent equity stake.

An executive order signed by George W. Bush in November 2001 stated that an incumbent president could not override a former president’s claim to executive privilege over documents. Should the incumbent president not agree with the former president’s claim to executive privilege in withholding records, the incumbent president may inform the former, as well as the Archivist—being the National Archives and Records Administration.

Nearly a decade later, Barack Obama reversed that guidance, which reportedly went back to Watergate and the Reagan era where incumbent president’s had the final say over past presidents, which gave them authority to act through the National Archives, Just the News reported.

Alan Dershowitz said, “The idea that a sitting president can somehow waive the executive privilege of a previous president really wrecks the executive privilege, which is implicit in Article II of the Constitution,” Dershowitz told Just the News last week. “You can’t have a privilege, which then your political opponent can waive.

Barack Obama was the start of many of our problems in our country.

"Biden informed the National Archives that it should turn over the logs sought by the Jan. 6 committee within 15 days.

President Biden ordered the National Archives to hand over a range of visitor logs from the Trump White House to the House committee investigating the Jan. 6 attack on the Capitol, rejecting his predecessor’s claim that the material is protected by executive privilege.

The decision boosts the committee’s efforts to gather information about who was coming and going from the White House not just on the day of the attack last year but also in the months preceding it as President Donald J. Trump sought to overturn the election." [NYTimes]

Biden spends nearly every weekend away from the White House and travels to either Camp David or his Delaware residence and refuses to release his visitor logs.

Trump’s Lawyers Head to Court in Jan. 6 Executive Privilege Fight

Trump’s lawyers stated in a filing last month that “congressional committees do not have the broad and boundless authority of inquisition; their investigatory powers are confined by their legislative function and the legitimate Constitutional prerogatives of their co-equal branches of government.”

“The Committee’s request amounts to nothing less than a vexatious fishing expedition designed to unconstitutionally target President Trump and those who served in his administration,” they add. “Our laws do not permit such an impulsive action against a former President and his close advisers.”

This congress should be investigating itself and fellow Democrats in general...they can start with investigating Crooked Hillary. But, Durham is doing that and it is starting to all leak out.

Congressional Democrats and a few RINOS (and Adam Kinzinger will not run again) would love to pin the January 6 protest all on Trump.they want to knock him out of even thinking about running again.
