And Democrats call Trump a "dictator"

Seizing Private Land Is Next Step in Fight Against Climate Change

Eminent domain is becoming the weapon of choice against opposition to large wind and solar projects being planned and constructed around the United States.

The dream of net-zero carbon emissions—and its vision of blanketing hundreds of millions of acres of American land with wind turbines and solar panels—is running up against the reality that most of the land in America is still privately owned and many Americans don't want these massive industrial installations near their homes.

But that may prove to be a temporary impediment.

“There is a major effort under the Biden administration to consolidate power over land and resources, because whoever owns the land and resources of a nation, controls the people,” Margaret Byfield, executive director of American Stewards of Liberty, a property rights nonprofit, told The Epoch Times.

“With current siting practices, an area the size of Texas is required to accommodate the wind and solar infrastructure we need to reach nationwide net-zero emissions by 2050." That will be a lot of stealing.

We are becoming a communist nation under Democrats. Trump, and I hope he will be elected, will have a lot on his hands in January 2025 as the country is quickly going down the tubes under Joe Biden and the socialists.

And last year, NetEra Energy was fined $8 million for killing over 100 Bald Eagles with their wind turbines--guilty to three counts of violating the Migratory Bird Treaty Act.” Democrats have no respect for our national Bird or for its citizens.

The Squad will have a Fit

Biden Admin Takes Possession Of Private Land To Expand Border Wall

The federal government has won the ability to take immediate possession of privately owned land along the United States-Mexico border. The Biden admin plans to continue the construction of the border wall and shows no plans at all to give the land back to its original owners.

According to a report from the New York Post, there is the possibility that the Biden administration still plans to make good on the Trump administration plans, particularly the plans to complete the gaps between existing segments of the southern border wall. We'll see. Biden has a habit of flip-flopping these days.

The owner of this property voted for Biden as he didn't want his land confiscated...now he's furious!

Palm Beach Mobile Park and Mayor Pam Triolo

Comment Up

Back on November 10, 2015, the City acquired some land for rights of way. One of the land owners was Palm Beach Mobile Home Park LLC.  The city needed and wanted this land for their Park of Commerce infrastructure project which is pouring $11 million into it this year.

So, if you want something, you can legally take it by Eminent Domain. Eminent domain is where the government can (and does) seize private property for public use - to build a road, a school or a courthouse.  Now, in cities across the country, governments are also seizing land for private use if they can prove that doing it will serve what's called "the public good." And this reminds me of what former commissioner Nadine Burns said years ago regarding the senior condos along Lake Osborne Drive. She thought the property wasn't being used for its best use. When you get officials who believe that way, no one's property is entirely safe from government land grabs.

Although out on 7th Avenue North and Joyce Street  was just a small piece of private property, the city said that the acquisition of the three (3) parcels involved will be used to address required corner clips for improved turning radius.

I believe that Eminent Domain in this instance was used for future private development, not the public good.

As part of the negotiations to acquire the properties and the eminent domain proceedings filed by the city, the owner(s) incurred legal fees for this land grab. The City is responsible to cover those legal fees in addition to the actual appraised value of the land. The total cost for the three (3) parcels including the legal fees incurred by the owner(s) is $41,637.50.

This is just another step by the city to cause concern for all those who live in the park.  It is the city that is instilling fear with the Senior residents who live there. And now they have the garbage incident.

This is a MUST read. The highly charged political letter by Pam Triolo to the residents of Palm Beach Mobile Home Park.

Garbage collection classification and Zoning are two different things

Comment Up

I received a comment last night that said "Stop the insanity." This reader was upset that their trio of Maxwell, Triolo and Amoroso was taking some sort of blame for what happened to the seniors at Palm Beach Mobile Home Park.
"Lynn, PLEASE address the fact that the ordinance was approved by a PREVIOUS Commission. At least be forthright in acknowledging this fact. How in your mind, is this somehow an "evil 3" enactment?? Stop the Insanity, please....."
City Manager Bornstein was told by staff that a resolution was passed in 2009 that rated certain establishments as "commercial" for garbage pick-up purposes. The mobile home owners were not aware of any change in their status as curbside pick-ups were done from the beginning when this land was plotted out for mobile home lots and that service continues. Some of the residents have been there, like its president, for over 30 years with garbage pick-up in front of their home.

What came as the surprise was when the park was notified just a few weeks ago that garbage would be handled differently than it had from inception. Little explanation and certainly zero sympathy was given to the mobile home owners.

I believe, and its only an assumption, that this all came to light when the City of Lake Worth contracted with Waste Management for Roll-Off services for commercial and residential properties back in August 2015. This Trio commission was getting ready for the Park of Commerce that was in the process of design, etc. and realized then that their big garbage trucks were looming down these narrow roads. Through discussions, the mobile home park's garbage designation was mentioned and that it had changed in 2009 to a commercial service and rate.

And don't forget, in January Waste Management gave Scott Maxwell a campaign contribution of $1,000.

Prior to that, in June 2015, the commission voted for Eminent Domain at the Park of Commerce. Eminent Domain, something Trump says is a wonderful thing, is used for the public good such as for government buildings and other facilities, public utilities, highways, and railroads. It is not used for the benefit of private developers. This trio of commissioners, Maxwell, Triolo and Amoroso voted for Eminent Domain at the Park of Commerce.

It is no wonder that the residents there feel like they have been treated like second class citizens. Garbage pick-up classification and their zoning are two different things. The first (garbage classification) took place in 2009 which was by Resolution and did not have to be publicly noticed. The other (land-use zoning) occurred in August 2013 under this commission and public notice was required.

Author Joyce Meyer said, "Don't just let the devil use your mind as a garbage dump."  A lot of people come over here trying to do just that.  There is NO insanity, just people who want to be treated right.

Eminent Domain on Boutwell Road

Comment Up

Eminent Domain at the Park of Commerce is costing the city $41,637.50 which includes the owner's legal fees--a very small price for the city to pay for a land grab.

All of the property is owned and controlled by Palm Beach Mobile Home Park, LLC and Palm Beach Home Sales, LLC. As part of the negotiations to acquire the properties and the eminent domain proceedings filed by the city, the owner(s) incurred legal fees for which the City is responsible to cover in addition to the actual appraised value of the land.

This has been placed on the Consent Agenda on Tuesday's meeting.

The Boutwell Road Infrastructure Project Capital account 304-5020-541.63-15 was funded in the amount of Eight Million Seven Hundred Thousand dollars ($8,700,000) for FY 2016. The approved budget included funds for the acquisition of required rights of way.

Good going "visionaries."  We can't fix the potholes but we can build a field of dreams and you all can have fun at the Grand Ole Opry.

Eminent Domain

Comment Up
  • Donald Trump said, "Eminent domain is wonderful."

  • The "visionaries," Scott Maxwell, Pam Triolo and Andy Amoroso along with McVoy (that one was a surprise) said the same thing when they voted for Eminent domain on June 16th at Lake Worth City Hall. The Park of Commerce is all about spending (OPM) other people's money or public money to ready land for developers.

  • Marco Rubio railed against the relatively obscure issue of eminent domain Thursday. While eminent domain is necessary for important (that's the key word--important) infrastructure projects, the power is often used to benefit wealthy private developers.
Rubio further said, "The fundamental right to private property has been under assault for years through our government’s abuses of eminent domain. Eminent domain is the authority vested in government to force the sale of private property. While this authority can be a necessary evil in rare cases related to public development, such as the building of crucial infrastructure, its modern use far exceeds this limitation. Today, it is often wielded by crony capitalist politicians to benefit wealthy and powerful private developers.”

I stand by Marco especially when we think about the Park of Commerce and all the private property they will take in order to fulfill Scott Maxwell's field of dreams and the multi-millions that the City plans to invest there over-all.

Lake Worth extends legal services with Eminent Domain experts

Comment Up

Last night was another meeting from hell. You have to wonder if some of these commissioners are asleep at the wheel, always angry, never have a clue, just plain evil or what. But one thing is certain, two of them are extremely rude--not just some of the time but most all of the time--and that will be a later story.

The visionaries are still on full throttle to grab private property on Boutwell Road...Eminent Domain. The legal dictionary describes Eminent Domain as follows: The power to take private property for public use by a state, municipality, or private person or corporation authorized to exercise functions of public character, following the payment of just compensation to the owner of that property.

The desire to take this property on Boutwell Road is NOT for the good of the public but for the good of the DEVELOPER and this visionary's dream of developing the Park of Commerce by spending $8.7 million allotted in the latest budget. We will NEVER recapture that investment in ad-valorem taxes in this century. So, why is it so important to Maxwell, Triolo and Amoroso and so important to TAKE private property?

The City entered into a legal services agreement with Caldwell Pacetti Edwards Schoech & Viator LLP on February 5, 2015 to provide certain legal services to the City concerning land acquisition and potential eminent domain proceedings pertaining to the proposed Boutwell Road improvement project. The City amended the agreement and it will now be open-ended.

This passed on Consent Agenda 5/0.

Eminent Domain - Firm Lake Worth hired

Comment Up

As previously mentioned, the city hired an expert law firm that specializes in Eminent Domain. The contract was signed by the mayor back on February 5, 2015. Who would have known? The entire concept of taking private property on Boutwell Road by Eminent Domain was approved by four out of five commissioners just last week.

William Doney of Caldwell, Pacetti says that Eminent Domain at the Park of Commerce IS for a public benefit. That's his argument and he's sticking to it and we've paid him $225 an hour up to $25,000 to tell us that and be able to argue it in court. And if we need them for other services going forward, it is by vote of the commission. Well, you never know--one of those landowners might not like the "deal."

Read the following to find out what you, the taxpayer is paying this firm.

Eminent Domain - Abuse of Power here?

Comment Up

Eminent domain should be used only for a public benefit. Kelo v. City of New London remains one of the most disputed rulings in the Supreme Court history. A decade later, the land where a neighborhood claimed by eminent domain remains vacant. “They put in infrastructure and roads to nowhere, sidewalks to nowhere with always the thought that they were going to have this redevelopment plan where a hotel would come, a health club, cafes, restaurants and stuff like that that never came to be,” said a woman whose property was grabbed and demolished.

Even though the government has the right to seize property for a public benefit, there is something inherently wrong with this. I still do not believe that eminent domain is proper on Boutwell no matter what Lake Worth's expert eminent domain attorney says. The city tries too hard and spends too much taxpayer money trying to convince all of us that they are right.

Eminent Domain at Park of Commerce is NOT for a public benefit

Comment Up

The City of Lake Worth wants to use its powers of eminent domain at the Park of Commerce. They believe that developing the POC is the city's salvation. The City Commission voted to do that and it passed on a 4/1 vote with Commissioner Ryan Maier dissenting.

The property may be taken either for government use or by delegation to third parties, who will devote it to public or civic use or, in some cases, to economic development. And that's what we are doing here in Lake Worth--economic development. "The most common uses of property taken by eminent domain are for government buildings and other facilities, public utilities, highways, and railroads.  Some jurisdictions require that the condemnor make an offer to purchase the subject property, before resorting to the use of eminent domain."  Lake Worth will offer the two owners involved 125% of its appraised value or seize the land.

How much did this eminent domain attorney cost the city who says, "the project is clearly for a public purpose." Don't we pay Torcivia law firm enough money? How does this eminent domain lawyer, William Doney with the law firm of Caldwell Pacetti Edwards Schoech & Viator LLP conclude that this is all for a public purpose?  How is it any public benefit? The only "benefit" is supporting this commission's desire to spend a hell of a lot of money for infrastructure, storm water drainage, utilities, etc. for private development. Developers get 100% off the hook.

Eventually this private development, if it even comes to the Park of Commerce, will be contributing to the tax base but it could take 100 years before those ad-valorem taxes covers the initial cost of all this infrastructure even if every square inch out there is developed.

This clearly is NOT a public benefit. What it is--a land grab and one gigantic expense for the taxpayers if Lake Worth gets its way.

The commission will be voting on Eminent Domain tonight

Comment Up

NEW BUSINESS Resolution 27-2015-

Tonight, in its pursuit to spend boo koo bucks to develop the Park of Commerce (The visionaries dream especially Vice Mayor Scott Maxwell's) to attract development,  City Manager Michael Bornstein has recommended the acquisition of fee simple title to Parcel 1 to the City Commission of the City of Lake Worth, as being necessary for the widening and construction of improvements to Boutwell Road in the City of Lake Worth, Florida. In other words, he wants to grab land belonging to a private citizen(s).

The city commission will be instructing the city attorney and city manager to take necessary action and to hire outside counsel in order to take possession of this property.

WHEREAS, the funds are available for the acquisition of the parcel  designated as Parcel 1; and,

WHEREAS, the City Commission of the City of Lake Worth is exercising  its authority of eminent domain pursuant to Chapters 73, 74, and 166, Florida Statutes.
