Federal judge clears way for Arizona border wall after tribe's bid to block construction fails

A federal judge denied the Tohono O'odham Nation's attempt to halt border wall construction along 62 miles of its Arizona reservation, ruling that national security interests outweigh the tribe's claims of harm. The Nation consists of 2.8 million acres.

U.S. District Judge Richard J. Leon rejected the tribe's request for a preliminary injunction, a court order that would have stopped the Trump administration from building on or near the reservation's southern boundary with Mexico.

The ruling allows federal contractors to move forward on a stretch of border that has long lacked a physical barrier, cutting through the Sonoran Desert along one of the most remote corridors on the entire U.S.-Mexico line. Fox News Digital reported that Judge Leon grounded his decision in a 1907 presidential proclamation and the timeline of the reservation's own creation.

The tribe, which has more than 37,000 members, thousands of whom live on the Mexican side of the border, argued the wall would damage sacred sites, disrupt religious rituals, and sever family ties between communities split by the international boundary. Judge Leon was not persuaded. A 1907 proclamation settled the legal question before it started--

Judge Leon's reasoning turned on a fact of chronology. In 1907, President Theodore Roosevelt issued a proclamation placing all public land within 60 feet of an international boundary under exclusive federal government control. Roosevelt's stated purpose: "a protection against the smuggling of goods between the United States and the Republic of Mexico."

The Tohono O'odham (meaning desert people) reservation was not officially established until 1917, a full decade after Roosevelt's order. Leon cited that sequence directly, concluding that the federal government's claim to the border strip predated the reservation itself.

As Mullin put it: "The smaller the choke point gets for criminals to cross." CBP has already placed $11.4 billion in Smart Wall funding on contract, with all remaining barrier contracts hitting by June 30.

By September 30, CBP expects 250 miles of new barriers completed – more than 10 miles of that built in just the last 50 days.

200 Border Patrol agents headed for Texas amid illegal crossings surge

At least 200 federal immigration agents are being sent to a border town in Texas where illegal border crossings have spiked amid the Trump administration’s claims the U.S.-Mexico border is secure.

The 200 agents otherwise assigned to the country’s northern and southern borders will be deployed to Laredo for 30 days to assist local Border Patrol employees who are dealing with a significant increase in immigrants attempting to enter the country illegally from Mexico each day.

NewsNation sources also say the surge in federal agents will include those from Customs and Border Protection’s BORTAC unit, a special operations group often brought in to assist with field operations.

Department of Homeland Security data obtained exclusively by NewsNation shows there were 2,600 encounters between federal agents and migrants in the Laredo Sector in March and April — a 50% increase from the previous two months. The 1,400 reported encounters in Laredo this month represent an 86% spike from April 2025, DHS reported.

Sources tell NewsNation that the Trump administration plans to expand the border wall through Laredo, but the city has pushed back on the expansion. City officials have expressed concerns about the wall running through residential areas of Laredo and eliminating river views for residents there.

Who would have thought it would be this difficult to secure our border and finish the wall in order to keep Americans safe from criminals and cartels.

White House Border Czar of the Trump Administration Tom Homan responded to Pope Francis’ criticism, saying that as a lifelong Catholic, he wished the Pope would “concentrate on his work” of fixing the Church.

The Biden administration is quietly auctioning off millions of dollars’ worth of unused parts from former President Trump’s border wall for peanuts – in an apparent end-run around pending legislation in Congress.

Since April, GovPlanet, an online auction house specializing in military surplus, has sold 81 lots of steel “square structural tubes” — intended for use as vertical bollards in the border barrier’s 30-foot-tall panels — hauling in about $2 million.

On Tuesday, GovPlanet netted $154,200 for 729 of the 28-foot-tall hollow beams, sold in five separate lots for an average $212 apiece.

Thirteen more lots are set to be auctioned on Aug. 23 and Aug. 30.

The Senate passed a bill just last month to extend the wall!
