Third Circuit strikes down New Jersey's AR-15 and magazine bans as unconstitutional

A federal appeals court ruled Friday that New Jersey's decades-old bans on so-called assault firearms and magazines holding more than ten rounds violate the Second Amendment, delivering a 10-5 decision that dismantles two of the most aggressive gun-control measures on the East Coast and sets the stage for a Supreme Court showdown.

The 3rd U.S. Circuit Court of Appeals found that New Jersey failed to justify its restrictions under the historical-analogue test the Supreme Court established for evaluating firearms regulations. The state pointed to colonial-era gunpowder storage laws and Bowie knife bans enacted in Western territories. The court was unpersuaded.

U.S. Circuit Judge Arianna Freeman, a Biden appointee who authored the majority opinion, wrote bluntly about the magazine restrictions:

"The text of the Second Amendment covers all magazines, not just magazines that New Jersey considers 'standard capacity."

New Jersey spent thirty-six years telling law-abiding citizens they couldn't own some of the most popular firearms in America. It took the Constitution about thirty-six pages to explain why the state was wrong.

More than a dozen county prosecutors across Virginia have declared they will not enforce Democratic Gov. Abigail Spanberger's ban on modern semiautomatic firearms, setting up one of the sharpest confrontations between local law enforcement and a state government over Second Amendment rights in recent memory.

The law, SB 749, which Democrat Governor Spanberger signed on May 14, bans a list of common firearm features and labels weapons possessing them "assault firearms." Within days, pro-Second Amendment organizations, the National Rifle Association, the Second Amendment Foundation, and the Firearms Policy Coalition, filed legal challenges. But the courtroom fight is only half the story.

On the ground, the prosecutors who would be responsible for bringing cases under the new law are saying, one after another, that they simply won't do it.

Their reasoning is not political posturing. It is grounded in specific Supreme Court precedent, and in the text of both the U.S. and Virginia constitutions.

On her popular "The Megyn Kelly Show" podcast recently, the former Fox News anchor didn't mince words about the network's treatment of Kirk.

"It's really bothering me how Fox News is talking about Charlie, like he was theirs — he wasn't. It's a lie. Just stop," Kelly said.

Kelly quit Fox News in January 2017 and has since been one of the network's most vocal critics, particularly after Carlson's firing in April 2023. She claimed that although some Fox personalities were friendly with Kirk, network leadership deliberately kept him off the air.

Kirk's situation with Fox News mirrored that of other pro-Trump allies during the years between his presidencies who were banned from the network for long periods. Such Trump allies included Jason Miller, Pam Bondi, Kari Lake, Karoline Leavitt, Peter Navarro, Donald Trump Jr., Rudy Giuliani, Andrew Giuliani, among others.

California bans Facemasks for ICE officers

California Bans ICE Agents from Wearing Masks

California's legislature has passed a bill that bans federal law enforcement officers from wearing masks while on duty, with criminal penalties for noncompliance.

The bill, SB-627, bans any law enforcement officer or agent from wearing a "facial covering that conceals or obscures their facial identity in the performance of their duties," with exceptions for motorcycle helmets and SWAT officers, along with N-95 masks for COVID-19.

Assuming it's signed by Gov. Gavin Newsom (D), violators could face either a fine or charged with a misdemeanor.

The bill also strips law enforcement officers from qualified immunity for officer and agents who commit "assault, battery, false imprisonment, false arrest, abuse of process, or malicious prosecution" while wearing a mask, and could face a fine up to $10,000.

"ICE law enforcement officers wear masks to prevent doxing, which can (and has) placed them and their families at risk. All ICE law enforcement officers carry badges and credentials and will identify themselves when required for public safety or legal necessity," the agency wrote on its website in the FAQ area.

Court Upholds Ban on ‘Unusually Dangerous Weapons’

A federal appeals court Thursday refused to block two Connecticut gun control laws despite arguments that they violated the Second Amendment.

The laws faced two separate challenges from the National Association for Gun Rights, the Second Amendment Foundation, and others, who asked the Second Circuit Court of Appeals to temporarily block the laws.

But on Thursday, a three-judge panel of the court declined to do so, saying the laws were constitutional because they preserved “numerous legal alternatives for self-defense” despite their restriction of “unusually dangerous weapons.”

The challenged laws included a 2013 ban on certain firearms and large capacity magazines—passed in response to the 2012 Sandy Hook shooting in Newtown, CT—and a 2023 law that further restricted access to what gun control advocates call “assault weapons.”

The groups opposing the laws based their challenge largely on the 2022 Supreme Court decision in New York State Rifle & Pistol Association v. Bruen, which said that laws restricting guns must be rooted in U.S. “history and tradition.” They also cited District of Columbia v. Heller, a landmark case from 2008 that held that the Second Amendment “confer[s] an individual right to keep and bear arms.”

The National Association for Gun Rights says it plans to return to the district court, where the case will be heard on the merits.

Biden invoked the 1953 Outer Continental Shelf Lands Act, potentially limiting President-elect Trump’s ability to reverse the decision without congressional action.

"This policy chokes long-term exploration and development, threatening the industry’s survival."

Neal warned of a broader anti-energy agenda. "If activists come for one thing, they’ll come for everything," he said. "This policy is catastrophic for oil and gas and could eventually target offshore wind farms for similar reasons. President Biden and his allies are pushing anti-energy policies that hurt Americans."

Meanwhile, Trump reiterated his commitment to American "energy dominance" during his 2024 campaign. He promised to ramp up U.S. oil and gas production while rolling back Biden’s climate-focused initiatives..."Drill, Baby Drill."
