Semiautomatic firearms ban in Virginia

Virginia prosecutors refuse to enforce Spanberger's semiautomatic firearms ban, citing Constitution

More than a dozen county prosecutors across Virginia have declared they will not enforce Democratic Gov. Abigail Spanberger's ban on modern semiautomatic firearms, setting up one of the sharpest confrontations between local law enforcement and a state government over Second Amendment rights in recent memory.

The law, SB 749, which Democrat Governor Spanberger signed on May 14, bans a list of common firearm features and labels weapons possessing them "assault firearms." Within days, pro-Second Amendment organizations, the National Rifle Association, the Second Amendment Foundation, and the Firearms Policy Coalition, filed legal challenges. But the courtroom fight is only half the story.

On the ground, the prosecutors who would be responsible for bringing cases under the new law are saying, one after another, that they simply won't do it.

Their reasoning is not political posturing. It is grounded in specific Supreme Court precedent, and in the text of both the U.S. and Virginia constitutions.

Feds have lost Minnesota

Mass resignations leave questions about government’s ability to prosecute fraud in Minnesota

Federal prosecutors have resigned from the U.S. Attorney's Office in Minnesota, and officials have provided few details about whether they are equipped to prosecute fraud.

Under Gov. Tim Walz, Minnesota has developed a national reputation for its failure to stop the large-scale welfare fraud that has occurred in the state. The topic has become such a big political issue that Walz was essentially ushered into an early retirement because of it.

The fraud saga includes the $250 million Feeding Our Future scheme as well as fraud in state-run, Medicaid-funded programs. Last year, the U.S. Attorney’s Office in Minnesota estimated that fraud in those state-run programs could exceed $9 billion since 2018.

Both the discovery and prosecution of that fraud have come from federal, not state, entities. The U.S. Attorney’s Office in Minnesota has charged and convicted dozens of individuals in connection with the fraud; the overwhelming majority of whom are Somali.

However, the U.S. Attorney’s Office was recently decimated after the office’s top fraud prosecutor resigned in January alongside other federal prosecutors. Today, the Minnesota Star Tribune has reported that even more federal prosecutors have resigned.

Earlier this month, CBS reported that the Pentagon is planning to send military attorneys to the U.S. Attorney’s Office in Minnesota to assist with fraud prosecutions. CBS reported that the military attorneys’ assignment would begin in March.

She thought blocking ICE agents made her a resistance hero.

And this Gen Z Democrat got caught on camera doing exactly what got her federally indicted.

Kat Abughazaleh styles herself as a progressive warrior taking on the Trump administration's immigration enforcement.

The 26-year-old Democrat is running for Illinois' 9th Congressional District seat to replace retiring Representative Jan Schakowsky who's held the position since 1999.

But Abughazaleh's campaign hit a major roadblock when federal prosecutors unsealed an indictment charging her with conspiracy and forcibly impeding federal officers.

The charges stem from a September 26 protest outside ICE's Broadview Service Staging Area near Chicago where prosecutors say Abughazaleh joined a mob that swarmed a law enforcement vehicle.

Trump Justice Department Launches ‘Special Project’ to Investigate Jan. 6 Prosecutors

The Justice Department under President Donald Trump has launched an investigation into prosecutors who handled the criminal cases against defendants convicted of participating in the January 6, 2021, riot at the U.S. Capitol building.

Multiple sources told CNN they had seen an internal memo indicating the president’s intention to investigate those involved in the prosecution efforts against the Jan. 6 defendants.

Also, The order alleges that federal law enforcement and intelligence agencies were used to conduct politically motivated prosecutions, investigations, and other efforts against Americans.

This includes parents who spoke out at school board meetings about inappropriate material being presented to their children in the classroom and critics of the former administration’s policies. [truthpress.com]

Humiliated Prosecutors, Forced to Apologize to Judge in Trump Case

"After months of relentless attacks from the special counsel Jack Smith, former President Donald Trump has once again emerged victorious in court.

Michael Cohen testified under oath that prosecutors THREATENED him to get him to flip on Trump, taking aim at both him and his family.

During the Trump “hush money” trial in New York, Cohen, the former Trump attorney, revealed that he was pressured by desperate prosecutors who were willing to stoop to new lows to “get Trump.”

In 2018, Cohen plead guilty to federal tax evasion and making false statements to a financial institution regarding a HELOC loan. At the time he claimed that he pled guilty without any outside pressure but now, Cohen admits that prosecutors gave him an ultimatum to coerce him into making the plea.

The attorney revealed that he was under an IMMENSE amount of external pressure with prosecutors in the Southern District of New York telling him that if he didn’t plea guilty AND “flip” on Trump – they would INDICT HIS WIFE.

And it worked.

“I elected to protect my family,” Cohen said.

The judge’s daughter, Loren Merchan, is actively making money from this sham attack against President Trump, rendering Judge Merchan conflicted out.

Special Counsel Jack Smith Brings On War crimes prosecutor to get Trump

"There is not even a pretense in the Biden administration’s persecution of former President Donald Trump anymore. Justice is not being served, and in its place is an all-out barrage of attacks intended to derail the Republican’s 2024 presidential campaign.

Department of Justice (DOJ) Special Counsel Jack Smith added a new prosecutor to his team, and his goals are clear. Alex Whiting is there to assist in the White House crusade to put Trump behind bars for the rest of his life.

Politico reported that Smith and Whiting worked together previously in war crimes trials at The Hague in the late 1990s. This means Whiting’s extreme political direction is clear to the special counsel, and that’s what he wanted.

The prosecutor wrote several pieces supporting Robert Mueller’s witch hunt against the Trump campaign. Whiting insisted that Mueller had clear evidence against the then-president when it was soon apparent that he did not.

Records from Open Secrets showed he has shelled out thousands to Democratic candidates over the last decade and more. And not just any Democrats. Whiting’s money went to support extremists such as Sen. Elizabeth Warren (D-MA) and former President Barack Obama.

There is not the slightest chance that Trump will receive just treatment from this investigation. Adding Whiting to the prosecutorial team is only the latest indication that the former president is being railroaded."

Donald Trump's classified documents case took a dramatic turn on Monday as the judge overseeing his trial rebuked federal prosecutors and struck down two of their filings.

According to District Judge Aileen Cannon, a Trump appointee who is handling the case, prosecutors must provide an explanation for “the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or to seek post-indictment hearings on matters pertinent to the instant indicted matter in this district.”

The judge’s decision to rebuke the federal prosecutors marks a rare step by a court in striking down documents.

Democrats are wincing. Their criminal justice reform movement suffered a significant setback when two of its most high-profile progressive prosecutors, Kim Gardner of St. Louis and Rachael Rollins of Boston, unexpectedly resigned.

Gardner and Rollins are two who made national news for lessening prison sentences, promoting restorative justice, and holding police departments accountable. Both rose in prominence during the Trump years, because they were actively fighting the White House.

Although their resignations were not directly connected, the two prosecutors’ respective troubles show the two are poor leaders and crooked. They're DIMS, so who's surprised?!

Former President Donald Trump was criminally indicted last week by President Joe Biden's Justice Department, by way of Special Counsel Jack Smith, in relation to his alleged mishandling of government documents after leaving the White House in 2021.

Trump, the leading 2024 Republican candidate, vowed on Monday to appoint a "special prosecutor" of his own to go after "the entire Biden crime family" if he is re-elected as president next year.

That message from former President Trump came in the form of one of his increasingly typical all-caps posts to his Truth Social account Monday morning -- which has been changed to normal capitalization for ease of reading.

The Jan. 6 committee is preparing to urge the Department of Justice to prosecute former President Donald Trump on criminal charges during its business meeting on Monday, sources familiar with the matter told ABC News.

The committee has been debating the move for months and is largely symbolic.

Obstruction of an official proceeding and conspiracy to defraud the United States are two charges the committee plans to include in their criminal referral, according to sources familiar with the matter.

Another charge under discussion is insurrection, the sources said.

Wife of Trump special counsel produced Michelle Obama documentary, donated thousands to Biden

"FEC records reveal the wife of the supposedly 'impartial' special counsel Biden Attorney General Merrick Garland tapped to investigate Trump donated at least $2,000 to Joe Biden's presidential campaign in 2020."

On Friday, United States Attorney General Merrick Garland announced that Jack Smith, a "veteran career prosecutor" would serve as a special counsel to lead the ongoing investigations into Donald Trump being conducted by Biden's Department of Justice, and on Monday records show Smith's wife, Katy Chevigny, is a "high dollar donor" to Joe Biden and contributed to various high-profile Democrat efforts.

On Twitter, Henry Rodgers tweeted a screengrab showing that Katy Chevigny, through her production company Big Mouth Productions gave $2,000 to the Biden for President campaign in 2020.

Chevigny also gave to anti-semitic squad member and Congresswoman Rashida Tlaib.

They haven't been able to "get him" in 6+ years so they have resorted to special counsel--their last hurrah!

One of the bigger stories over the weekend was the appointment of a special counsel to continue the Donald Trump investigations. Even people who have been critical of Trump defended the former president. Disgraceful.

These investigations against Trump have been going on since before Trump took office. They continued throughout his presidency, and are still going on today. After six years, we have yet to see any charges brought against Trump.

Now, since Trump announced for 2024, Merrick Garland is moving the investigation from the DOJ to a special counsel, Jack Smith.

Senator Ted Cruz (R-TX) responded, “The Biden Department of Justice is thoroughly politicized and weaponized. “This is camouflage designed to set up the next step — which is the Biden Department of Justice intends to indict Donald Trump.”

Special Counsel Investigating Trump Has an Eyebrow-Raising History

There’s no reason to believe Jack Smith will be a fair arbiter while investigating Trump. Many of the same things being said about him (i.e. that he’s a straight shooter) were said about Robert Mueller, and we all saw how that turned out, with Andrew Weissman being allowed to run wild before moving on to becoming a far-left loon on MSNBC.

The right move here was for the DOJ to put up or shut up on charging Trump. If they had the evidence, they were welcome to pull the trigger. If they didn’t have it, then there was no reason to appoint this special counsel unless the point is to engage in another fishing expedition. And what a coincidence that it will drag out well into the 2024 election season, right?

Former Federal Prosecutor, Andrew McCarthy, says Real Issues with Hunter Biden’s Case Being Swept Under Rug

Hunter would be charged with tax crimes related to his business dealings and also a gun charge for allegedly lying on a federal form when he purchased a firearm while allegedly using illegal drugs.

While McCarthy was speaking with Fox News, he said that President Biden “should be worried” about the investigation and claimed that the bigger implications of this investigation are not being made public.

“I think the talk that we are hearing now about the possibility of a disposition of the case with tax charges and maybe the full statement that you refer to could be a choreographed event, where what gets swept under the rug is the thing that is of consequence to the country,” he explained, “which is the fact that foreign regimes, some of them hostile to the United States, such as China, poured millions of dollars, millions into the coffers of the Biden family.”

A clip from the 20-minute surveillance video shows Chang Suh repeatedly being kicked in the head by a man whom police have identified as Calvin Ushery,39.

The attack started shortly after the suspect pretended he was interested in buying something. When Suh’s head was lowered, the man grabbed him by the neck and pistol-whipped him.

The suspect then jumped over the counter and stomped on the helpless Suh, who was lying injured on the floor. He is now unable to walk.

Judge poised to release parts of key Mar-a-Lago raid document

Judge Reinhart ruled today that portions of the affidavit underpinning the FBI search of former President Donald Trump’s Mar-a-Lago estate would likely be made public – despite objections from the Justice Department.

West Palm Beach Magistrate Judge Bruce Reinhart — who signed off on the search of the 45th president’s home — said at the conclusion of the 77-minute hearing that “I believe — at least on my initial careful review of the affidavit — that there are portions that could be presumptively unsealed.”

Reinhart gave federal prosecutors until noon on Aug. 25 to submit a list of requested redactions and added that a partially blacked-out version would likely be released at some point in the future. The judge said the government will be given an opportunity to appeal if it doesn’t agree with his proposed redactions.
