Dustin Zacks' Public comment at Lake Worth City Commission Meeting.

Local Democrat "funny" guy lawyer and his suggestions for our new Lake Worth (Beach) Seal

Public Hearing
NAME Dustin Zacks
EMAIL dustinzacks@yahoo.com
ADDRESS 216 N Federal Highway #4
Lake Worth Beach, Florida 33460
United States
FOR OR AGAINST Against
PLEASE HAVE THE CHAIR READ YOUR
COMMENTS INTO THE MINUTES.
Please Read.
I am against the seal as drafted for the main reason that it does not
show or offer any inherent clues to the identity of our town to the
public at large:
Consider these far more worthy, identifiable-on-sight options, when
compared to the puny seal that has currently been proposed:
Option
1. A handsome banana tree, signifying we are not afraid to be
our own little banana republic;
2. A no cats sign, signifying our pro-endangered-bird and anti-cat
policies;
3. Before I forget I should also mention we may want to eliminate
some of the longer written words on the city seal so as not to
unnecessarily confuse any Michigan state graduates;
4. A silhouette of Panigiotti Tsolkas' historic protest, in which he
suspended himself from the overhead stoplight at Lake and Dixie to
protest the Lucerne Building;
5. Any alarming or conspiratorial phrase written in all caps by Lynn
Anderson, you know, something about THE SHEEPLE;
6. A slogan paying tribute to our most famous homegrown graffiti
artist, shouting "FREE FERAL!"
7. A picture of Scott Maxwell's face with town tribute slogan, "He's
our grumpy cat."
8. In light of my publicly expressed fervent opposition to the Pacific
Partnership of the Orient trade deal, an insignia stating that "Lake
Worth Beach is not down with OPP."
9. Instead of the flower on the seal, just put the actual kiss-from-arose-
singer Seal on the seal. Seal is a great singer and we are naming
the thing after him anyway, I mean it's called a seal, so this makes
epic double sense.
10. A salty old pelican, with his sign saying "Get off my lawn."
I trust you will see reason, reconsider, and select one of these fine
options. Thank you.

League of Women Voters

Comment Up

I was surprised to see The League of Women Voters in our town yesterday as they wrote our city off in October 2011 -- "The League has to be very careful to protect its nonpartisanship," League president Joan Karp said in an email. "Our conclusion after the Lake Worth debate is that we will only participate if we have control (over rules of the debate) and furnish the moderator."

Remember when the League of Women voters used to observe our election debate at the Lake Worth Playhouse in order to ensure fairness?  They were in our city every year for years.  Then came along a new mindset--"We're not going to allow candidates to lie or exaggerate the truth" according to one side of politics.  John Paxman stepped down for awhile, a local television station star was to be moderator but we ended up with hard-hitting John Rinaldi who took his place as moderator that year--clearly on one side of local politics. He asked the candidates questions and interrupted them, debating their answers, cross examining them as if they were on trial.  Waterman was the target along with Jo-Ann Golden. That was a contentious night, not only because of Rinaldi but candidate Dustin Zacks and his Zack Attacks against Rachel Waterman. Some in the audience actually walked out. After that, the League told Lake Worth to take a flying leap.

A goal of The League is to increase understanding of major public policy issues, and to influence public policy through education and advocacy, as well as through political lobbying of Congress but they say they're not political. This member from the League of Women voters told me yesterday that they do not believe there is any voter fraud.

Judicial Watch notified a dozen states that they must clean up their voter registration lists or face lawsuits. Judicial Watch and True the Vote subsequently filed lawsuits against election officials in Indiana and Ohio, and prompted the state of Florida and other states, without litigation, to remove thousands of ineligible voters from state registration lists. According to independent research published by Pew Charitable Trusts in February 2012, approximately 24 million active voter registrations throughout the United States – or one out of every eight registrations – are either no longer valid or are significantly inaccurate. Click here... for voter fraud stats.

And The League is not alone. Residents have given up on filing to run for office in this city--at least none have stepped up this year thus far. They have written off politics in our town and just want the slum, blight and crime to go away as candidates promised us in 2011.

The Cats Attack

Comment Up
Just call last night's city commission meeting  Comedy Central.

Feral cats are a problem, no doubt about it. Personally, I feel sorry for the poor animals that are abandoned to feign for themselves. Their owners should be rounded up and put in cages; that would be just.

Last night lawyer and Planning & Zoning board member Dustin Zacks notified the commission of a feral cat problem. Cats keep him up at night. You remember Dustin, the young man who went on the "Mayor Rachel Waterman attack" during the election, condemning her for her financial problems. He wouldn't let up during the debates, acting like a cat in heat--inferring that she was the biggest deadbeat in history and heavens knows why anyone would want to elect someone like that even though others running had their own financial problems.

And speaking of not letting up, he did the same thing with "cats" last night and interjected commentary under various city business items. They must teach you that in law school--twist any subject around to what you want to talk about. With dry humor, he did it well.

Feral cats are a problem. In our community we have been told by the City that it is OUR problem to solve. Forget about Animal Rescue; they don't help either. We had to hire a trapper. We did and the cats were hauled away. It seems that they come from the trailer park behind us on 6th Avenue South and those owners allow cats to roam around and reproduce like crazy. Every other week I hear gun shots coming from that area and it wouldn't bother me if everyone residing there would be put in a cage.

Lake Worth Board Appointments coming up

Comment Up

Board appointments will be coming up soon as terms expire. Applicants don't even have to sit through a public interview. They are appointed behind the scenes by the commission. We have no idea if anyone is qualified. If you go to the city web site, they don't even give you information any longer on the CRA's board members. Even though the city commission appoints CRA board members, it is off the city's web  site.  The CRA does not have to answer to the city commission or to the residents at all. They do have to submit a budget and the city has to be responsible for all debts they fail to pay. Everything is getting less transparent in the City of Lake Worth. Everyone should be asking, "why?"

Following are two of the top three city appointed boards members' lists. These appointees have a lot of power as to how our city looks, sometimes making decisions that are arbitrary to our desires. At times they get deeply involved in political issues and even go so far as to scorn city code and ordinances.  It is really important who is elected commissioner.

Lake Worth lawyer missing and so is millions

Comment Up
UPDATE: click here

Lake Worth lawyer skips out and millions missing

The firm's main office is at 2135 S Congress Avenue in Lake Worth but the firm also has an office at 30 S M St  Lake Worth, FL. No one knows much about it. They only see one guy coming and going. It was reported to me that the Sheriff was there the other day.

A few days ago, this story broke in the Post but I wanted to call everyone's attention to it.  Doctors and lawyers used to be pillars of our society. We all looked up to them. There are crooks in every profession, as we have been finding out. Abortion doctors killing live babies and now a foreclosure attorney absconding with possibly $50 million of escrow money.

I contacted one of Lake Worth's own foreclosure attorneys and asked him what he thought about it all. Here is his reply:

"Crazy, never met the guy but I've biked by his office. vultures - that's what I always tell prospective clients to beware of.  I've heard more horror stories in terms of people being swindled by attorneys and/or "loan modification experts" who promise the moon than I care to recall.

Dustin A. Zacks, attorney, writes new Paper on attorney misconduct

Comment Up

Click here for Dustin Zacks' latest paper on the misconduct of some foreclosure firms that popped up during the mortgage crisis and their highly questionable and unethical practices. The report is interesting and provocative beginning like a "thriller." As many of you know, Dustin was appointed to our Planning & Zoning board by last year's commission and he previously "ran" for mayor of Lake Worth.

The Paper, entitled, Robo-Litigation, points out the shady practices, the over-billing, the conflicts of interest and bad dealings made by some foreclosure firms with the Florida Bar and the Florida Supreme Court doing little, if anything, to keep the system honest or come down strong on those involved in unprofessional practices. One of these lawyers became wealthy by over a hundred million dollars. Many analysts, including conservatives such a Republican Senator Marco Rubio, have stated that the housing crisis was "created by reckless government policies.”

"The recent housing crisis increased demand for attorneys to process foreclosures through state courts. This increase in demand was coupled with a desire for the fastest and cheapest legal services available. As a result, large foreclosure firms designed to handle an enormous number of foreclosure cases quickly and inexpensively evolved and flourished. During their ascendancy, these firms consistently generated complaints about their conduct, including questions about their ethical decision-making and about the veracity of the pleadings and documents they filed. Scholarly literature on the housing crisis, however, is largely devoid of commentary on ethical issues related to increased foreclosures."

He concludes that the foreclosure crises was the perfect storm that bred robotic attorney practices resulting in "severely troubling ethical lapses."

Public Commentary at last night's city commission meeting

Comment Up

Last night I wore my new t-shirt that said, "Bad decisions make the best stories." I have to say that in Lake Worth, one never runs out of ideas. Thanks to Commissioner Amoroso for addressing my 3 points I made during Public Commentary, one of the first commissioners who has ever done so:

L Street Parking Lot--
The City entered into a Contract on February 1, 2011 to September 30, 2011 for the sum of $10,000 which comes to $1,250 a month which seems like a reasonable rate. It was signed by the Parties (Mayor Rene Varela signing for the City) on February 10, 2011. We  pay the owners, Lucerne Holdings LLC, rent and charge parking fees to those using the parking lot thus helping to off-set the cost to the taxpayers of Lake Worth and hopefully paying for the Lease. I don't recall this renewal ever coming back before the city commission since the original contract. Now that the commission has abrogated rights to the city manager by increasing his authority on expenditures from under $15,000 to $25,000 without commission approval, we may never see these things again or even be allowed to speak to these issues. I look to the City Commission to be on top of all expenditures.

Two-way traffic at the beach--(Thanks, Dustin Zacks!)
Dustin turned in a comment card and with tongue and cheek with a little bit of truth--he wanted to ban all drivers over 55 from driving at the beach...too slow.  I remember when I thought 30 was too old and that they all were "out of it."  Unfortunately, the design there is atrocious and dangerous. Over this past weekend, the city made it a two-way street. We had cars backing out on both sides and traffic coming in two directions.  It was unreal.  If you don't drive 2mph, you will be a victim in that accident waiting to happen and 55 or older folks know that. Just think, Dustin--one of us old birds might have saved you. Thank us.

Glen Torcivia contract
When he and his firm were hired back in July 2012, it was on an interim basis and to be evaluated in six months. The concept of having an outside law firm to represent us in our city on day to day legal issues was new.  We always had our own staff lawyer. With that brought easy access but it also brought retirement and costly benefits. The value of an outside firm was to be analyszed as to cost effectiveness, accessibility and whether he was doing an overall good job for the City of Lake Worth.  The firm would have lawyers on staff who specialized in various issues relative to city business. Other than Torcivia agreeing to a settlement to the flim flam man,  he appears to fit right in but we need to know if we are getting the best bang for our buck.

King, Nieves & Zacks volunteers services to distressed homeowners

Comment Up

West Palm Beach, FL, December 13, 2012 –

The law firm of King, Nieves, Zacks, a West Palm Beach boutique litigation firm, announces its plan to volunteer to take on up to 10 pro bono foreclosure defense cases on behalf of distressed homeowners.

“As the holiday season is upon us, we want to give back to our community as a thank you for the unprecedented success of our first year as a firm. We want to do our small part by volunteering our services to some of the neediest in our community. We seek to assist troubled homeowners who may not ordinarily be able to afford legal representation,” said attorney Dustin Zacks.

“Having published extensive research on the foreclosure crisis, I realize that many in our community will surrender their homes without consulting an attorney. This holiday season, we do not want the neediest among us to face the new year at risk of being thrown out of their homes simply because they may not be able to afford an attorney,” Zacks said

King, Nieves, Zacks PLLC will be dedicating Friday, December 21, 2012 to meeting with prospective pro bono clients. Homeowners may schedule a meeting no matter the stage of their cases, and are encouraged to bring their court documents with them for foreclosure defense attorneys to examine.

For more information and to schedule an appointment for possible pro bono representation, call (561)855-7620 or visit the King, Nieves, Zacks website at www.knzlaw.com.

King, Nieves, Zacks is located at 2240 Palm Beach Lakes Blvd., Suite 250, in West Palm Beach, between Okeechobee Blvd. and I-95.

Lake Worth's Dustin Zacks gets Cited

Comment Up

Dustin Zacks, member of Lake Worth's Planning & Zoning board, just had an article cited by the Washington Supreme Court

Published on Monday, 03 December 2012 13:25

King, Nieves & Zacks is pleased to announce that the Supreme Court of the State of Washington has cited Florida foreclosure attorney Dustin Zacks' Quinnipiac Law Review article in the case of Bain v. Metropolitan Mortgage Group, Inc. In that pro-homeowner opinion, the Court held that Mortgage Electronic Registration Systems, Inc. cannot be deemed a beneficiary to deeds of trust (the equivalent to mortgages in Florida) when it never held the original promissory note secured by those deeds of trust.

In the opinion, which can be found by clicking here, the Washington Supreme Court twice cited Zacks' Quinnipiac Law Review Article discussing Mortgage Electronic Registration Systems' standing in foreclosure litigation. The Court even cited Zacks' article as substantiation of the fact that foreclosure servicers and lenders sometimes issue incorrect or fraudulent assignments.

Planning & Zoning Board Lake Worth

Comment Up
There was no reasonable explanation as to why the visionaries on the City Commission wanted to kick the former Planning & Zoning board to the curb--a Board that had done a highly professional job. This was unprecedented in the City of Lake Worth. Bullying from the dais is unacceptable to most reasonable people. The Commission has the final word anyway. Even the Member Log of the P&Z was altered to reflect that all their terms expired on 6/26/12. They made sure that all of their ducks were in a row.

Now we have a predominance of people on this Board who are more inclined to have their "vision"... higher buildings in the downtown with the taller buildings already here as exceptions. They even want higher buildings in certain residential areas.

Someone asked a question on this blog regarding education of the final members of the new "visionary" Planning & Zoning Board. Although education is important and certainly necessary when choosing a "qualified" candidate as that entails a profession of some sort such as law, architecture, etc., (a new requirement for this Board), higher education is not everything in life and does not guaranty success or that someone will be better at this volunteer position than someone without a degree.

Usually college graduates make more money than those who do not. There are always exceptions and huge success stories come to mind: Bill Gates and the late Steve Jobs. My grandfather was an immigrant from Scotland with a 9th grade education but he was the most educated man I have ever known and a big success in his life, actually living the American Dream that so many get the opportunity to do in this great country through hard work.

I found his answers to questions to be in alignment with my own other than his wanting to attract more young people to the city. We have an abundance of young here with the average age at about 34.  Attracting more affluent would help build up the neighborhoods and those people are usually older than our average age with over 56% of our populous under the age of 44. The average age has drastically changed over the last several decades.

Final applicants for Lake Worth's Planning & Zoning Board

Comment Up

I am interested in all the volunteer boards within Lake Worth but mainly the following three Boards : CRA, Historic Preservation and the Planning & Zoning board because these boards have the influence to change Lake Worth.

As this new commission is making a big move to change the face of our city by eliminating the present Planning & Zoning Board and pack it with their "friends," the following people have submitted applications to the P&Z. The application process is now closed. Those indicated below said that the P&Z was their 2nd choice for a board appointment. Only four people applied to the 7 member Historic Preservation Board: Wes Blackman, Clara Kim Hanson, Judy Just and Herman Robinson.

After being treated abominably by our present commission and being kicked to the curb, only two previous members of the Planning & Zoning Board have re-applied.

13 Applicants to P&Z:

Wes Blackman (2nd choice)
Mark Humm (2nd choice)
Judith Just (2nd choice)
Frank Palen
Mark Parilla
Greg Rice
John Rinaldi
Herman Robinson (2nd choice)
Kate Sheffield - reapplied
Dean Sherwin
Laura Starr (2nd choice)
Robert Waples - reapplied
Dustin Zacks (This will be his reward for Waterman Zack attacks)

So, if you eliminate all those who marked the Planning & Zoning as their 2nd choice, that leaves all of the above less one.

This will be the volunteer leadership of our city.

Where's Dustin Zacks

It appears that Dustin Zacks, the young attorney who "ran" for mayor last year in Lake Worth, is moving up in the world. It was just a short time ago when he was into Zack Attacks. Now he is a partner in his own law firm: KNA Attorneys at Law.

KING, NIEVES & ZACKS, PLLC, located in Palm Beach Gardens, is described as a boutique litigation firm representing individuals and businesses at all stages of litigation, trial, mediation and appeal. They say that they are "dedicated to providing you with outstanding legal services that are tailored to your individual needs. As your advocate, we understand that your individual needs are paramount. We will strive to meet your goals from helping you avoid a lawsuit to helping you file suit to hold someone accountable that has wronged you."

He's not talking about politics here when it comes to "wronging" someone.

Robo-Signing Foreclosure Debacle

Comment Up
We can all remember Dustin Zacks and all of his attacks in the last election regarding Waterman and her foreclosures. It has heavily come to light, as we all knew then but not to the same degree as we do now, all the fraud that was committed by banks in the mortgage loan business. People were victims of the corrupt banking system.

Now Obama has a new scheme to help out the banks, and foreclosures are predicted to rise again because of this latest plan.

"State and federal governments have condoned forgery, perjury and fraud in what’s been called the “robo-signing” foreclosure debacle. Last week, the five biggest banks in America signed on to a $26 billion deal that, basically, lets them off with a slap on the wrist for fraudulently foreclosing on homes in the last few years. I am not going to go on and on about how unfair and unjust this deal was or how the rule of law has been thrown down the stairs. I am going to focus on the fallout of this morally corrupt deal."Obama says that this is good for struggling homeowners.

Read more at USAWatchdog that disputes Obama's claim. If true, our city will be affected in a big way. The commission will either have to special assess or worse; it will have to reduce spending to a degree that is unimaginable and Mr. Zacks will have more business than he can handle as mortgage defaults are projected nationally to rise over 10 million over the next decade.

The Razzie Award goes to Vice Mayor Scott Maxwell hands down.

No one else came close to him in attitude, demeanor and for his overall bullying of the city manager and undermining her at every opportunity. It was like one sick game played in real time twice a month. As the City moved forward in its policy direction, Maxwell fought the city manager at every turn. He chose his battles and voted with the old commission over 95% of the time. Even though he loved the "free lunch," he only voted "no" on the Budget as well as on financial issues involving the Casino. He constantly complained about not getting the back-up to the Agenda in a timely fashion and mentioned his displeasure in anyone putting something on the agenda at the last minute. He changed his top priority from code enforcement and eliminating slum and blight to the Park of Commerce development and for the approval of a plan to spend $11.05 million dollars over 15 years at today's value. He changed our beach from a beach/park destination to a bar focus caring only about the price per s.f. He wanted open and transparent government. As the City was finally working its way step by step out of the black hole, Maxwell pulled away the ladder and fired the city manager by putting the matter on the agenda at the last minute, never giving one reason for the manager's termination. Even though he was holding the majority vote, he was unsure of his ability to lead the city manager. He even attempted to stifle public commentary on the issue. Many of his "speeches" were right out of the Republican Play Book.

On City Board Appointments

Comment Up
Yeah, I know. I gave Dustin Zacks, former candidate for Mayor, a "hard" time. It was no where near as hard as he gave to Mayor Waterman, a woman who is raising a family and making a sincere effort to rise above the economic hardships that she and millions of Americans have endured over the past several years.

But Mr. Zacks was right when he talked about volunteer city boards and the politics behind some decisions. Zacks also suggested that the city do background checks on those individuals applying and in so many words he said not to appoint jail birds. I agree with all of that. It is just common sense.

Wellington will now have a new Ordinance that will make it easier for boards to kick out their own members if they miss 2 meetings in a row or 4 out of 6 meetings for any reason. They will also be doing background checks. One city councilwoman complained about the cost of a criminal background check but background checks don't have to be in-depth or costly. If there is a felony conviction within 10 years of appointment, that person will not have a chance on a city board. They are not doing a credit check, the very thing that was used against Waterman. At least Wellington understands someone's finances or lack thereof should not be held against them.

I would like to see The City of Lake Worth take stronger action and not be allowed to appoint anyone who is 1) an anarchist or 2) convicted of any crime. I think we should even be tougher than Wellington and not limit it to just felonies. There are many despicable acts that are anti-government and anti-social that should be considered when a government appoints anyone to represent the city.

End the Free Lunch in Lake Worth

Comment Up

As Commissioner Scott Maxwell will be on one of those "free lunch" excursions, this time to Phoenix for a National League of Cities Economic Development Conference, we will not have the election swearing-in ceremony until Monday, November 14, 2011 at 9:30 AM.

The Economic Development Conference which is being held November 9-12, is supposed to help local leaders foster global economic linkages and encourage entrepreneurship and small business — both critical ingredients to more competitive cities in a 21st century economy. Now I ask, why in the hell are we sending someone to Phoenix? For global linkages? Our problems are much more immediate than that. Zacks and I agree on this one. The free lunches need to end.

In reality, this conference is nothing more than a FREE LUNCH on the taxpayers of Lake Worth who were just taxed a special assessment by a city commission that also raised advalorem and other taxes. As Zacks would say, "Get real."

Dusty said, the truth will set me free

Comment Up
Dustin thinking he was playing us like a fiddle spewing out facts of truisms, actually was played.

Believing in truth, justice and the American way, he wanted to believe all the big bad wolf stories about anarchists, losers and such. He didn't mind going on the attack just so long as "his word" got out. Being used did not bother him as he had justified it all in his mind, somehow, some way. He had to do it, he said to himself, afterall, that stupid commission turned me down for a city board appointment.

He managed to get out one anti Waterman mailer. Those who sent him contributions for this purpose were:

Laura Starr...$200 (both wife and husband as well as their law firm contributed the maximum in the last election and lost a bunch of money. They want to see a big return on Tuesday)
William Smythe...$200
Teresa Miller...$100 (one of those vocal people who fought for PBSO)
J. R. Frey...$500 (those illegal signs are STILL on his property)
Dwight Saxon...$500 (Secretary of The Lucerne Association and a Greg Rice connection)

And then he partied at The Cottage.

Zacks Attacks

Comment Up
I thought we were through with "bustin" Dustin but lo and behold a Zack attack mailer was received today. Now how did he do that with only $413 left in his campaign account.

The G4's had to be in by 5pm on Friday so by Monday we should be able to see what's going on with contributions, if we can even believe what we see.

Dustin Zacks "drops" out of race

Comment Up

It is unconfirmed but apparently Dustin Zacks has "officially" dropped out of the mayoral race because he put out a press release stating so and throwing his support to Triolo because he doesn't want the City to pay for a run-off election. However, he is on the ballot and there very well could be a run-off but I doubt it. He can't really drop out. Of course, he never was really in it, not really. Now he wants to have a party at The Cottage tomorrow night to celebrate. Celebrate what? Crusty Dusty. He was a drop-in who has now dropped-out.

I have a problem with ALL "occupiers" and just people who are a general pain in the azz and a waste of time even if they are smart lawyers just wanting to cause havoc as are the socialist occupiers of our city parks who are there to whine and complain and over-throw democracy.

The Cottage? That certainly is an appropriate place to have a party since the owners already pulled off their own special havoc on the City of Lake Worth. Birds of a feather? More like vultures.
