GOP senators confront former Biden pardon attorney over clemency push for Dylann Roof, federal death row inmates

Republican senators turned a confirmation hearing for acting Attorney General Todd Blanche into a sustained confrontation with the former Biden administration pardon attorney who recommended clemency for all 40 federal death row inmates, including the man who walked into a Charleston, South Carolina, church in 2015 and shot nine Black parishioners to death during Bible study.

Sen. Josh Hawley of Missouri led the charge Thursday on Capitol Hill, pressing Elizabeth Oyer over a 73-page memorandum she authored in November 2024 that urged President Joe Biden to spare every inmate on the federal death row.

Democrats had called Oyer as their chief witness against Blanche's nomination. By the time Republicans finished questioning her, the witness they summoned had become the hearing's central liability.

The exchange, reported by Fox News Digital, laid bare a question that should trouble every American who believes victims matter more than their killers:

Hawley went straight at the most indefensible names on Oyer's list. Dylann Roof murdered nine parishioners at Emanuel African Methodist Episcopal Church in Charleston. Robert Bowers killed 11 Jewish worshipers at the Tree of Life synagogue in Pittsburgh in 2018. Dzhokhar Tsarnaev carried out the Boston Marathon bombing. Oyer recommended clemency for all three.

How did a senior Justice Department official produce a 73-page clemency recommendation that, according to a DOJ report cited during the hearing, devoted just three paragraphs to the grievances of victims' families?

Former Biden Aide Neera Tanden Does Not Know Who Ordered President’s Autopen Signatures

She admitted that aides were allowed to sign for pardons

Neera Tanden, a former top aide for President Joe Biden, told Congress that she had authorization to direct autopen signatures for the president but does not know who gave the final order.

Tanden served as the director of Biden’s Domestic Policy Council and she told Congress during a testimony on Tuesday that the president used an automatic signature tool allowing for aides to sign pardons, memos, and other official documents in the White House. Tanden said she did not know who authorized those signatures. Per Fox News:

During Tanden’s interview before Congress, which lasted more than five hours, she told lawmakers that, in her role as staff secretary and senior advisor to the former president between 2021 and 2023, she was authorized to direct autopen signatures on behalf of Biden, an Oversight Committee official told Fox News.

Tanden, who reportedly said during her testimony that she had limited interactions with Biden in her role, according to sources familiar with her testimony, described an approval process that left her – at least partly – in the dark about who specifically was giving final approval on the decisions to use the automatic signature tool, even though she simultaneously insisted Biden was in charge.

Tanden reportedly testified that to get approval for the use of autopen signatures she would send decision memos to members of Biden’s inner circle. However, she added that she was not aware of what actions or approvals took place between the time she sent the decision memo and the time she received it back with the necessary approval, according to the source familiar.

The expectations for pardons have already begun influencing legal proceedings, with some defendants requesting courts to pause their cases in anticipation of Trump's return to power.

Defense attorneys report growing inquiries from clients about potential pardons, while prosecutors continue to oppose delay requests based on speculative clemency promises.

The View Host Urges Presidential Pardon For Hunter Biden Before Trump Takes Office

"According to Daily Mail, The View host Ana Navarro has publicly called for President Joe Biden to pardon his son Hunter for gun and tax evasion crimes before Donald Trump assumes the presidency.

Hunter Biden faces sentencing in December for three felony gun charges and nine federal tax charges. The president's son was convicted of the gun charges in June 2024 and entered guilty pleas for tax-related offenses in September. Despite mounting pressure, President Biden has consistently maintained his position against pardoning his son or commuting his sentence.

The younger Biden could potentially face up to 25 years in prison for gun-related charges, which include lying to a federally licensed dealer and illegally possessing a firearm while being a drug user. The tax case carries additional penalties of up to 17 years imprisonment and potential fines reaching $1.3 million.

Both cases are overseen by Trump-appointed judges, with sentencing dates set for December 12 and December 16 respectively."

On Wednesday, Trump met with Joe Biden for a reported two hours. I would bet that Hunter was a major topic in their conversation. Biden has always said that he will not pardon his son but allowing the next president to do so would be a great negotiation. Joe ends up looking like a stand-up guy, at least as far as his criminal son goes.

Trump says he wouldn't be opposed to pardoning Biden if he's reelected in November. Trump told conservative radio host Hugh Hewitt last month “I wouldn’t take it off the books . . . despite what they’ve done to me,” when Hewitt asked if he was open to pardoning the younger Biden, suggesting he was taking a moral high ground compared to the Justice Department, which he claims has unfairly prosecuted him.

Something was agree upon; you can bet on it...and the new administration won't go after Joe. I believe that Trump negotiated The Art of the Deal again with a quid-pro-quo---Hunter gets pardoned and the January 6th prisoners get pardoned, or at least most of them.

To refresh your memory--The indictment against Hunter Biden, 53, was filed in California. It includes three felony counts of tax evasion and filing a false return and six misdemeanor counts of failure to return. The Department of Justice (DOJ) accused Hunter Biden of not paying at least $1.4 million in self-assessed federal taxes between 2016 and through 2019, and evading the assessment of taxes in 2018 when he filed false returns.

President Donald Trump promised Wednesday night that if he is elected he will pardon a "large portion" of the people convicted of federal offenses for their participation in the Jan. 6, 2021, attack on the U.S. Capitol.

"I am inclined to pardon many of them," Trump said at a town hall hosted by CNN at Saint Anselm College in New Hampshire. "I can't say for every single one, because a couple of them, probably they got out of control."

He added that "most likely" he would pardon "a large portion of them."

"And it'll be very early on," Trump said.

“I mean full pardons with an apology to many,” Trump told Bell while discussing how a hypothetical Trump administration would respond to January 6 defendants.
