Appeals Court: Trump Can Try to Overturn His Conviction in the Fake Stormy Daniels Case

A federal appeals court has ruled that Judge Juan Merchan treated President Donald Trump unfairly in the completely fake Stormy Daniels hush money case.

The court will allow Trump to revive his bid to overturn his conviction in what the media calls “34 FELONY COUNTS.” The president can now try to have the case moved to federal court.

Sorry, Democrats. It looks like you won’t be able to falsely smear Donald Trump as a “convicted felon” for much longer.

Trump’s lawyers tried to move the case to federal court last year, but Judge Merchan refused to even consider that. Merchan’s daughter is a fundraiser for the Democrat Party, and she was raking in a small fortune by breathlessly updating Democrat donors on how her dad was putting Trump through a kangaroo court.

The three-judge panel on the 2nd Circuit Court of Appeals said that it “cannot be confident” that Merchan adequately considered Trump’s bid to move the case to a federal court.

“The court bypassed what we consider to be important issues bearing on the ultimate issue of good cause,” the judges wrote.

The U.S. Supreme Court ruled against a bid from the attorneys for President-elect Donald Trump to delay the sentencing in the case involving hush money paid to adult movie worker Stormy Daniels.

Yesterday, the court ruled in a narrow 5-4 vote against Trump.

"First, the alleged evidentiary violations at President-Elect Trump's state-court trial can be addressed in the ordinary course on appeal. Second, the burden that sentencing will impose on the President-Elect's responsibilities is relatively insubstantial in light of the trial court's stated intent to impose a sentence of 'unconditional discharge' after a brief virtual hearing," read the ruling.

Trump will face sentencing at 9:30 ET, although he will be allowed to attend the ruling via video conference. Merchan is determined to make Trump a felon.

In a surprising move on a lightning-quick timetable that is unlikely to stand if challenged, the New York court that presided over the Stormy Daniels hush money criminal trial of Donald Trump ordered him on Friday to be sentenced on Jan. 10, just 10 days before he will assume the presidency once again.

The liberal sneaky judge signaled that Trump would get an “unconditional discharge,” meaning no jail time or probation, but sentencing would still cement the former and future president as a convicted felon.

If Trump seeks an emergency stay blocking the sentencing—and it will not surprise us if he goes all the way to the U.S. Supreme Court if necessary—we expect he will succeed.

But on Friday, in the aftermath of Trump’s presidential victory, Merchan canceled next week’s scheduled sentencing and reluctantly agreed to formally consider a defense motion to dismiss the case entirely. A sensible and fair judge would grant it. That may exclude Merchan.

“He could have exercised his discretion here to change the sentencing date,” Yoo explained. “But instead, he actually moved it closer to the beginning of absentee voting in my home state of Pennsylvania.”

Ultimately, Yoo concluded that because Judge Merchan has steered Bragg’s case from the beginning in order to maximize its impact on the Presidential election and help Democrats, that’s likely what he’ll continue to do next month.

But this judge has used discretion every time to try to force this trial in a political direction that will have an effect on the election,” Yoo concluded.

Fox News obtained the letter Judge Juan Merchan shared with Trump defense attorneys and Manhattan prosecutors.

That means that in order to find Trump guilty, the entire jury would have to agree that Trump committed a specific crime.

But per usual, these are not normal circumstances.

Merchan told the jury that if they thought Trump was guilty of ANY one of the three crimes – even if they didn’t agree on which one – he would accept it as a unanimous guilty verdict.

The three crimes in question were:

The falsification of business records
Tax violations
