You Might Have Missed It, But Ray Epps’ Lawsuit Against Tucker Went Down In Flames

A federal judge dismissed a January 6th defendant’s defamation lawsuit against Fox News and its former primetime TV anchor, Daily Caller co-founder Tucker Carlson on Wednesday.

Delaware Federal District Court Judge, Jennifer Hall, ruled that Carlson’s reporting on Epps was protected under the First Amendment because Epps’ lawyers did not prove Carlson had acted with “actual malice.”

“For the reasons announced from the bench today, it is hereby ordered that Defendant’s Motion to Dismiss for Failure to State a Claim is granted,” Hall, a Biden appointee, wrote.

Members of the corporate media claimed that Epps would win his lawsuit against Fox News and prove Carlson had acted with “actual malice” in his reporting on the Jan. 6 defendant, according to an MSNBC discussion on the defamation case led by former Republican National Committee chairman and MSNBC political analyst Michael Steele on July 16, 2023, following news of Epps’ lawsuit.

January 6 footage shows that Ray Epps lied to the J6 Committee about when he left the Capitol on that day. J6 Committee members likely knew this but defended him anyway. Ok, Fox...what say you now?

DOJ Recommends Reduced PRISON TIME for Ray Epps While Innocent Patriots Rot Still Awaiting Trial

Well, well, well, isn’t this just the cherry on top of the unfairness sundae?

Ray Epps, a man who was caught on camera allegedly egging people on to storm the Capitol on January 6th, 2021, is being recommended for a measly six-month prison sentence by none other than the Department of Justice.

Now, I’m not a legal expert, but doesn’t that seem a tad lenient considering the gravity of what transpired that day?

Sure, let’s just give him a slap on the wrist and call it a day. That’s like sending a kid to bed without dessert because he accidentally burned down the house.

Many folks over at share this sentiment – and then some. They’re convinced that Epps was an informant for the FBI. If that’s true, then this tale just took a turn straight into a Hollywood thriller. An alleged instigator, working for the feds, gets a light tap on the shoulder instead of a firm push into a prison cell. Now, isn’t that an interesting theory?

Why was Ray Epps treated as victim by the same people who condemned almost everyone around him as a threat?

Tucker Carlson, accused Epps of being an agent provocateur and linking his wife to Dominion Voting Systems. In September, 2023, he was charged with and pleaded guilty to a single misdemeanour count of disorderly conduct for his participation in the attack.

Far-right conspiracy theorists, members of Congress, and even the former president himself suspected Epps as a potential tool of a sort of "deep state" conspiracy seeking to discredit Trump's movement.

Revealed by the House Judiciary Committee, Epps told his nephew that he “orchestrated” what transpired that day in 2021.

Ray Epps to Be Criminally Charged by DOJ, Blames Tucker Carlson

A lawsuit from Ray Epps, a shadowy figure at the edge of multiple theories concerning the Capitol incursion, says he has been charged by the Department of Justice more than two years after the events of Jan. 6, 2021.

The claim is contained in a defamation lawsuit Epps filed against Fox News. In the lawsuit, Epps blames former Fox News host Tucker Carlson for having the spotlight thrust upon him, leading to threats from Trump supporters and, eventually, charges against him.

Epps was a highly visible figure in multiple videos from the incursion. Epps was originally among those pictured on an FBI wanted notice in the days immediately after Jan. 6 but was removed from the list in July 2021. Speculation ran rampant that because he was not charged, Epps was a federal agent whipping up the emotions of protesters.

Infiltration at Capitol Protest

It is still beyond belief that so many people have been arrested, imprisoned, and sentenced in connection to what took place on January 6, 2021 for simply going inside the Capitol building. Those who did do damage and stole stuff, I agree, should be prosecuted. But those who were there to protest and were seemingly permitted entry by the Capitol police should not be going through this.

To comment on this situation, Gary McBride said: “Those black gates in the video are as weak and flimsy as a cheap dog fence you can purchase on Amazon...If you look carefully, you can see Ray Epps in the video below seemingly motion with his hands to people around him to pull the fence up, not push. Somehow, he knew that these kinds of fences can easily LIFT out of holes in ground without much effort required! This can be verified if one takes some time to carefully watch how Epp’s hand gestures correspond with what occurs next”.

What’s perhaps even more puzzling than Ray Epps' knowledge on short-term fencing solutions is why exactly Ray Epps himself isn't being targeted by law enforcement agents when other members of his group are being prosecuted? Is he being protected by someone or something else? And why is it so difficult for attorneys involved in these cases to say his name aloud?

In the two years since a mob forced its way into the U.S. Capitol, more than 950 people have been charged for their roles in the riot, and the Federal Bureau of Investigation continues to seek hundreds more. So, what about Ray Epps?

Ray Epps Claimed He Believed Capitol Was Open to Public on January 6

Ray Epps, a mysterious January 6 figure some theorized to be a federal informant, told congressional investigators he believed the U.S. Capitol was open to the public on the day of the riot.

The assertion appears in a long-awaited transcript released Thursday by the House January 6 Committee, which released its final report last week. Epps, a self-proclaimed supporter of former President Donald Trump who raised concerns about the 2020 election, was asked about January 5, 2021, video footage showing him urging a crowd to “go into the Capitol” the next day.

Epps said “yes” when asked if he was under the impression that the Capitol would be open on January 6, the day lawmakers met to certify President Joe Biden’s 2020 election victory. He again said “yes” when the word “open” in this case was described as “like, open to visitors, like anyone could walk in.”

Now why do we believe he is a "mysterious" figure. He was wearing a Trump hat and Epps was caught on video before January 6 as he incited Trump’s supporters to “go into the Capitol.” But, he was never charged by the January 6 Select Committee.

Of course, Epps denies the conspiracy theorists that he was with the corrupt FBI.

But Not by President Trump

As the two year anniversary of January 6 is coming up in six days, most of those who went to the Capitol that day were protesting the election in support of Donald Trump. On January 6th, the Capitol building in Washington DC was entered by pro-Trump supporters. We all saw the chaos. We saw where Ashli Babbitt, an Air Force veteran, was murdered by a Capitol policeman, the only person who died that day.

This event sparked a flurry of accusations and counter-accusations about who was responsible for the violence and chaos that erupted as well as who got the crowd excited.

Donald Trump told the protesters to march peacefully and patriotically to the Capitol. But it didn't matter what he said as the Democrats were out to lynch him. They blamed the day entirely on Donald Trump, thus the haters formed the January 6 Select Committee to ensure all the details would come out and Trump would be indicted on a criminal charge. They all salivated, picturing Trump in handcuffs and eventually in stripes

While many in the media and the Democratic Party were quick to blame the outgoing President Trump for inciting the mob, a closer examination of the events reveals that the notion of a “Trump-led insurrection” is unfounded.

And what about Ray Epps?

I would imagine, now that the Jan 6 Select Committee is over, Ray Epps was an important figure in the Capitol protest but Ray Epps is not mentioned in the 845-page J6 Committee report.

New Tapes, Interviews Released on Ray Epps Reveal That He Lied But Was Never Arrested

Several individuals and groups have issued FOIA requests to the FBI about Ray Epps, but the agency refuses to comply.

It’s not hard to figure out why when you look at his actions from January 5th to the 6th. On the fifth, Epps defended ISIS and then told people they needed to enter the Capitol the next day.

He defended Antifa while standing next to Antifa leader, John Sullivan, who did enter the Capitol the next day but was also not facing trial or hanging out in the DC gulag.

Imagine that. Does anyone else find this to be curious? Both men incited a riot, but neither one was jailed.

Trump told the protesters to march peacefully and they call that incitement to riot, but Epps telling people to storm the Capitol isn’t. Something smells fishy about this.

Epps has long denied being an informant for the FBI or other law enforcement entity on Jan. 6. His photo—assigned No. 16—was initially placed on the FBI’s Jan. 6 most-wanted website, but it was later removed without explanation. Epps hasn’t been arrested or charged with crimes for being at the Capitol.

And he hasn't been called to the Jan 6 un-Select Committee either.

It is still believed that government operatives, who infiltrated the crowd, incited the protesters. It's also been said that those who were infiltrators wore their MAGA caps backwards so they could be easily identified to other government operatives.

He is convinced people were embedded in the crowd to execute “an organized operation planned well in advance of the January 6 joint session of Congress.”

According to Waller, a “covert cadre” of people were scattered throughout the crowd to encourage people toward the Capitol, including “fake Trump protesters” he suspected were Antifa “wearing Trump or MAGA hats backwards.”
