Trump agrees with the Supreme Court on Abortion

Trump says abortion laws should be decided by US states

SCOTUS already decided on this nearly two years ago.

Trump reiterated that he backed exceptions for rape, incest and to protect the life of the mother, and also that he supported the availability of in-vitro fertilization.

A call for a national ban could have dented Trump's support in the six or seven U.S. states that swing between Democratic and Republican candidates and are therefore likely to decide the election outcome.

Overall, 57% of Americans think abortion should be legal in most or all cases, a March Reuters/Ipsos poll found.

The opinion, written by Justice Samuel Alito, said that the Constitution does not mention abortion. Nor does the Constitution guarantee abortion rights via another right, the right to liberty.

The opinion rejected Roe’s and Casey’s argument that the constitutional right to liberty included an individual’s right to privacy in choosing to have an abortion, in the same way that it protects other decisions concerning intimate sexual conduct, such as contraception and marriage. According to the opinion, abortion is “fundamentally different” because it destroys fetal life.

Alito began his 79-page opinion by observing that abortion “presents a profound moral issue on which Americans hold sharply conflicting views.” But the Constitution does not refer to abortion at all, Alito stressed. And although the Supreme Court has recognized some constitutional rights as protected by the due process clause, even if they are not expressly mentioned in the Constitution, the right to an abortion is not one of them.
