Judge Talwani Forced to Lift Mail-In Ballot Injunction After Supreme Court Rebuke

That didn't take long

Obama-appointed U.S. District Judge Indira Talwani has lifted her nationwide injunction blocking new Postal Service safeguards for federal mail-in ballots.

The move came after the Supreme Court rejected a separate injunction tied to the same election-order fight. The Justice Department then asked Talwani to reconsider her own ruling. On Wednesday, she issued a nine-page order lifting the freeze.

Talwani acknowledged that the League of Women Voters plaintiffs are “not likely to prevail as to ripeness” unless they revise their complaint now that the Postal Service has issued a final rule.

The ruling did not read like a change of heart. Reporting around the order said the Supreme Court’s decision “compelled” Talwani to lift the injunction. At the same time, she continued to warn that President Trump’s election-integrity directive could create “chaos.”

The result is clear: The injunction is down, and the USPS rulemaking can move forward.

Trump's Brilliant Idea: USPS Moves To Limit Mail-In Ballots - In Time For Midterms?

USPS acting on two recent executive orders: March 25th and March 31st by President Trump, “Preserving And Protecting The Integrity Of American Elections” and “Ensuring Citizenship Verification And Integrity In Federal Elections” that aim to limit mail-in voting which is a vehicle for systemic fraud.

The US Postal Service proposed a new rule that would effectively create a national voter list and prevent states from mailing ballots to anyone who is not on that list.

The proposed rule, which was formally published on June 2nd, comes just one day after a federal judge decided that it was too early to weigh in on Trump’s executive orders because much had not yet been implemented.

Interesting timing, given the obvious fraud in the Los Angeles election for mayor wherein a ballot dump several days after the election resulted in 100% of the new ballots going to Communist Karen Bass whose policies burnt down 8000 homes and burned 12 people to death, or the Muslim immigrant Nithya Raman who is Left of Bass. [Is it possible to be Left of a person who was trained in guerilla warfare in Cuba?]

Raman,as a council member, authored the Sanctuary City Ordinance, which ensures city resources are never used for federal immigration enforcement.

Spencer Pratt, the outsider who lost his own home and had two life-long friends burn to death, got ZERO votes from this dump of fraudulent ballots. BTW, ballot dumps in Democrat-run states never increase the votes for Republican or Independent candidates.

On election night, returns placed Pratt in second place behind Karen Bass, with Raman trailing a very distant third. However, as LA County processed waves of mail-in ballots over the course of the week following election day, Raman overcame the deficit to surpass Pratt by roughly 22,000 votes, shifting the second-place spot, and kicking Pratt out of November’s general election.

Shocking Supreme Court decision

Supreme Court rules USPS cannot be sued for intentionally withholding mail, shielding government under sovereign immunity

The U.S. Postal Service is now officially immune from lawsuits when its workers deliberately refuse to deliver your mail. The Supreme Court said so Tuesday, in a 5-4 decision that shields the federal government from accountability even when postal employees act with intent rather than incompetence.

The case involved Lebene Konan, a Texas landlord who alleged that postal workers in Euless, Texas, intentionally withheld and returned mail addressed to her and her tenants at two rental properties she owned. She filed administrative complaints. As reported by Fox News, she sued the United States in federal court, asserting state law claims including nuisance, tortious interference, and conversion.

A federal district court tossed her claims, citing the Federal Tort Claims Act's (FTCA) postal exception. The Fifth Circuit revived the lawsuit, ruling the exception didn't apply to intentional acts of nondelivery. The Supreme Court took the case to resolve a split among federal appeals courts.

The justices ultimately ruled against Konan.

The Majority's Logic:

Justice Clarence Thomas wrote for the five-justice majority. His opinion rested on a straightforward reading of sovereign immunity and the text of the FTCA's postal exception. Thomas opened with the foundational principle:

"The United States enjoys sovereign immunity and cannot be sued without its consent."

Postmaster General DeJoy Steps Down Amid Push for Postal Service Reforms

The Postal Service reported a $9.5 billion net loss for fiscal year 2024, up from the $6.5 billion loss reported in 2023.

White House advisor Elon Musk has called for its privatization, and President Donald Trump has suggested it could be moved under the Department of Commerce. But all three men appeared to agree that immediate change was needed.

“It has long been known that the Postal Service has a broken business model that was not financially sustainable without critically necessary and fundamental core change,” DeJoy said in a March 13 letter to Congress. “Fixing a broken organization that had experienced close to $100 billion in losses and was projected to lose another $200 billion, without a bankruptcy proceeding, is a daunting task.”

10,000 employees were set to start voluntary early retirement and that his department had cut 50 million labor hours, resulting in $2.5 billion in savings.

He also asked DOGE to look into the mismanagement of the department’s Workers’ Compensation Program, which he said resulted in $400 million a year in “excessive charges,” and the Postal Regulatory Commission, which he called an “unnecessary agency that has inflicted over $50 billion in damages” to his department.

Initially DeJoy was to retire in February but waited to implement some crucial efficiency changes working with DOGE.

USPS Reaches Agreement With DOGE To Cut 10,000 Workers

Postmaster General Louis DeJoy announced an agreement with the General Services Administration (GSA) and Elon Musk’s Department of Government Efficiency (DOGE) to implement a sweeping plan that will see the elimination of 10,000 USPS jobs and billions of dollars in budget cuts.

The announcement, made in a letter to Congress, signals a significant step in DeJoy’s efforts to address the agency’s long-standing fiscal issues, which have resulted in near $100 billion in losses over the years.

DeJoy acknowledged that USPS operates under a “broken business model” and has been plagued by excessive regulation and mismanagement, specifically in areas such as retirement assets and workers’ compensation. The new agreement with DOGE is intended to identify and implement further efficiencies that could help pull the Postal Service out of its financial crisis.

The proposed cuts have ignited significant backlash from both lawmakers and labor unions. The plan to reduce 10,000 jobs through a voluntary early-retirement program is just the latest in a series of workforce reductions at the agency, which previously slashed 30,000 positions in 2021.

Florida Postal Worker Accused of Dumping 1,000 Pieces of Mail

He allegedly dumped more than 1,000 pieces of mail in a wooded lot in Orlando, including over 400 pieces of political mail and at least one election ballot.

Ottis Nicole McCoy Jr., who was employed by a private contractor to deliver mail for the U.S. Postal Service, has been charged with stealing and discarding mail in violation of federal law, according to a criminal complaint filed on Oct. 25 in the Middle District of Florida.

An affidavit attached to the complaint indicates that a manager at Cummings Contract Delivery Service Corp., the company that had hired McCoy as a part-time employee to deliver U.S. mail to a postal route in the Alafaya Woods area of Orlando, became suspicious when McCoy finished his route earlier than expected despite having a “very large” quantity of mail to deliver.

Data from a GPS tracking device connected to the vehicle McCoy was driving indicated that McCoy had deviated from the route, prompting the manager to investigate and find pieces of mail discarded in a wooded lot.

It confirmed that from September 2020 through April 2021 postal inspectors watched their targets through various social media surveillance procedures.

I am an employee of U.S.P.S. Like everything else the media gets their hands on, the current news about the U.S.P.S. and especially Trump's involvement with it are hyped and in some cases TOTAL Bull Shit.

There are many, many issues that could addressed. Here are twelve that I copied from another postal employee....

#1 - Trump did NOT get rid of the former US Postmaster General! She retired!

#2 - Trump did NOT appoint the NEW US Postmaster General! He was VOTED IN by the board of USPS Governors!

#3 - Processing plants have been shutting down and consolidating for YEARS now! And yes, part of that process involves dismantling equipment, which is most often reassigned to ANOTHER processing facility and utilized there! Some machines are dismantled and are not reused because like everything else, they wear out and eventually aren't worth fixing!

#4 - Yes, mailboxes in some areas are being removed. Why? Because mail volume in some areas has gone down, whereas in other areas, (like the greater Seattle area), the mail volume has recently INCREASED! But this too has been going on for YEARS and as many as 14,000 mailboxes were removed during the Obama administration. Was there outcry then? NO! And like Trump has NOTHING to do with the removal of mailboxes now, Obama had nothing to do with the mailboxes removed then!

#5 - The media LIES! The USPS processing plant in Everett, WA handled all of the regional mail from the south border of Snohomish county to the US/Canadian border. It closed in 2013 as part of a planned consolidation. True it was not initially to be the first plant in WA to close, but that's how it turned out. The media had a field day with its closure and announced more than 300 employees would lose their jobs. How many employees ACTUALLY lost their jobs?: ZERO!

#6 - The USPS is not in debt - at least not in the sense that almost all other large US businesses are not also. Does the USPS have loans? Yes. Are they in default on those loans? NO!

#7 - Is and has the USPS been losing money for more than a decade now? Yes. But not for the reason most people think, and certainly not for the reasons the media reports! The truth is, the Postal Service is not losing money because of Amazon or any other tech company or technological advance is society. It’s losing money because in 2006, Congress passed a law forcing it to prepay its pensions AND HEALTH CARE BENEFITS for 75 years IN ADVANCE!!! NO OTHER corporation, whether in government or the private sector has to do this! The USPS has appealed this decision every year since during every administration and shift in Congress and it has never been repealed. This means the pensions and health care benefits for people who have yet to be hired or even BORN the USPS is required to pay and lock up every month - IN ADVANCE! Who bills them? Congress! And do they do so accurately? NO! Many times Congress has OVERCHARGED the USPS the monthly amount they are to pay. Has the USPS then EVER been REFUNDED the difference? NO! So, believe it or not, without this law, the Postal Service would be turning a PROFIT!!!

#8 - When the federal government allowed other businesses to handle the package business, (DHL, FEDEX, UPS) these companies took the most profitable business and left the USPS with the least profitable - delivery to EVERY household in the U.S. and all U.S. Territories, (yes, even Puerto Rico and GUAM!), regardless of the cost of delivery. Believe it or not, the Havasupai tribe that lives on the floor of the Grand Canyon receives first-class mail and packages delivered by MULES!!! NO private company wants this business… or any business for 55 cents to every door in America - no matter the distances between the customers! #9 - Trump's treasury department DID loan the USPS 10 BILLION dollars at the end of July! Why do they need it? In addition to the reasons already mentioned above, the Corona Virus Pandemic has had a significant NEGATIVE effect!

# 10 - Trump has TWICE said he WOULD IMMEDIATELY sign a STAND ALONE bill to provide even MORE funding, but the Democrats in Congress will not present a bill that does not include other stipulations such as stimulus checks provided to illegal aliens, mandatory voting by mail nationwide and bailouts for the blue states with cities that have been damaged by rioting.

#11 - EVERY major private package delivery service utilizes the infrastructure of the USPS somehow, someway on a DAILY basis! The private carriers simply do NOT have the capability of handling ALL their deliveries from END-TO-END without having the USPS help them out at some point! But the USPS is LIMITED by CONGRESS concerning the amount the USPS is allowed to charge these private carriers - and they are getting one heck of a deal!

#12 - This is perhaps the most unknown of all. The USPS is SELF-FUNDING! Yes, that means it is NOT funded by U.S. Taxpayers! This has been true since the mid-1980s! The USPS REVENUE is EARNED just like any other business via sales of products and services! Any money given to the USPS by the Federal Government is in the form of LOANS that it must payback! Are they low-interest Federal Loans? Yes! But why shouldn't they be?!!!

Gifts for USPS Mail Carriers
There are rules regarding gifts for USPS mail carriers. Postal Service employees may accept the following items:

• Snacks and beverages that are not offered as part of a meal.
• Items with little intrinsic value (i.e., greeting cards, plaques, pens, coffee mugs, etc.).
• Perishable items (i.e., flowers, chocolates, cookies, etc.); if the items are clearly worth more than $20, employees should share them with others in the Postal Service workplace.
• Items with a market (retail) value of $20 or less.
• Gifts motivated solely because of a personal relationship.
• Gifts for which the employee has paid market (retail) value.
• Gifts paid for by the Postal Service.

Postal Service employees may not accept cash  - in any amount or form (bills, checks, money orders) - from an outside source.
