A code violation that never was a code violation

As Commissioner Maier stated at the time, “This is completely untrue and unfounded. The woman (who made the allegations) is no friend of mine. She’s never been in my home and she’s not even my neighbor.”

Well her closing statement did make a good point, if you don't let code in their powerless to actually prove a violation actually exists. So news to all if your doing anything inside against code just plead the 5th and it will go away...

Nice closing statement. Its scary anyone can get out of a violation if they just keep their door shut. Yah yah right to privacy but on the other hand some real bad stuff can be happening inside a property and yet the people we look to too enforce codes have little power. So the saying goes no proof no violation of course... Even if proof is hidden?

I can say i only wrote the 8:07pm. Wouldn't it be nice if you actually spoke with a code officer to find out the nity grity facts instead of every yahoo commenting for or against Maier. But again im sure the code people arent allowed to discuss details with the public...

It's a vicious city and anyone can say anything. Sometimes it sticks. Sometimes not. It's too bad that Jessica didn't talk to Ryan before going after him to ruin him. Bad move. Bad advice. It won't be forgotten and there is no reason why he should lose the next election, a long way off I might add, when he slammed dunked this one.

for sure the whole camel is coming!

This is the exact reason for the 4th amendment.
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

...meaning - "Get a judge to issue a warrant."

@8:25 above--I'm rather sure that code officers must follow the laws. It shows that there is a flaw in our system when someone political can go after a politician with NO evidence. Sorry John Rinaldi, but being a former lawyer, you, of all people, should know this.

Now as far as this house over here on Wright Drive, there was a huge loophole in LW law...that is something that NEVER should have been allowed to happen. Even though the city is trying to get these ordinances foolproof, we have a way to go.

To all those who think Maier did the stand up thing. I hope your next door neighbour is doing some shady stuff "inside" thier house and then when you call code to help you the owner says no entry, case closed. Then you hear how hes a great person and did the right thing, 5th amendment.. Blah blah blah. Then lets see whose crying now...

Do you want to know what's going to come out of all of this? Voters are sick and tired of people being run over and treated like crap by people like you. This will backfire for anyone involved in this and prove to be very negative if you continue to bring it up. You will lose a lot of votes if you do because basically people still support civil rights in this country (I realize that Obama is trying to stomp on that premise) and just plain fairness.

So keep it up. We don't like sleazy politics. The next time you come after someone be sure to have some EVIDENCE. Break into his house and hide under the bed or something...you would be good at that.

Anyone can make a complaint then its codes job to gather evidence but how can they when they arent allowed to? Maier got off bc lack of evidence because he inhibited his officers from gathering any.

Yes it was his right but dont you see theres a difference between hiding behind the constitution rather thsn standing behind the whole entire platform he preached during his election. The fact the case was closed due to lack of no evidence wasnt because code got inside and saw there wasnt a violation which would be concrete proof instead he didnt allow his code people to gather evidence. Regardless of you see it Lynn there is a difference.

Im not saying it wasnt his constitutional right to plead the 5th which i agree its his legal right but theres a difference on being equitted on a solid evidence than a speculational lack of evidence because he wouldnt work with his people to view it. All that it hurts is his image. If he allowed code in and there was no evidence on that basis there wouldnt be any discussion. Try to look at it from a different point of view Lynn. In not saying it wasnt his right to deny code entry

He wasn't "pleading" anything. He was not in a court of law. I believe someone quoted the Fourth Amendment to our Constitution above. Read it. Understand it. Stop! I am looking at it from the correct point of view and would do the same for anyone else. This is about rights.

They are too saturated in what they think is right - rules
(Constitution) be damned! I do like the suggestion to those
who in some alternative universe think this invasion of privacy
is OK to open up their houses and be the first to endure 'cruel
and unusual punishment' (giving up CREATOR GIVEN RIGHTS - Like DNA)!
After all the city needs income and code picking low hanging fruit
(used as a political weapon from a NON-LW CITIZEN) should be tried
out on those who think it's OK FIRST! Obviously they have NO EXPERIENCE
with our code dept and would be the greatest correctors/defenders of the
'rules' after that fiasco!

It is about the 4th amendment but does include the next step in the 5th.
You can NOT be compelled to HELP ANYONE make a criminal case against you!

"nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law;"

Maier's platform was on transparency in public affairs, as in three commissioners should not be having dinner together locked in the city manager's office twice a month for three years. That's the public's business.
As in the district 4 commissioner should not be on the payroll of a developer trying to re-develop our already beautiful beach property.
as in the mayor and same commissioner should not be communicating with same developer during the ITN process, which the developer revealed on public record recently.
as in a sitting commissioner and department director on a secret committee to bring new development to our beach should not be conspiring to manipulate an election by withholding information from the public.
as in the city manager should not be misleading commissioners in regard to the intent of a bidding process that could significantly affect public land (the beach).
as in the city attorney should not be conspiring at the request of a secret committee to sidestep a 20 year max lease term at our beach property that was approved by 90% of Lake Worth voters.

Not as in he is not allowed to have his own private space and private life.

You people are always prancing around in your cloaks of self-righteousness and petty judgment. Your bloviating about future elections is obviously ill-informed, but you can take this to the bank: a hard rain's gonna fall next March.

Joining in: i dont think that whoever a few anonymouses are is stating that he didn't have rights to say no. I think he/she is only stating it may not have been in his best interestes for his persona with the people to proceed the way he did. There is a diffeence between no hard evidence and possible evidence behind a closed door. Thats all. I guess no one will ever know for sure. But the case is closed for "lack of evidence" so we should all just drop it. Lets start a new topic on all the good our qwarky city has going for it. ��

You have the evidence? Let's see the photos--all of them. Make sure that they are dated. Bring the proof of your allegations that already have proved to be worthless. Code was not hindered in any way. What happened here is that you politicos didn't get your way. How lucky for all the rest of us who believe in fair play. Maybe you can get Kevin D. Thompson to write anotehr follow-up article to the follow-up article.

No ones saying they want him crucified they are just saying theres a difference between clear no evidence and lack of due to him preventing it. How can someone gather evidence to proof without walking inside? One day Lynn you will need code's help and if they dont do it to your standards you'll blast them too. THIS IS AMERICA. You can't charge people with a "crime" and then have them prove they're guilty or not guilty to satisfy your hatchet job. People are innocent and it is up to you to prove otherwise. Mr. Waters, CM, City attorney and Code Supervisor all cleared Maeir because Maier simply wouldnt let them obtain evidence, either way thats the verdict. The real one to blame is Code Officer Robinson for persuing it, sorry you didnt catch your man! Its a good thing her supervisor leashed her and instituted some sense into her. Look Robinson its closed, too bad huh. Why dont you go worry about some dog poop on someones lawn and stay away from the honest people in Lake Worth!

I just read everyone's comments and it looks like a bunch off you are missing the point. Literally no one said its a legal thing tramping on his constitutional rights. There saying maybe he didnt take the most straight forward approach to handling the situation. Why does so many individuals, literally 60+ feel the need to jump all over eachother instead of actually thinking about what is being said.

A code complaint doesn't go away simply b/c you don't let them in your home. I don't think any of you have had any experience with code, but I have. And, no I wouldn't let them in my rental unit to inspect it, and guess what happened, the code complaint didn't go away. Rather I had to go to a hearing and address the allegation and prove that I was right, which I did.

There are also plenty of other ways to gather evidence besides entry. If you are running an illegal business, code could gather evidence by taking photos of deliveries or customers, etc. If something were super "shady" as some of you put it, that wouldn't be code it would be the police and they have different methods to gain entry.

He stood on his UN-A-Lien-Able, creator given rights and GOVERNMENT
was formed to protect those rights! We have a republican (representative)
government because in a democracy (NONE to date has ever survived) a
simple 51% would change it all from day to day vs rules set in cement,
not easily changed on purpose understanding how people can be easily
swayed to allow feelings not law to rule them...

Anon @ 1:24, so your stating you have a rental unit in the city and code issued a case on you because you wouldnt let them gain access? Every rental in the city is required a inspection its called a use and occupancy inspection. So you to stated they took you to court and you won? Thats funny bc i have a bunch of rentals and its part of the Lake Worth Business License. Ive never had a issue with code, they've always been fair to me. But ive also never gave them a reason not to be...

This whole city is corrupt. All they way from the CM to comissioners.

They all have their own agendas regardless of what the public or employees want. Take for example the beach... The majority of the community wants to keep the beach the way it is yet sadly HH will most likely get it. The employees havent recieved even a 1% raise in 7 years yet the CM & Departmental Heads continue to get raises, some over $10,000 a year.

When have politicians every been considered the most honorable upstanding people?
