Finally, an update on the lawsuit and it is good news! The panel of judges for the 15th Judicial Circuit released their opinion this week granting our request to have the Deco Green development go back to the Commission for review and a new vote. Thanks to the donations, research and support of each of you the approval is "quashed"!!!
The judges decision is based on a very limited criteria, essentially a math error that allowed the developer two extra units (127 units instead of 125). While it may sound minor, the two extra units could gain them upwards of half a million, based on the current insane housing market.
We submitted for the judges consideration other serious concerns - that the City erroneously applied their Land Development Code in their use of the Sustainable Bonus Incentive Program to approve height, stories and density in excess of what the code allows. Unfortunately, the judges did not rule on those issues based on a technical position that the public comments submitted by the petitioners did not have the level of detail they say is required by law. This is an important lesson learned about how the laws favor developers and shut out residents for not submitting enough detail in their public comments.
We won this first phase in the battle of community power over real estate greed. Here are two things that can solidify this victory:
- 1. Call and email your commissioners and the mayor. Let them know you are aware that the Fifteenth Judicial Circuit reversed the development order for the Deco Green development. Encourage them to listen to you and other residents' concerns before approving the Deco Green again. They will be under pressure from the developer to fix the two unit mistake and plow forward. But, according to PAPA, the land is still owned by the CRA (map attached). This means it is still technically public land, paid for with public dollars, and the residents should guide what the best and highest use of it is. This project needs to go back to the drawing board - we have a new commission, new city manager, new CRA board members and an increased affordable housing crisis. IF the city is going to double the density for a project it should be for true affordable housing, not an expensive 9 story building with a dog park.
- 2. Kick in towards the ongoing legal challenge. We currently owe another $2,000 to our lawyer for review of the judges opinion and to help ensure the court order is honored. If you can each offer $25 - 75, we can pay off the balance and have some funds to continue having their legal assistance as this comes back before the commission.
We believe in our communities' power to fight and win real sustainability, economically and ecologically. We are committed to public land being used for affordable housing that will stabilize our community rather than upend it. We respect the height and density limits that people organized for and voted on, in order to establish neighborhood controls on development.
Let's keep at it!

ps - If you can kick in towards the legal costs I can do venmo, paypal or drop off a check at my house. thank you!!!

thank you. I don't think she will get anywhere with this commission
I've been fighting with the mayor and some commissioners this week.
The far left leaning group is now only for themselves.
The green space that belongs to PNC on Lucerne, is now a homeless encampment, and the good people of LWB want a fancy hotel two blocks away.
How do you get to that point in life when you think you are a somebody, deserving of all the good things in life, when in reality, you are walking around through garbage everyday, and you don't even see it!
They never really ever really want to do anything nice for the city of lake Worth to try to improve it and remove the blight Bryant Park has so many homeless living there and all along the boat ramps on the other side of the park the newer area all homeless people even boats dock there they don't even enforce the laws or the rules about boats being docked there and indefinitely and park their living off their boats they have so many homeless how are they going to attract another clientele and have a nice hotel or a nice living there just go a few more blocks north all the areas all blighted now to even college park used to be nice has a lot of belite as well the whole city has just been taken over by crime renters lawlessness complete chaos it's a mess there and career always used to want to not have gentrification so she never wanted to see any major improvements or do anything about the homelessness or all the crime or all the illegal immigrants or anything she always sides with all of them over the American citizens and the taxpayers. PBC and lake Worth are now hell holes!
For over 30 years they keep saying lake Worth is going to improve it's going to look better where in 30 years is it improving only over crowded and lots of renters and lots of crime very blighted areas the city has never improved just keeps getting worse and worse over the past 30 plus years very unpleasant place to live lawless crime infested lots of drugs alcoholics millions of illegal aliens drunk all over, not a pretty picture!
Why is it the elected leaders in this country continue to ignore the homeless.
It's very simple really: The homeless are a problem that require action, and the Politian's can't deal with anything that requires action, especially if intelligent thought has to precede the action.
The homeless situation is intolerable. Any country that can't control and improve the homeless situation is not a 3rd world country, it is a 4th world country.
It is a disgrace to drive down the alley toward PNC Bank and see a roll of toilet paper. Shame on you commissioners! And you sit and endlessly discuss a multi-million-dollar hotel.
What is wrong with you?
The real problem is not really homelessness it's what causes homelessness which is addiction and nobody in our country does anything about the addiction problem that so many people are alcoholics or drug addicts in our country and that's what causes the homelessness but our country and leaders love everybody addicted to drugs alcohol gambling whatever the addiction or vice may be they want people who are addicted there's lots of money to be made on taxes from different addiction. Addiction is what causes homelessness! Our country promotes addiction! We are slaves to submit to it!
