Supreme Court Backs Trump On Border Asylum Question That Left Democrats Furious
What it's all about--Look, the legal question is straightforward: Does federal immigration law require Border Patrol to process asylum claims from people who haven't actually entered the United States yet?
Common sense says no — you can't "arrive" somewhere while you're still outside it.
At issue is "metering" — the practice of turning away asylum seekers at ports of entry when border officials determine they're at capacity. Metering started in 2016 during the final months of the Obama administration when Haitians flooded the San Diego border crossing from Tijuana.
Trump formalized the policy in 2018 as Central American migrant caravans pushed thousands toward the border claiming asylum.
Biden rescinded metering in 2021 after a federal judge appointed by Obama ruled it violated asylum law, thus putting our country in peril.
