President Donald Trump bypassed Congress regarding the Iranian war by using his constitutional authority as Commander-in-Chief and asserting that the 1973 War Powers Resolution is unconstitutional.
He also argued that ongoing cease-fires meant active hostilities had ended, eliminating any legal requirement for retroactive congressional authorization.
Commander-in-Chief Power: Article II of the Constitution names the president the head of the military. Administrations maintain this grants inherent authority to use force to protect national security without waiting for a congressional declaration.
