E-Cigarettes and ban for minors

Comment Up

The Entrepreneur will be upset when he reads about this latest bill passed in the Florida Senate--It still has a lot of hoops it must go through first...at least their talking about it. It could be effective on July 1, 2014.

The bill has the support of the Florida Medical Association and the American Academy of Pediatrics. It's a start.

The Senate measure would make it a misdemeanor to sell e-cigarettes and related products to minors. So, knock it off Lake Worth entrepreneur, or you could end up with one year in the county "slammer."

Quote of the Day - Gov Rick Scott - The Jobs Governor

“Florida’s tourism industry is responsible for 1 million Florida jobs and we want to make sure that this important part of our economy is rewarded. Thanks to our job creators, Florida is becoming the top state for business in the country. I look forward to recognizing these innovative businesses for making sure families can live their American dream.”

~ Gov Rick Scott

Sunshine State News says that 2012 proved a record year for tourism in Florida with 91.5 million tourists who spent almost $72 billion in the Sunshine State, leading to 23 percent of the state’s sales tax revenue and more than 1 million jobs.

Hydrant flushing in College Park

Comment Up
M. Hill photo

Periodically, you will see city personnel releasing water from hydrants. Hydrant flushing is necessary to test the hydrants to make sure adequate flow and pressure is available. Flushing is also done to remove sediment from the pipes in order to maintain water clarity and quality in the distribution pipes.

Sunday Fun Day

Palm Springs wants to change its city code allowing alcohol to be sold on Sundays beginning at 7am. The city said that it wanted its retail alcohol sales to be more in line with surrounding cities and that the present code was "unfair" to businesses.  They cited 5 municipalities where they reviewed code but Lake Worth was not one of them.

LAKE WORTH CODE
Sec. 5-4.
Hours of sale. No person shall sell, deliver, consume or permit the sale, delivery, service or consumption of alcoholic beverages on the premises except for the following hours where a business holds a legal alcohol license:
(a) The hours of sale of alcoholic beverages of more than one (1) percent of alcohol by weight shall be:

 (1) 12:00 a.m. (midnight) to 2:00 a.m., and 7:00 a.m. to 11:59 p.m. Monday through Saturday.
 (2) 12:00 a.m. (midnight) to 2:00 a.m., and 12:00 p.m. (Noon) to 11:59 p.m. Sunday.

City Commission Meeting - a few excerpts

Our first Lake Worth Hero Award recognition was held on July 1, 2012.  All I can remember was the heat and also how proud Mark Parrilla's family was for him being the honoree.

It was announced last night by Commissioner Amoroso that the second event will take place in February 2014.  There are so many people who work tirelessly for our city and this recognition is important.

There was nothing too startling about last night's agenda--everything passed with ease by the entire commission...There were 9 items on the consent Agenda.  More and more city business is being pushed off to Consent. It was only recently that state law changed allowing the public to comment on these items and now it seems that more is on Consent. The City is only allowing us to comment for 2 minutes maximum on Consent items during public participation.

The city's property at 1105 2nd Avenue South and its lease to The Living Arts Foundation for $1 a year for 20 years minus one day was approved. The Living Arts Foundation, a 501 3c,  gave a presentation and I must say they made a good sales pitch. They will be paying the equivalent of ad valorem taxes but it will be based on the Consumer Price Index.

Table of Annual Averages (2002-2013)

Date 2003 2004 2005 2006 2007 2008 2009 2010 2011 2012 2013
Annual Average 184.0 188.9 195.3 201.6 207.3 215.3 214.5 218.1 224.9 229.6 234.1

The property is worth $343,687 according to PAPA. They would pay this "tax" directly to the city (not the CRA). A private operating foundation is a private foundation that devotes most of its earnings and assets directly to the conduct of its tax exempt purposes, rather than to making grants to other organizations for these purposes. This  corporation is a private operating foundation defined in the Internal Revenue Code under section 4942(j)(3). They don't have to pay taxes.

The sheriff contract was passed without one comment. People don't mind paying 70% of our operating budget for police but they do mind taking $9 million from our utility to augment the city operating budget. What happens when it become 80% or 90%? Will they be concerned then? Will they still be wanting to wean us off dependence on Utility revenue?  If their general obligation bond for infrastructure and developing the park of commerce passes, and they seem to be confident, then it might be possible.

Last night Scott Maxwell said, "We can't keep doing the same thing over and over again and expect a different result." Saying that the 2020 Program will be the biggest undertaking, he wants us to plan for, obtain grants and/or do everything possible to get this 2020 Road/Infrastructure improvement program done. He talked about Shiny Objects again and said that we had gravitated towards them in the past, one of his favorite political sound bites and complaints.

When speaking about road infrastructure, the mayor said, "If we are going to get better, we have to be truthful about who we are.  We can't afford to do this wrong.  Right the ship; right the wrong...these are discussions...we are trying to do a clean-up here."

Commissioner McVoy said, "It needs to be a community discussion and a clear one. We have to be careful in what we promise with it."

If they want to obligate the citizens to tens of millions over 30 years and get this on the March 2014 ballot, they had better hurry in that discussion.  So far, it has all been one-sided... "I want, therefore you will get."

Finance Director in Lake Worth to Retire

Comment Up
Steven Carr

Another one of Susan Stanton's top hires will be leaving our city employ, retiring on January 3rd.

Taken out of retirement when he was hired, Mr. Carr turned our finance department around. Since he has been with us, his department has been recognized by the Government Officers Finance Association consisting of 17,500 professionals for excellence in financial reporting for preparing the CAFR--full disclosure and easy communication of our city's financial position for the fourth year in a row.

He took this department to a whole new level in the few years he was with Lake Worth. After he arrived, gone were the days of a finance director's performance being recommended for criminal action to one of excellence in government reporting.  He will be missed, not only for his expertise in government finance and what he accomplished while here in Lake Worth but for being an asset to our city both personally and professionally.

Individual and Joint Action decided by Court - Florida Hometown Democracy

Opposed by business groups, the Florida Chamber of Commerce, developers, Realtors and all those who could possibly derive an income from development, the U.S. Supreme Court on Monday declined to take up a challenge filed by three Sarasota and Charlotte county residents to Florida laws that place requirements on political committees.

Justices did not provide an explanation for denying a request to hear the case, which was filed by a group of residents who sought to pool $600 to run radio ads in 2010 against a ballot initiative known as the "Florida Hometown Democracy" constitutional amendment. Some people think they can get away with anything.

FEC Depot on east side of tracks
Photo from the Lake Worth Museum

We have a lot of history in Lake Worth even some that we don't know much about. We have, however, heard about the FEC Railroad because it runs through our city today. Some of us remember an FEC train depot right here on East Coast St. But many of us are not aware that it once owned property on the western side of the tracks; it is undetermined as to how long the FEC owned it. The city now wants to give that western property at 1105 Second Avenue South an historic designation. Back in 1982, the FEC sold it to B.R.D. Properties for $210,000. It went through a few title changes and eventually the City of Lake Worth was granted the property through a gift almost two years ago.

A photo of the south end of the property
The entire property extends from 2nd Avenue South
to 3rd Avenue South

The city advertised its intent to make the property historic at 1105 Second Avenue South on October 24, 2013 giving the following description: the property is bounded on the east by the FEC Railroad; on the north by 3rd Avenue North; and on the south by 2nd Avenue South. This legal advertisement and description seems to be in error and needs an explanation and/or re-advertised.

Tonight, under New Business A, the City is leasing the property at 1105 Second Avenue South to the Living Arts Foundation, Inc. a 501(c) corporation to be used for metal works, ceramics, and other art disciplines.  The rent will be $1 dollar a year and the lease is for 20 years minus a day. The Lessee will actually pay the City of Lake Worth ad valorem taxes (is this in the CRA district?) that will adjust each year based on the CPI.

The Living Arts Foundations says it will create 38 jobs and will do renovations to the tune of $1.76  million. This building appears to have its own generator and propane tanks.

The Arts Foundation is allowed to sub-lease.
The "visionaries" are going along with a plan to lease this to the arts, have them improve the property over 20 years and allow them to get government grants while doing so. It's called making do re mi out of art.

And of course, the CRA approves.

PBSO costs in Lake Worth

Comment Up

Under New Business 12-B, is the Law Services Agreement with PBSO. We went through the budget cycle and the budget that was finally approved had a total cost figure of $15,057,583.  That's the cost for policing out of a total operating budget of $29.516 mil. Tonight there will be a 4th Amendment action item involving policing effective for FY 2013/2014 and FY 2014/2015.

The Sheriff’s Office had originally proposed a 2% increase ($242,000) this year and a 3% ($370,000) for next year. The city says that after several negotiating sessions with the Mayor, City Attorney and City Manager, the Sheriff agreed to NO increase for the next 2 fiscal years.

We also engage the Sheriff for six special events throughout the year along with requests to have one or more at commission meetings or board meetings which is an extra cost. In order to meet FODT standards, crossing guards have been increased from 10 part-time to 22 part-time. We are told that there are 5 vehicles patrolling and on call at all times.

What the city doesn't give in the backup is an explanation on the difference in the Budgeted amount and the Contract price. The difference between the total $15,057,583 (budget for all Police costs) and the $12,100,000 (contract with the Sheriff) is:
  • $2,791,353 of Police pension costs for the former Police Department employees
  • $161,240 of utility and maintenance costs on the Police Building (which the City agreed to pay in the original contract)
  • $5,000 additional to the Sheriff for enforcing local ordinances. (Need detail)
In the Executive Brief it states that residents in the community have been very satisfied with the law enforcement services provided by PBSO and the positive impact they have had in addressing criminal activities in the community. Who are the very satisfied?  And what positive impact? The PBSO are PR specialists but reducing crime can't possibly be one of the reasons why they are so revered as the bad guys have no fear and crime persists.

We pay $1,008,833 a month for PBSO and no matter how you slice this cake, policing really costs us $1,254,799 a month and $114,073 a year (which includes the 22 part-time crossing guards) for each PBSO person assigned to Lake Worth. The question is, for all that money and the uncontrollable costs that take 69.49% of our operating budget, do you feel safer? Are we making a dent in crime?

Quote of the Day - Ret. Navy Capt. Joseph John - Obama's purge surge

Obama’s massive assault to restructure the military mindset, destroyed unit cohesion, unit morale and is negatively affecting combat effectiveness. The net result of the occupant of the Oval Office’s new policies set for the U.S. armed forces changed and enforced by his civilian appointees at DOD continues to degrade the most effective military organization ever created.

Retired Navy Capt. Joseph John

Lake Worth Casino

Comment Up

Lake Worth has finally reduced the commission agreement to writing on the Casino--

After certain conditions are satisfied, the following will apply:
Commission based on the total base rent to be paid during the initial term of the approved lease. The specific amount of the Broker’s Commission for the approved lease shall be negotiated by the City and Broker prior to the approval of the lease and shall not in any event exceed seven percent (7%) where there is a 50/50 commission split with other broker(s) or six percent (6%) for  straight Broker’s Commission; however the Broker’s Commission shall not exceed five percent (5%) for an approved lease with any existing tenant. Any Broker’s Commission for a month-to-month lease will be negotiated between the City and Broker prior to the approval of such lease and may exceed seven percent (7%) in the City’s sole and absolute discretion.

There you have it. Let's get it rented.

Old video but applies more than ever today.  And the last I looked, we still had graffiti in our downtown. We continue to give away or lease away valuable properties to non-profits and we encourage affordable housing.  No problem trying to grab federal grant money...we do it willfully. No problem for this commission in trying to make our entire city an enterprise zone to encourage development in blighted neighborhoods through tax and regulatory relief to entrepreneurs and investors who launch businesses in our city. We are attracting more and more poor.  We compare ourselves to BelleGlade...why not Detroit...does that come next? We give a waiver to anyone who asks that wants to sell beer and wine. We spend a fortune on policing and still have tons of crime. This video is about the fall of Detroit but we are following their plan.
