Khalil To Be Deported After Court Loss

Court Reverses Release

A federal appeals court last week overturned a lower court order that had secured Mahmoud Khalil’s release from immigration custody.

The 3rd U.S. Circuit Court of Appeals ruled 2 to 1 to send the case back the other way. That means Khalil, who has been fighting deportation for months, is likely to be taken back into custody while the government moves forward with removal proceedings.

Tricia McLaughlin, the Department of Homeland Security assistant secretary for public affairs, told NewsNation the expectation is that Khalil will be re-detained and deported to Algeria.

DHS framed the decision as a reminder for green card holders and visa holders that residency is a privilege and that breaking the law or supporting violent groups can cost you your place in this country.

That is a straightforward message from a government focused on restoring order around campus protests and foreign influence.

The administration says Khalil helped organize pro-Palestinian riots at Columbia University, provided false information on his permanent residency application, and has ties to groups the U.S. designates as terrorist organizations. He has also sued the government for $20million for false imprisonment and malicious prosecution.
