The only thing "frivolous" is Lake Worth's argument

My first question is why would the City of Lake Worth spend an estimated $25,000 defending and going against a Heights Referendum won by the residents? Did this commission Trio approve this amount of money? If so, when? If so, why? Does the city attorney's office have carte blanche on spending? Why was it so important for the city to "win" its case against the voters and have Hudson holdings as an Intervenor on the suit? Nothing was holding up Hudson Holdings from renovating and developing its property. Why was giving Hudson Holdings 20 more feet so important?
Hudson Holdings argument was and is bogus. The city's argument, along with the Historical Board, approved upzoning for one owner. This was flat out egregious when you consider the Charter Amendment was won at the polls allowing only 45 feet for buildings in that area. This is also spot rezoning, which the Supreme Court has said is illegal. After the vote was won, the city upzoned the parcels at the Gulfstream and changed the entire area to a Hotel District. Was this clever legislation to get around the law?
Now the latest article in today's Palm Beach Post says the recouping of attorney fees of $25,000 might not be that easy after all. The city attorney is hoping that he can prove that the citizens' case was 'frivolous." Of course, the main objective here is to intimidate any resident who thinks he can come after the city for any reason.
Perhaps the Court will show cause why the City shouldn't be fined a large amount of money for frivolous argument.
The only thing frivolous is Lake Worth suggesting to spend even more money to go after its residents who have a good argument regardless of what the Appellate Court said that offered no reasons for its opinion...just another thing over-worked judges could get off their desk by agreeing with the status quo?

I love Thursdays!

I love Thursdays. Why? I get my Lake Worth Herald delivered and there is always, without a doubt, something that totally ticks me off that is either untrue or missing facts.
Today it is the recent ruling in the Appellate Court on the citizen lawsuit on the Charter Amendment. The article states: A referendum put to the voters of Lake Worth regarding building heights was narrowly defeated in March 2013. The city commission certified the results of the election that the PAC won by 55.86% that were never moved forward to Tallahassee by the City Clerk. That margin of win is not insignificant nor should it be described as "narrow." Politico has defined a landslide election as being at least winning by 10 percentage points.
The editor also states that the citizen's effort "would have resulted in thwarting the revitalization of the Gulfstream Hotel." The truth of the matter is--NOTHING in the Charter Amendment EVER thwarted the renovation of the existing hotel. And the owner, Hudson Holdings, could have built to 45 feet on the vacant property.
The Hotel District was designated AFTER the Charter Amendment. HB 537 was signed by the governor three months AFTER the election. And this law reverted back to 2011.
I still believe the people's argument was correct. And all you little political activists who were in the photo in front of the hotel cheering on Hudson Holdings and the City, some of whom actually work for Hudson Holdings, tell the owner to clean up his mess. Let's now see some results.

Trout and Morel Collaborate
Mike Trout and Emmanuel Morel (Morel is running against Jeff Clemens), are cooperating on a new proposal to give an opportunity to small businesses on our Interstate.
FOR IMMEDIATE RELEASE:

Contact:Mike Trout, 561-206-2378
Emmanuel Morel, 561-301-6843
US House Candidate Mike Trout (CD-21), and Florida Senate Candidate Emmanuel Morel (31st District) say they are cooperating on an exciting new proposal to tap a huge opportunity to give market access to thousands of artists, craft creators, inventors, and even hot dog vendor micro and small enterprises all over Florida, and potentially hundreds of thousands around the nation.
Trout says he got the idea when he stopped at a rest area on Interstate 95 one day, and noticed that there was a lot of (publicly owned) real estate, but very few offerings for the hundreds of travelers who stop in every day, other than the ample restrooms, and a few overpriced vending machines.
He says it just clicked in his mind that what he was looking at had the potential to be a vibrant marketplace and public commerce and commons area. He envisioned a space geared towards serving both sides of a supply and demand vacuum, one that could give many opportunities to many local enterprisers, in a way that tourists and locals alike could benefit from.
"I could see everything from hot dog and drink vendors, to artists and musicians turning this space into a bustling and happy experiment," he said.
Campaigning together in June, Trout said he started to talk about the idea with Morel, who noted that there was a busy Turnpike Service Plaza in his Senate district. A collaboration of ideas ensued, and the two candidates are announcing that they will cooperate on legislation making these two market proposals come alive, Trout's proposal in the US Congress addressing areas along the (federal) interstate highways, and Morel's in the Florida Senate addressing areas along the Turnpike and other state roads as yet to be identified.
Says Morel, "A lot of people mistakenly believe that Democrats and Progressives are somehow not "pro" business and capital opportunities. I'm here to tell you that myself and my good friend Mike Trout are the enterprise progressives in this campaign season."
Trout added that "we have identified possibly hundreds of similar market opportunities in Florida and literally thousands and thousands across the country." He noted that many cities and counties offer roadside vendor permits in some rights of way, including Palm Beach County, "but none with the built in infrastructure of our Interstate highway rest areas and tollroad service plazas. Why should two or three corporations exclusively dominate the potential economic activity as they do, especially as is currently the case in the Turnpike Service Plazas? These are publicly owned properties."
Mike Trout is a lifetime Democrat running as a Progressive Independent (NPA) candidate for Congress in Florida's newly drawn 21st District, and Emmanuel Morel a Democratic candidate in the newly drawn 31st Senate District.

Quote of the Day - Shelley Vana

“Anybody who believes I’d go to a Trump rally, I can’t help them with that. I’m a Hillary (Clinton) person, obviously. I can’t conceive of me ever voting for Donald Trump. For anything.”
~ Shelley Vana
It's still fun for Democrats to bash Trump even when Palm Beach County is Trump's second home. It's fun to bash Trump and support a corrupt, crooked liar like Hillary Clinton because Democrats far outweigh Republicans in Palm Beach County (248,208 to 371,372). Vana was seen at a Trump rally and her opponent, Dorothy Jacks, mailed out a flyer insinuating that Vana is really a Republican. Jacks' campaign made a mistake sending out a flyer of this nature in a non-partisan race.
Being that politics is what it is (slimy and dirty at times), I still encourage you to vote for Dorothy Jacks for Palm Beach County Property Appraiser.
