Provisional Ballots should have counted

Comment Up

So says Tallahassee:  "Legally cast provisional ballots must be counted even if an election worker fails to fill out a form properly."  Susan Bucher, Supervisor of Elections Palm Beach County, demanded a formal opinion; she got it; she lost.

Read about it here...

The State agreed with Bucher when she said that the secrecy of the ballot could not be violated but in the State's opinion, "the error did not rise to a high enough level to offset the law requiring properly cast provisional ballots to be counted." There were 14 provisional ballots in Lake Worth that were cast aside from the August 26, 2014 election. That was our city attorney's opinion all along. The City has said it will not pay Bucher's legal fees.

The only reason they are not discussing this election in any way, shape or form is because they plan on putting it right back on the ballot.
