Commissioner Maxwell gets "hit" with a Pie

Comment Up
Commissioner Scott Maxwell and Barbara Jean Weber

Several weeks ago, Barbara Jean Weber asked Commissioner Scott Maxwell what pie he liked best as she was going to bake his favorite for the 3rd on the 4th Event (July3) pie baking contest. He answered, "Rhubarb or Coconut Cream." Barbara didn't come through that day for Scott but last night, saying she was a "man of her word," she presented him with a coconut cream pie.

Ingredients:
  • 3 cups half-and-half
  • 2 eggs
  • 3/4 cup white sugar
  • 1/2 cup all-purpose flour
  • 1/4 teaspoon salt
  • 1 cup flaked coconut, toasted
  • 1 teaspoon vanilla extract
  • 1 (9 inch) pie shell, baked
  • 1 cup frozen whipped topping, thawed

Fire/Rescue and the Lake Worth Budget

Comment Up
Tom Keating of Lake Worth had his letter to the editor published in Wednesday's Palm Beach Post wherein he states that salaries of our fire/rescue personnel need to be cut before raising taxes. Because of the high cost of salaries, the only options will be to raise taxes or reduce the number of workers per Palm Beach County. "Sadly, neither option would be necessary if county commissioners or even the fire-rescue union had the courage to do the right thing and cut these egregious salaries across the board," said Mr. Keating.

Dennis Dorsey has mentioned to me on several occasions that we pay so much more than that reported $90,000 a year in average salary. Here in Lake Worth, we still have fire/rescue workers whose retirement benefits equal 172% of payroll. So, that $90,000 a year really amounts to Lake Worth taxpayers paying $245,000 a year, not to mention other benefits. They will get their retirement benefit until death and then their spouse will get a percentage until his/her death. Such a deal.

As property values in Lake Worth are down again this year by 3.6%, the budget is still "strained," according to Susan Stanton. The City Manager wants to tax all of us the same amount of money for fire/rescue that she says "could" lower the millage rate. Don't count on the "could."

The Culture of Incompetence - Lake Worth Utility Customer Service

Comment Up

That's what our Utility Service Department is and has been for years and the City finally has had enough.

We all feel lucky when we actually call Lake Worth Utilities customer service and get someone to speak with us on the first try. Usually we are put on hold forever and when someone finally gets on the line, they do not know how to answer our questions. They are often discourteous and have even been condescending. Most of us know that the only way to get the least bit of satisfaction is to drive there and wait in the lobby to get a live person so that we can insist on an answer that makes sense.

The service department has tried a multitude of managers, some very highly qualified and who, for whatever reasons, have not been able to turn the department around. Workers there are protected by the Union. At the moment, the Union has filed a grievance against the City because the employees were asked not to make or receive personal cell phone calls during business time. It came to that lightning bolt moment--outsource it all.

By so doing, private enterprise will be running the show and what can do it better than a well run American company that will strive for efficiency and will not coddle the lazy and won't have difficulty getting rid of the deadwood. Becky Mattey has done her best over the past two years but when it comes right down to it, the boss is the Union. The Unions will be out, the very ones who have allowed this to happen and that has a system in place that makes it almost impossible to correct. No more of people doing the bare minimum with all the wrong answers.

On May 3, 2011, the City Commission approved a 90-day contract with Government Services Group (GSG) for a not to exceed amount of $70,000 to provide management services and business practice evaluation on an emergency basis for the Customer Service Office. Per the agreement, should the City require additional services not included in this Agreement and/or reflected in the minimum tasks in Exhibit "A" of the agreement, fees and payment for such services will be set forth in a separate Additional Services Addendum, as authorized by the City prior to any such additional services or work being performed by the Consultant. Also, per the agreement, the City may extend services as needed on a month to month basis.

Last night, the Utility Director, Becky Mattey, and our city manager, Susan Stanton, tried to do just that. Unfortunately it was placed on the agenda at the last moment. In order to put something on the agenda without proper notice, it must be an emergency. Scott Maxwell challenged whether this was an emergency.

The department has 400 accounts that have yet to be billed and employees keep getting farther and farther behind the eight ball. Checks have been found in a locked fault, one going back to two years in the amount of $150,000. No one knows how to do anything even though they have had instructions in customer service, billing etc. Employees do the bare minimum in their jobs. Insolence and ineptitude abound. They have been given chance after chance to improve to no avail. The department is falling farther and farther behind to the point of no return. Thus the emergency. Thus the lightning bolt decision to outsource the department.

The Commission wanted to see a full report from GSG and have it come back to them prior to the August 2 meeting before they made their decision to outsource our Utility customer service.

Allen West Speaks Out

Comment Up
"And all we hear from the President is talk about “shared sacrifice,” “tax the rich,” and “increase revenues by tax hikes.” It was just December 2010 that President Obama and the Democrats extended the Bush era tax rates for two years…now less than a year later they are FLIP-FLOPPING!

The problem is, there is no confidence and certainty in the fiscal vision emanating from Washington D.C. and hence revenues and receipts are down. We are not setting the conditions or creating an environment for economic and job growth. For all of you, that is what has to change, and that is where I am committed to seeing change and not the empty rhetorical doublespeak of 2008.

I suppose the President forgot that 47% of wage earning households in America do not pay federal income taxes.

In the area of foreign policy, the United States has officially recognized the Libyan rebels as the “legitimate” government of Libya. Now, I am just a simple fella from down South, but I recall a previous Democrat President recognizing a bunch of undefined ideological zealots called the Taliban…and we all see how that ended up!

The voices of the American people who want sound fiscal, taxation, and regulatory policy need to be heard this week. I am issuing a “call to action” – let the White House, Nancy Pelosi, and Harry Reid hear how you feel. Are there REALLY 80% of Americans who want higher taxes?

I must confess, when I see anyone with an Obama 2012 bumper sticker, I recognize them as a threat to the gene pool."

Killer, Nathaniel Brazill, files Civil Rights Suit

Comment Up

What is it about people who commit horrendous crimes today? They become instant celebrities and get off scot-free for murder or if they don't, they file a law suit saying their civil liberties are infringed. They just keep scamming the system.

Nathaniel Brazill is back in the news. He has now become so smart behind bars that he is his own lawyer in a pending suit. He had a lot of time to study the law, use the library and had computer time. Why didn't they put him to work doing some sort of hard labor? I mean, he did kill his teacher in a cold blooded murder, for no reason other than he was ticked off, didn't he? He only got 28 years for the murder of Barry Grunow, his Lake Worth Middle School teacher, but the guy won't shut up.

He has filed a lawsuit because the prison system transferred him twice and he was put in solitary confinement, reasons for that unknown. He says it is because his jailers retaliated against him for filing an earlier lawsuit. He says his first Amendment Rights were violated. I say that all of our rights of sensibilities have been violated by Nathaniel Brazill.

Community Center formerly called the Shuffleboard Center

Comment Up

When did the name get changed for our Shuffleboard Court Building? Was it when the city decided, without a commission vote, to jackhammer out all the shuffleboard courts that are still on the chopping block? Once The Mentoring Center moved out, this building was to be used for our recreation department, or so I thought. Shuffleboarding is a recreation and one that Seniors enjoy. Also, the Seniors used to use the building for bridge games on a weekly basis.

On the agenda is a vote to accept a JAG award that fell through the cracks when The Mentoring Center was still "leasing" the property and ran it into the ground. The Department of Justice agreed to award the City of Lake Worth a supplemental award in order to utilize the FY 2008 grant funds in the amount of $18,088.

It will be spent on computers and software that will be used for programs to be operated from the facility including: PBSO “First Tee” Program, FCAT classes, Start Smart, a Citizens Police Academy, and ESL (English Speaking Lessons) classes. Attendance will be maintained regarding the number of programs and participants utilizing these computers.

Who makes these decisions on who will utilize city buildings, change its functions as well as its name?

Taxed to the Max - What happened to equitability?

Comment Up

Talking about the fire assessment: "The actual assessment would depend on the total costs included in the assessment such as fire fighter pension costs."

Because of property values being less than desired, the City now is trying desperately to convince Palm Beach County that our fire/rescue costs should be paid by a special assessment and billed to all of us on the non-advalorem part of our tax bill. In the past, the cost was based on the value of our property and we were being charged 3.4581 mils for fire/rescue.

The above is the revealing statement in the City Manager's Assessment of the Fire rescue situation. The City wants us to pay an equal share of the cost of fire/rescue. Every property owner would pay the same in order to cover the expense of having fire/rescue and all the pension retirement costs which now are 172% of payroll. Commissioner Maxwell says this is fair! Their argument? We get the service therefore charging everyone the same fee is fair.

Someone in a small 780 s.f. unit should not be paying the same rate as someone in a 5,000 s.f. house. Someone who lives in a cement block structure versus a wood frame, should not pay the same. Someone who chooses to live in The Lucerne should not be paying the same rate as someone in a single family structure. It takes more resources to put out a fire in a highrise. Taxes should be fair, just and equitable. Taxing everyone the same fee is nothing more than the easy way out.

We, the taxpayers, did not approve of these union contracts that are breaking our city and now will force all of us to pay equally, if the city gets its way. The tax is not based on one's ability to pay. The City could care less that some people are poor; some are on fixed incomes and struggling to stay in their homes. It will have nothing to do with the value of our property. It will not give the city or the county any incentive to keep costs down as the fire unions keep wanting more. We, in Lake Worth will pay the same fee regardless, freeing up millage for other expenses in the City's budget. The City Manager has suggested that we also might be taxed to the max...10 mils.

The City says, "The City feels strongly that this proposed funding mechanism (throwing fire costs onto the non-advalorem portion of our bill) will ensure that all city residents who benefit from fire protection pay their fair share of the cost of this service." Paying a fair share is fine, but "fair" it is not when the cost per owner is the same. This is public safety and something we must pay by law...not quite the same thing as a choice between buying an I-Pod or and I-Pad, a commodity, a luxury at a fixed price and something that we can do without.

While the economy is still fragile and people are still losing their homes and losing their jobs, the City of Lake Worth wants to tax us MORE to the maximum allowed by Law, not less, even dreaming up ways to get more than the 10 mils by throwing fire/rescue on to our tax bill as an assessment.

One half of the Palm Beach County Fire/rescue workers make more than $90,000 with one-third of them making six figure salaries, according to the PB Post. Palm Beach County now has two options to meet Fire costs: raise taxes or reduce the number of workers. The root cause still exists--Unions.

The City of Lake Worth's fire is in the hands of Palm Beach County. They can allow the city manager to tax us all the same rate or we can once again have our own fire department and we all will be taxed the same rate. Those seem to be our choices coming out of City Hall.

The positive is that with our own fire department, the City will be in control. And with a strong city manager as is Susan Stanton, we will not see retirement costs at 172% of payroll for new firemen, a cost that is unsustainable anywhere. If we had our own fire department the Florida Retirement System (FRS) is recommended as the pension plan. Perhaps if we had our own fire department, we would be more agreeable to paying a special assessment based on ability to pay or the best option-- pay per the total square footage of our residence. To break it down more than that would be an impossible feat.

Everyone should try and attend the Budget meetings. The Fire/Rescue will be discussed in a special meeting on July 21 where you will have a chance to speak to the issue. The first Budget workshop meeting is on July 26 and 27 with the millage set on July 28. Be as passionate as you were with the PBSO issue. As the Budget discussions are workshops, we will not have an opportunity to speak, another travesty, as it is our pocketbook they are trying to screw.

Letter to the Editor - Remember Tax Raisers' Names

Comment Up
Lake Worth High School alumnus, Randall Hall, wrote a Letter to the Editor. It is featured below.

Palm Beach Post
Sunday, July 17, 2011

While most political entities (cities, state, etc.,) are not increasing taxes during these hard economic times, Palm Beach County is going the other way. The commissioners have voted 4-3 to increase our property taxes next year. The four commissioners who voted in favor of increasing taxes are: Burt Aaronson, Shelley Vana, Jess Santamartia and Priscilla Taylor.

Remember those names the next time you vote for your commissioner. It looks like we need to replace them and give somebody else a chance to manage the county.

Obama raises a lot of cash for his re-election inspite of record debt

Comment Up
We think it's really something when a local candidate can call out the troops and raise $37,000 for a local election with most of them not even from Lake Worth and use every trick in the book. Obama and the DNC just raised $86 mil for Democrats and want to grow our $14 trillion dollar debt. It is simply amazing.

Today I am off to The Lake Worth Playhouse to see Chicago. I have heard it is the best show of the year. Chicago appears through July 31...one more week to buy your ticket.

Centrepoint Plaza - on the foreclosure block?

Comment Up

Centrepoint Plaza in Lake Worth, an 85,168 s.f. building and the former headquarters for the Realtors Association of the Palm Beaches, could be seized by a commercial mortgage-backed securities (CMBS) firm. Just another one that might bite the dust as our economy struggles and struggles as the city wants to raise taxes.

Let us Remember our History

Comment Up
Letter to the Editor writer Joanne Kelly said, "Let us remember our history." Mrs. Kelly was speaking about past commissioners, who in her mind, made some historical and good decisions for Lake Worth.

I believe in remembering our history. We can learn from it. I believe in concentrating on the positive as Ms. Kelly has done but frankly, I don't remember a whole lot of good from some of the commissioners she wrote about. It is always the bad stuff that lingers, many of which haunt us to this day. When ending relationships there are always very good reasons. Even the mention of Rodney Romano failed to say that he was voted out of office because he was just too close to and supported a favored developer who wanted to build condos at Old Bridge Park, something the people did not want.

First credit was given for the new downtown Publix to the CRA and to State Rep Jeff Clemens, our former mayor. What was left out of her letter was that the CRA doled out our money like candy by giving Publix, a billion dollar corporation, 1/2 million dollars of taxpayer money, a magnanimous gesture that was uncalled for and not asked for by Publix. Publix was going to build there regardless.

Next, the Gateway project was mentioned giving credit to Jeff Clemens and the CRA again. She failed to say that it cost us $15 million dollars for developer friends to get rich. We ended up with some pavers and some skinny trees and the CRA is struggling to pay the loan. The idea to spend all of this money was to attract development to the City. This was a failed pipe dream of the CRA, Jeff Clemens, and those on the Commission back then, one of the worst commissions ever.

She said that Jeff worked with the County to get the Snook Island boardwalk into existence. Perhaps so; who knows? Clemens was Mayor from 2007 to 2009 and the Snook Island project was completed in 2005. The boardwalk along with a fishing pier, floating docks and kayak launch just started in April of this year and Vice Mayor Suzanne Mulvehill had a lot to do with that.

Total credit for the beach redevelopment was given to former mayor Rene Varela which is far from the truth. In actuality, Cara Jennings was the leader in this endeavor. The only thing that Rene Varela brought to the table was Michael Singer (that cost us much more money) and Varelas' vote to proceed.

Mrs. Kelly is a member of the Lake Worth Democratic Club where several Officers and Directors of that club didn't even support Democrat Varela in his first run for office but instead supported a Republican. They did the same thing this year when they supported Tom Ramiccio, a Republican. As an officer/director of the Lake Worth Democratic Club, the most dysfunctional political club around these parts, this is contrary to the oath they swore to uphold.

Everyone brings something to the table; there is always something a commissioner did that was beneficial for the city, like falling asleep at the dais. That helped a lot. However, we also must remember that many of the commissioners that were mentioned in this article were either inept, corrupt or just made some horrible decisions for Lake Worth that we are paying for to this day and for years to come.

So looking at a few good things is dandy but the historical facts support costly and detrimental decisions from those who were cited in this Letter to the Editor that allowed our city to get to where it is today--at last we have a new, progressive commission that is finally leading us out of the messes of the past. Standing independent of the city manager is all that I ask from them.

Fire Services Feasibility Study

Comment Up
Willdan Feasibility Study on Fire Services

From the City Manager:

The current Inter-local Agreement requires the City to opt into the Fire/Rescue MSTU and to pay supplemental funding to the County in the amount of $700,000 for FY 2010 and FY 2011, $900,000 for FY 2012 and FY 2013, and $1,300,000 each fiscal year thereafter. For Fiscal Year 2011-2012, and future years, the City Administration has proposed the establishment of a Special Assessment for Fire Services irrespective of whether the County is providing this service or whether the City reconstructs a Fire Department. The actual assessment would depend on the total costs included in the assessment such as fire fighter pension costs.

Because the City has so many properties that pay little or no property taxes (due to the homestead exemption and current low value of the homes and commercial property) this assessment will allow the City to more fairly and equitably recover the cost for providing this critical public safety service.

The decision to terminate the Inter-local Agreement with Palm Beach County for Fire Protection and Emergency Medical Services and to reconstitute the Lake Worth Fire Department is dependent on Palm Beach County's willingness to modify the supplemental fire payment and allow the City to pay for fire protection provided by the County with the proceeds of a Fire Special Assessment. As indicated, so far, the County Commissioner's formal position is that it is unwilling to modify the agreement.

Willdan Homeland Solutions will present this report to the City Commission on July 21, 2011 at 6:00 in the Lake Worth City Hall.
