Appeals Court: Trump Can Try to Overturn His Conviction in the Fake Stormy Daniels Case

A federal appeals court has ruled that Judge Juan Merchan treated President Donald Trump unfairly in the completely fake Stormy Daniels hush money case.

The court will allow Trump to revive his bid to overturn his conviction in what the media calls “34 FELONY COUNTS.” The president can now try to have the case moved to federal court.

Sorry, Democrats. It looks like you won’t be able to falsely smear Donald Trump as a “convicted felon” for much longer.

Trump’s lawyers tried to move the case to federal court last year, but Judge Merchan refused to even consider that. Merchan’s daughter is a fundraiser for the Democrat Party, and she was raking in a small fortune by breathlessly updating Democrat donors on how her dad was putting Trump through a kangaroo court.

The three-judge panel on the 2nd Circuit Court of Appeals said that it “cannot be confident” that Merchan adequately considered Trump’s bid to move the case to a federal court.

“The court bypassed what we consider to be important issues bearing on the ultimate issue of good cause,” the judges wrote.

Disgraced Lawyer Michael Avenatti Lands Reduced Prison Term

Michael Avenatti, a former high-profile attorney who rose to fame representing porn actor Stormy Daniels against President Donald Trump, was originally sentenced after pleading guilty to bilking his California clients and hiding millions more from the IRS.

He had the sentence vacated in October by the Ninth Circuit Court of Appeals, which determined that it was based on calculations of a greater loss to his victims than was actually suffered — and thus was too lengthy.

Senior Judge of the United States District Court for the Central District of California Judge James Selna,  sentenced Avenatti to 135 months, minus 40 to account for a separate Stormy Daniels fraud sentence.

The court previously ruled that the Stormy Daniels theft was similar in nature, happened in the same time period, and therefore could be considered when deciding the new sentence.

Justices Barrett and Roberts side with liberals to deny sentencing delay in Trump hush-money case

The U.S. Supreme Court ruled against a bid from the attorneys for President-elect Donald Trump to delay the sentencing in the case involving hush money paid to adult movie worker Stormy Daniels.

Yesterday, the court ruled in a narrow 5-4 vote against Trump.

"First, the alleged evidentiary violations at President-Elect Trump's state-court trial can be addressed in the ordinary course on appeal. Second, the burden that sentencing will impose on the President-Elect's responsibilities is relatively insubstantial in light of the trial court's stated intent to impose a sentence of 'unconditional discharge' after a brief virtual hearing," read the ruling.

Trump will face sentencing at 9:30 ET, although he will be allowed to attend the ruling via video conference. Merchan is determined to make Trump a felon.

In a surprising move on a lightning-quick timetable that is unlikely to stand if challenged, the New York court that presided over the Stormy Daniels hush money criminal trial of Donald Trump ordered him on Friday to be sentenced on Jan. 10, just 10 days before he will assume the presidency once again.

The liberal sneaky judge signaled that Trump would get an “unconditional discharge,” meaning no jail time or probation, but sentencing would still cement the former and future president as a convicted felon.

If Trump seeks an emergency stay blocking the sentencing—and it will not surprise us if he goes all the way to the U.S. Supreme Court if necessary—we expect he will succeed.

Manhattan DA Alvin Bragg's "hush money" case against former President Donald Trump seems to have taken several steps back in recent weeks.

That was evidenced once again during the ongoing trial when one of Bragg's paralegals admitted on the stand that several key phone records had been deleted.

The phone records in question, according to The Epoch Times, were those regarding conversations between Stormy Daniels and former Trump lawyer Michael Cohen.

Trump's lawyers pointed out that the records had belonged to a set of evidence that was submitted to the court, but the fact that several records had been deleted was not disclosed to Trump's legal team.

A paralegal from Manhattan Attorney General Alvin Bragg’s office testified on Friday during former President Donald Trump’s “hush money” trial that some phone call records between Michael Cohen and Stephanie Clifford’s (a.k.a. Stormy Daniels) lawyer were deleted, raising questions about evidentiary integrity.

In a bid to challenge some of the evidence being put forward in President Trump’s business records falsification trial in Manhattan, Trump attorney Emil Bove asked paralegal Jaden Jarmel-Schneider in court on May 10 about roughly three pages worth of records that the attorney claimed Mr. Bragg’s office had deleted.

“Insanity! How on earth is this not a felony committed by Bragg and his minions? It sure would be if team Trump did it,” the former president’s eldest son, Don Trump Jr., said in a post on X.

A number of legal experts have challenged the way Mr. Bragg elevated the misdemeanor into a felony. This includes retired Harvard law professor Alan Dershowitz, who argued that Mr. Bragg was operating on an invalid legal premise because he invoked federal statutes over which New York has no jurisdiction.

What does it say about the current fraudulent prosecution of former President Donald Trump, that the state's key witness was a universally hated, serial exaggerator, who would often go rogue and may have been suicidal? It should say a lot.

And that describes Michael Cohen, Trump's ex-attorney-turned-Trump nemesis who will soon be testifying against Trump in a court in New York City.

Lawyers for the former president argue that Cohen had acted on his own behalf to make the payments to the porn actress “Stormy Daniels” to cover up Trump's alleged affair before the 2016 election. They add that Cohen tried to distance Trump from him.

The Daily Caller reported: “A witness in the trial of former President Donald Trump testified Thursday that he thought former Trump attorney Michael Cohen was going to “kill himself” over missing out on a spot in the Trump administration.” It noted:

…“‘Jesus Christ, can you fucking believe I'm not going to Washington, after everything I have done for that fucking guy, I can't believe I'm not going to Washington,'” Davidson recalled Cohen as saying. “‘I've saved that guy's ass so many times, you don't even know.'”

Cohen, who reported to prison in May 2019, was released to home confinement after about a year as authorities released low-security-risk inmates during a coronavirus outbreak in federal prisons.

Jonathan Turley: Manhattan DA’s Potential Case Against Trump ‘Legally Pathetic’

George Washington University Law Professor Jonathan Turley panned reports of the looming potential case against former President Donald Trump after the former commander-in-chief announced he may be arrested.

Alleged unnamed court sources have told multiple news outlets that Trump could be indicted in the near future, while Trump said via Truth Social that he expects to be arrested by Manhattan District Attorney Alvin Bragg’s office on Tuesday (today). Bragg’s office has not publicly confirmed reports that he may possibly indict the former president for allegedly misclassifying a $130,000 hush payment made to Stormy Daniels in 2016.

But Turley said that based on those reports, the DA’s case against Trump “is legally pathetic” and “is struggling to twist state laws to effectively prosecute a federal case long ago rejected by the Justice Department against Trump.”

“Prosecutors working under Bragg’s predecessor, Cyrus Vance Jr., also reportedly rejected the viability of using a New York law to effectively charge a federal offense,” Turley noted. Bragg also previously expressed doubts about the Daniels case and shut it down when he took office several years ago, he said, adding that two lead prosecutors resigned at the time.

The NYPD is erecting metal barricades outside of the Manhattan Criminal Court where charges are expected today against former President Donald Trump.

House Speaker Kevin McCarthy (R-Calif.) reacted to the news of Trump's potential indictment on Twitter, pledging to have congressional committees look into whether federal funding was involved in the case out of the Manhattan District Attorney's Office.

“Here we go again — an outrageous abuse of power by a radical DA who lets violent criminals walk as he pursues political vengeance against President Trump,” McCarthy said on Saturday. “I'm directing relevant committees to immediately investigate if federal funds are being used to subvert our democracy by interfering in elections with politically motivated prosecutions.”
