New Jersey wrong on banning AR-15's

Third Circuit strikes down New Jersey's AR-15 and magazine bans as unconstitutional

A federal appeals court ruled Friday that New Jersey's decades-old bans on so-called assault firearms and magazines holding more than ten rounds violate the Second Amendment, delivering a 10-5 decision that dismantles two of the most aggressive gun-control measures on the East Coast and sets the stage for a Supreme Court showdown.

The 3rd U.S. Circuit Court of Appeals found that New Jersey failed to justify its restrictions under the historical-analogue test the Supreme Court established for evaluating firearms regulations. The state pointed to colonial-era gunpowder storage laws and Bowie knife bans enacted in Western territories. The court was unpersuaded.

U.S. Circuit Judge Arianna Freeman, a Biden appointee who authored the majority opinion, wrote bluntly about the magazine restrictions:
"The text of the Second Amendment covers all magazines, not just magazines that New Jersey considers 'standard capacity."
New Jersey spent thirty-six years telling law-abiding citizens they couldn't own some of the most popular firearms in America. It took the Constitution about thirty-six pages to explain why the state was wrong.

Anti-gunners use lawsuit to target Smith & Wesson

Anti-gun lobby has been searching for ways to make AR-15's illegal

President Joe Biden’s attempts to pass a federal so-called assault weapons ban haven’t gone anywhere.

The U.S. Supreme Court’s landmark decision in New York State Rifle & Pistol Association, Inc. v. Bruen is a roadblock to the most aggressive measures against AR-15s in blue states.

So, anti-gunners got creative in an attempt to target the popular rifle.

They went after one of the companies that produces AR-15s, Smith & Wesson.

A group of Catholic nuns was behind the lawsuit, including the Adrian Dominican Sisters, Sisters of Bon Secours USA, Sisters of St. Francis of Philadelphia, and Sisters of the Holy Names of Jesus & Mary filed a lawsuit claiming the shareholders were against the AR-15's and claimed without evidence that AR-15s are “machine guns” that should be regulated under the National Firearms Act (NFA).

They dropped their "case."

The Left is trying to use the legal system as a vehicle to enact policies that they can’t get passed through any legislature.

'Assault Weapons' Ban to Take Effect in Just a Few Weeks After Supreme Court Declines to Block It

The U.S. Supreme Court on Thursday refused to issue a temporary block of a radical Illinois law that bans so-called “assault weapons,” leaving the state clear to launch the far-reaching ban on Jan. 1.

They are including an AR-15 as an assault weapon.

This reminds me of the liberals on a past dais in Lake Worth, insisting that the AR-15 was an assault weapon. I even set him straight at a commission meeting.

No self-respecting gun owner would ever call his AR-15 an assault rifle, but many who’ve never done their research think the “AR” in “AR-15” stands for “Assault Rifle.” It doesn't...look it up.

House Democrat Proposes 1,000% Tax to Soft Ban AR-15s

Only a Democrat could dream up something like this! Lake Worth's Herman Robinson would approve.

Virginia Democrat Representative Don Beyer's Back-handed Effort:
“We think that a 1,000% fee on assault weapons is just the kind of restrictive measure that creates enough fiscal impact to qualify for reconciliation.” He describes the ban as a “creative pathway” to ban AR-15’s with only Democratic votes.

There’s no way around it, the goal is clearly to price as many Americans out of the market as possible. Democrats like Beyer do not believe in the second amendment or American’s right to self-defense.
