Tour de Turtles


Do you like turtles?  I know, that's a silly question. We all love turtles.  On the right side of my blog I have a link to the Tour de Turtles. One big guy has traveled 1,032 miles in just 52 days.

These turtles have been released back into the ocean and are being tracked by satellite.

Click here to see how all of them are doing. Poor Amie is going around in circles and has only traveled 128 miles in 52 days. She has no idea where she's going or where's she's been..sort of like a few politicos in Lake Worth.

Last night, Mayor Pam Triolo, Vice Mayor Scott Maxwell and Commissioner Andy Amoroso, all up for reelection, voted to raise taxes across the board with few exceptions.  Maier and McVoy voted against, primarily because of two categories-- parking at the beach and electric rates. These two items are hot button election issues and there was no way that this trio would change their minds. They, instead, will now have a loss at the beach as they added more staff and they will be dipping into reserves at our electric utility.

Commissioner McVoy was disturbed that he got information before the meeting that there were other options that were never presented on the electric fund that would have helped in his argument to  increase reserves and that the average residential bill would only increase by 76 cents a month if they chose two out of the three options. He verified his graph with the electric utility director who was not at the meeting. The other three weren't "buying it" and Maxwell did not want to even include it into the record as he said it was McVoy's "opinion," essentially attacking Commissioner McVoy's credibility.

Maxwell said, "We need to find a way to keep our commitment to the public...we're thinking out of the box."  What he really did was drive another nail into our coffin by spending more and robbing reserves. The Mayor said she never agreed to raise electric rates and that they made a law to have rate parity with FPL. McVoy said that the average monthly electric bill has stayed flat and rate has very little influence on the community and that they, as a commission, needed to mange the city responsibly.

Not going back to the roll-back rate, taxes will be 8.35% higher than last year according to the city manager. We will bring in $6,946,193 in ad-valorem and will be spending $19,817,316 in Public Safety. In Palm Beach County, the Sheriff's budget is now $553.7  million and county employees are getting a 3% raise in 2016.

Not only is your ad-valorem going up, but so is just about everything else--

 No change in the General Fund millage rate of 5.4945 mils. No change in the MSTU of 3.4581.
 Salary increase of 4% across the board.
 Use of approximately $68,889 of General Fund available fund balance.
 No change to Electric Rates after decreasing rates for the prior 5 years.
 Increase in Local Sewer rates of 3%
 Increase in Water rates of 3.5% to fund new wells and other capital needs. Last night Maxwell said it was to pay back the loan from ourselves to build the Casino. That's the latest "line" coming out of City Hall. Read page 55 of the Back-Up to get the real "skinny" or listen to the video and what the city manager said in the very beginning of the meeting.
 No rate changes for Garbage or Stormwater.
 All business taxes up 5%.

Employees, Raises and Benefits

Three things happened yesterday--the Pope arrived in the United States, Lake Worth had its Second Public Hearing to pass the millage and the 2016 Budget of $179,420,309 and the public finally got to speak to it. Of course, it had already been decided in the First Public Hearing so very few residents were in the chamber.

The above graph's figures have changed slightly to 33.60% Controllable or $10.4 million and 66.40% Non-Controllable or $20.6 million. It's a "living document" we have been told.

I can well understand why some Lake Worth government employees are unhappy if what they claim is true--no raise in eight years.  But what we do know is, pay and benefits have become extremely costly and Unions have a lot to say as to what an employee in a specific job will make. All these employees who are unhappy with their pay should be contacting their Union Rep to understand the contract or discuss with their supervisor or the Human Resources Director who could explain it.
  • A pay raise of 4% was passed last night.
  • PEU/PMSA/IBEW employees, the 4% increase will be effective on the date of the new contracts without retro pay.
  • For all non-bargaining employees, the 4% increase will be effective on October 1, 2015
  • The mayor, Commission, and the city manager are excluded from receiving this salary increase.
High-performing workers, no matter how hard they work, cannot earn more than what the seniority system permits. The complaint from some of the employees is that good workers are leaving. Many leave and take jobs at non-union companies or get hired with a different job description in order to make more.

Sen. Marco Rubio, R-Fla., and Rep. Todd Rokita, R-Ind., recently re-introduced the Rewarding Achievement and Incentivizing Successful Employees Act which essentially amends the National Labor Relations Act to declare that neither its prohibition against interference by an employer with employees' right to bargain collectively, nor the terms of a collective bargaining agreement entered into between employees and an employer after enactment of this Act, shall prohibit an employer from paying an employee higher wages, pay, or other compensation than the agreement provides for.

The two graphics used on this blog have slightly different figures as these were drafts prior to the budget being finally set last night. The figure is a little higher than when this was first passed out but it is given as an example of what little money we have to run our city after paying UNCONTROLLABLE COSTS. Payroll and benefits take the biggest part of the pie.

When Trump says our leaders are STUPID, you can bet that they are.  Naive as well. We are clueless as to whom the enemy is. If we don't know who the enemy is, how do we fight it?  We waste billions of dollars and we are taken in, time and time again.

Ted Cruz on Stephen Colbert Show

California, and the people in it, are all screwed up--all liberals, all Democrats and many progressive socialists with a state near bankruptcy. Colbert's audience was full of them.  Thank God they are not typical of people in our country who believe in democratic principles and our Constitution.

I'm not sure why any Conservative would go on this show but Ted Cruz held his own.

Electric Fund Options

Now here's something that the other blogger might believe. It came from our consultants, Burton & Associates. But perhaps he won't believe that as he doesn't believe in the figures from our Finance Department that are in the Budget. Our visionary commission (Triolo, Maxwell, Amoroso) politically voted down increases in our electric fund so that we could go in the red.

These figures are the various options in our Electric Fund. We know we have to raise rates to stay healthy.
  • Option number 1 starts in 2017 and is a 76 cents monthly increase for 3 years. Healthy in year 2020.
  • Option number 2 starts in 2016 and is a 76 cents monthly increase for 3 years. Healthy in year 2019.
  • Option number 3 starts in 2016 and is $1.53 a month for 2 years. Healthy in year 2018.

ECR Payments


A mistake was made on Resolution 48-2015 so now a new one will be voted in tonight. It just shows how much the commission relies on staff and all information coming from the city to be true and accurate. We already know that numerical mistakes have been made because the city manager has admitted that.

In 2016 the East Central Regional Water Reclamation Facility Debt Payment is not levied in FY 2016. The total we collected in 2015 was $799,308.

On September 1, 2015, the City Commission approved Resolution No. 48-2015 which established the rates and charges for the sub-regional sewer utility based upon the recommendations of the sub-regional board for Fiscal Year 2016. The rates include operations and maintenance charges, rehabilitation and replacement charges and a capital reserve charge to collect funds required for a Palm Beach County shared force main rehabilitation project. The rates are included in this resolution. After adoption, it was found that the rates listed under Lake Clarke Shores and Lake Worth were reversed.  Resolution 54-2015 corrects that error.

Although Mr. Blackman (a real estate sales associate with PALM BEACH EAST REAL ESTATE OFFICE LLC in West Palm Beach and an employee of Hudson Holdings, the guys who wanted to grab our beach), is talking about the real estate market in South Florida, we take him at his word with his quote on his blog and remind him of the Palm Beach Post endorsement in 2007 when he was running against Jo-Ann Golden, one of his favorite targets for hit pieces and character assassinations.

Obviously from his statement above, he agrees that the Post made the better choice. Golden won that election with 52.56% of the vote.

Enterprise and Special Revenue Funds - The Difference

Wrong information is being championed once again on another blog.  So, to set that blogger straight as well as the public, below are the Enterprise Funds, starting on page 65 of our 2015 Budget, that we have within the City of Lake Worth. I already answered his charges earlier this month, Click here but it's a constant challenge with some people where facts just are not digested or get in the way.

The Beach Fund is a Special Revenue fund. These type of funds start on page 49 of our 2015 Budget. The Beach Fund is NOT an Enterprise Fund nor is the Golf Course Fund.

Special Revenue funds are described as follows: Special Revenue Funds are established to account for revenues and expenditures that are restricted by law or contract. The City operates  twelve Special revenue funds, two of which are the Beach Fund and the Golf Fund, the two that this blogger  seems to have the most "problem" with that began when the Vice Mayor got confused.

Enterprise Funds are used to account for operations that are financed and operated in a manner similar to a commercial enterprise, where the intent of the Commission is that the costs of providing goods or services to the general public on a continuing basis be financed or recovered primarily through user charges. The City operates the following enterprise funds:

Electric Fund (Fund 401) – To account for the provision of electric service to residents of the service area. All activities to provide such service are accounted for in this fund, including administration, generation, transmission, distribution, and customer service.

Water Fund (Fund 402) – To account for the provision of water service to residents of the service area. All activities to provide such service are accounted for in this fund, including administration, generation, transmission, distribution, and customer service.  City Code Section 18

Local Sewer Fund (Fund 403) – To account for the provision of sewer service to customers of the local service area. All activities to provide such service are accounted for in this fund, including administration, collection, pumping, treatment, disposal and customer service. City Code Section 18

Regional Sewer Fund (Fund 405) – To account for the provision of sewer service to customers of the regional service area. All activities to provide such service are accounted for in this fund, including administration, collection, pumping, treatment, disposal and customer service. Chapter 85.439 Laws of Florida

Stormwater Fund (Fund 408) – To account for the operation and maintenance of the stormwater utility systems. Revenues in this fund are obtained via non ad-valorem tax receipts. City Code Section 18.4 and Section 2.151

Refuse Fund (Fund 410) – To account for the provision of solid waste removal for the residents and businesses of the service area. All activities to provide for such service are accounted for in this fund, including collection and disposal. Revenues in this fund are obtained via non ad-valorem tax receipts for residential collection and billed service fees for commercial collections. City Code Section 12.15 and Section 2.151

I wish all this information would sink in for some writers so that I don't have to continually do all of this work, over and over again.  And the solution is simple--read the budget.

Peace Initiative Day - Some would rather stir the pot

Pastor Mike Olive of the Common Ground Church reached out to Wes and Mark in a gesture of friendship and love as well as to be a compassionate listener. They were invited to come over to his coffee shop yesterday which was Peace Day. But they were both "no shows."

Felon Voting Rights Bill SJR 192

Jeff Clemens's bill, if approved by the Legislature, would go on the November 2016 ballot. The measure seeks to restore the voting rights of felons who have completed their sentences. People with restored rights also would be eligible to hold public office. Automatic restoration would not apply to felons convicted of sexual offenses or homicide.

Getting beaten to a pulp by the Commission majority

Commissioner McVoy had a lot of concerns regarding our electric fund during an August budget workshop meeting and asked in-depth questions just as he did a week ago. In August, Commissioner McVoy commented that he was tempted to walk out of the meeting because it was a waste of the Commission’s time--he meant it was a waste of a thinking man's time.

The financial numbers were not correct and it sounded to him like the Finance Department was understaffed and there was not enough of it. Even the city manager has admitted that financial numbers are wrong in some instances but it's a "living document" he uses as an excuse.

Commissioner McVoy said he was not interested in the previous presentation. A few years back, an ordinance was passed to drop the City’s rates to match FPL’s. The Burton and Associates model showed a slope of the curve, which started at plus $10 million in operating cash downward to minus $20 million. He said rates were lowered and that, if operating expenses were reduced, then the $30 million spread over that period of time showed that the Electric Utility Department was not being managed correctly. He asked that information be provided using a clear, graph format. The City would go from a Projected Operating Cash of plus $10 million in Fiscal Year 2014 to minus $20 million in Fiscal Year 2020.

The response from the Mayor and Vice Mayor, often called bullies by many residents, and the two on the dais who beat up on McVoy all of the time (using scornful looks, leaning back in a chair, shuffling papers and not paying attention, cutting him short while he is speaking, etc.) are as follows--

Mayor Triolo commented she did not want to villainize staff and asked to keep the comments professional because staff worked hard. She is the one who storms out of meetings, passes the gavel and/or often gets annoyed. Calling professional scientist and commissioner Christopher McVoy unprofessional, is well, just plain unprofessional.

Vice Mayor Maxwell commented that the City historically contributed large sums of money to backfill its revenue through the Water and Electric Funds. He asked the Commission not to beat up staff over the rate parity ordinance and said that, if a Commissioner wanted to increase the electric rate, then he could make a motion. He asked that staff not be beaten up. That's a great line coming from someone who is constantly intolerant of a different opinion, beating up the minority commissioners and even has beaten up on the public calling them liars for voting against the general obligation bond, showing absolute zero patience and restraint.

So the moral of this story is, if you have a responsible commissioner who asks questions when numbers or explanations from staff don't add up, this majority will ignore you and beat you to a pulp but you continue on to the best of your ability and do your job for the people you serve.

Is this "bully pulpit" really the kind of leadership we want for Lake Worth?
