Third Circuit clears path for Mahmoud Khalil rearrest and deportation in 2-1 ruling

A federal appeals court has stripped away the legal shield that kept Mahmoud Khalil,Court,Palestine,Immigration Act, the Columbia University graduate student who helped organize pro-Palestinian campus encampments, out of immigration detention.

The Third Circuit's 2-1 decision reverses a lower court order that had freed Khalil, ruling that the district judge never had jurisdiction over his removal case in the first place.

The decision hands the Trump administration a clear win in its campaign to deport noncitizens tied to what federal officials describe as pro-Hamas activism on American college campuses. It also sets up a potential rearrest and puts Khalil closer to removal than he has been at any point since his case became a national flashpoint.

The core of the ruling is jurisdictional, not ideological, though the practical effect lands squarely on one side.

The Third Circuit held that the Immigration and Nationality Act strips federal district courts of subject-matter jurisdiction over removal proceedings like Khalil's. That means the New Jersey federal judge who intervened and ordered Khalil's release acted outside the bounds of judicial authority.

NYC first lady Rama Duwaji says she's sorry for 'harmful' posts — but won't name what she actually said

New York City's first lady, Rama Duwaji, broke her silence on a string of resurfaced social media posts that praised Palestinian terrorists, used racial slurs, and celebrated violence against Israel, but her carefully worded apology never once named the content she was apologizing for.

In a sit-down with the arts outlet Hyperallergic, the 28-year-old wife of Mayor Zohran Mamdani expressed regret for "language" she used as a teenager and said she understood the "hurt" she caused. She did not mention the Popular Front for the Liberation of Palestine, Palestinian plane hijacker Leila Khaled, Hamas, the October 7 attack, the N-word, or any of the specific posts that triggered the uproar.

That gap, between what Duwaji said and what she conspicuously left unsaid, tells its own story. An apology that refuses to name the offense is not an apology. It is reputation management.

And the timeline did not end in her teenage years. Duwaji also liked Instagram posts celebrating Hamas' October 7, 2023, attack on Israel, posts that shared images of the assault and included claims that rapes carried out by Hamas against Israeli hostages and victims were a "mass hoax." She was in her mid-twenties at that point, not a high schooler.

The posts at issue were made roughly a year and a half before she married Mamdani who says his wife is the "love of his life" and a private person. How sweet.

The "private person" defense by Mandani is a familiar Washington play: claim the spouse is off-limits while benefiting from the public profile that comes with the title.

Duwaji may hold no official government position, but she is the first lady of the largest city in the United States. That comes with public interest, whether the mayor's office likes it or not.

Khalil To Be Deported After Court Loss

Court Reverses Release

A federal appeals court last week overturned a lower court order that had secured Mahmoud Khalil’s release from immigration custody.

The 3rd U.S. Circuit Court of Appeals ruled 2 to 1 to send the case back the other way. That means Khalil, who has been fighting deportation for months, is likely to be taken back into custody while the government moves forward with removal proceedings.

Tricia McLaughlin, the Department of Homeland Security assistant secretary for public affairs, told NewsNation the expectation is that Khalil will be re-detained and deported to Algeria.

DHS framed the decision as a reminder for green card holders and visa holders that residency is a privilege and that breaking the law or supporting violent groups can cost you your place in this country.

That is a straightforward message from a government focused on restoring order around campus protests and foreign influence.

The administration says Khalil helped organize pro-Palestinian riots at Columbia University, provided false information on his permanent residency application, and has ties to groups the U.S. designates as terrorist organizations. He has also sued the government for $20million for false imprisonment and malicious prosecution.

Appeals court overturns ruling on Mahmoud Khalil’s release, citing jurisdictional grounds

A federal appeals court has just reversed a lower court’s decision, potentially paving the way for the re-arrest of Columbia University activist Mahmoud Khalil.

On Thursday, January 16, 2026, the 3rd U.S. Circuit Court of Appeals ruled that U.S. District Judge Michael Farbiarz lacked jurisdiction to order Khalil’s release from immigration detention last summer.

Khalil, a green card holder married to an American citizen, was arrested by ICE agents in New York City in March 2025 and held for about three months in a Louisiana detention center. The appeals court vacated multiple prior orders from April to July 2025 and directed Judge Farbiarz to dismiss Khalil’s petition challenging his detention.

Khalil’s arrest stemmed from a determination by Secretary of State Marco Rubio that his pro-Palestinian speech compromised U.S. foreign policy interests. He was released on June 20, 2025, after Judge Farbiarz found he posed no danger or flight risk and faced irreparable harm if detained further. The Trump administration publicly criticized the release order at the time.

Judge Farbiarz’s rulings, while well-intentioned, stepped beyond his authority, according to the higher court.

What happens next to Khalil remains uncertain, though re-arrest looms as a real possibility.

"Presidential peace envoy Steve Witkoff, on Jan. 14, announced the start of the second phase of President Donald Trump’s Gaza peace plan.

In an X post on Jan. 14, Witkoff said the second phase will move Gaza from an initial cease-fire into a period that will include the demilitarization of the Hamas terrorist group and the establishment of a technocratic governance model.

He said the second phase will also see the start of reconstruction for the war-torn territory. The Gaza peace plan began in October 2025, and the overall strategy is supposed to proceed in three phases and achieve the 20-point plan Trump laid out in September.

“Phase Two establishes a transitional technocratic Palestinian administration in Gaza, the National Committee for the Administration of Gaza (NCAG), and begins the full demilitarization and reconstruction of Gaza, primarily the disarmament of all unauthorized personnel,” Witkoff wrote.

I still remain amazed that Sen. John Fetterman (D-PA) has become the voice of reason for the Democrat Party. This all started over Fetterman breaking with the party over Israel when the war between Israel and Hamas first broke out.

It continues now, as Fetterman is pushing back against this huge movement in his party to recognize the Palestinian state, which would be in direct conflict with the wishes of Israel.

Dems have been pushing for this for some time, but over the last few months, they have really started to put the squeeze on. For example, in September, a group of Senate Democrats made the push to recognize a demilitarized Palestinian state.

The United Kingdom, France, Canada, and Australia were among the countries that were advocating for a two-state solution.

"Whether it's France or Australia or any of these nations, our Western allies are now calling for a two-state solution when Hamas refuses to disarm and are actively trying to kill Jews. I can't imagine why anybody would do that at this point,” he said.

TEL AVIV, Israel — Israeli Prime Minister Benjamin Netanyahu vowed Sunday to oppose any attempt to establish a Palestinian state, a day before the U.N. Security Council planned to vote on a U.S.-drafted resolution on Gaza that leaves the door open to Palestinian independence.

Netanyahu has long asserted that creating a Palestinian state would reward Hamas and eventually lead to an even larger Hamas-run state on Israel’s borders. But as the U.S. attempts to push forward with its Gaza ceasefire proposal, he faces heavy international pressure to show flexibility.(Hope he doesn't)

The Security Council is expected to vote on a U.S. proposal for a U.N. mandate that would establish an international stabilization force in Gaza despite opposition from Russia, China and some Arab countries.

Hamas and Palestinian factions warned Sunday against the U.S. proposal, calling it an attempt to impose an international mandate on Gaza that is biased toward Israel and deprives Palestinians of the right to manage their own affairs. In a statement, the groups said the force must not involve Israel and must be under direct U.N. supervision.

The statement also rejected any reference in the U.S. proposal to disarming Gaza. Netanyahu on Sunday noted the proposal calls for Gaza to be demilitarized and Hamas to be disarmed, telling his Cabinet: “Either this will happen the easy way, or it will happen the hard way."

The United States plan for Gaza was passed by the United Nations on Monday. The 15-member council voted 13 to 0 in favor of the resolution, with abstentions by Russia and China, which declined to use their veto power to block the measure.

Israel is readying itself to implement the first stage of US President Donald Trump's 20 point plan to return the hostages and end the war in Gaza, the Prime Minister's Office confirmed early on Saturday morning.

"We will continue to work in full cooperation with the President and his team to end the war in accordance with the principles set forth by Israel that are consistent with President Trump's vision," the PMO office said.

Trump earlier demanded Israel stop bombing Gaza "immediately" after Hamas said on Friday night it is willing to release all hostages in an effort to re-enter negotiations over Trump's deal to end the war in Gaza.

The terrorist organization said in a statement it would release all hostages, living and dead, "according to the exchange formula outlined in President Trump’s proposal, provided that field conditions necessary for the exchange are secured." Hamas officials later told international media that it would likely take longer than the 72 hours outlined in the US proposal to release them.

The acceptance came hours after Trump issued an ultimatum to the terror group, insisting Hamas had until Sunday to accept the deal or face "all HELL like no one has ever seen before."

Why The G7 Gives Palestine A Pass But Denies Taiwan Recognition

The recent announcements by several G7 nations, notably France, the United Kingdom, Canada, and Australia, that they will recognize Palestine as a sovereign state mark a significant geopolitical moment.

Until very recently, the idea that even one, much less four, members of the G7 would take this step was unthinkable.

Their longstanding policy of non-recognition was rooted in a commitment to the Oslo Accords, signed in 1993 and 1995, which created the Palestinian Authority as an interim administration and emphasized that a Palestinian state should emerge only through direct bilateral negotiations with Israel, not unilateral action.

That this barrier has now been crossed reveals a troubling contradiction in the application of international law and diplomatic principles. These same nations refuse to recognize Taiwan, a self-governing, prosperous democracy that clearly meets the established legal criteria for statehood.

By contrast, Palestine does not presently meet those criteria, and yet it is being ushered into recognition largely as a political rebuke of Israel. This double standard is as untenable as it is transparent.

Take a moment to review what's happening here. Hamas is a U.S.-designated terror group. Hamas ran the Gaza Strip after voters gave it power in 2006. There hasn't been an election since, which is what an actual threat to democracy looks like. Hamas is open about its hatred of Israel:

"Israel will exist and will continue to exist until Islam will obliterate it, just as it obliterated others before it," Hamas stated in the preamble of its 1988 charter.

That doesn't have quite the same ring as "We hold these truths to be self-evident, that all men are created equal."

On Oct. 7, 2023, Hamas launched a surprise attack on Israel and slaughtered around 1,200 people. Most of them were civilians. It also kidnapped around 250 people and continues to hold some 20 hostages.

In July, the UN reported that 1,123 UN-manifested trucks collected aid along the Gaza border. Of those, 1,055 trucks were intercepted before arriving at their destination. In other words, less than 10% of UN aid arrived at its destination. Hamas likely took much of it.

Controlling food means power and money for Hamas. Little wonder it has worked hard to stop other sources of aid. The U.S.- and Israeli-backed Gaza Humanitarian Foundation is attempting to give aid directly to civilians. Hamas warned Gazans not to accept the aid. Hamas has placed bounties on those distributing the food. In June, it even murdered several GHF aid workers.

Hamas wants Gazans to go hungry. It knows Western leftists will then blame Israel and advance policies Hamas wants – like recognizing a Palestinian state. And that's exactly what's going on.

Prime Minister Anthony Albanese called the situation in Gaza a "humanitarian catastrophe” and put the blame squarely on Israel, ignoring terrorist group Hamas and its mission to find and kill Jews.

Michele Bachmann, the former congresswoman and now a dean at Regent University, is a vocal defender of Israel. She tells AFN the Gaza War now nearing the two-year mark has been a military disaster for Hamas but a propaganda bonanza.

“When they've made every wrong move that there is, their last move is the PR campaign,” she says. “And so they put pressure on these Western nations to make a dumb decision, which is to ‘recognize’ a Palestinian state.”

"It was outrageous for Macron to do this, and it came at a horrible time. It basically rewards Hamas and is one of the reasons that they became unreasonable in any talks to end the war in Gaza," Huckabee, the U.S. Ambassador to Israel, said in an interview with Family Research Council President Tony Perkins.

Macron said that he will revisit this topic in an official statement at the United Nations General Assembly in September.

In the post, he attached a letter he previously wrote to Mahmoud Abbas, president of the Palestinian Authority, expressing the same sentiment. In the letter, the costs to civilians on both sides began with terrorist attacks by Hamas on Oct. 7, 2023.

Huckabee said, if one nation can just declare another place on the earth to be a state, then I think it would be fitting for the U.K. to declare France a British colony."

“While Columbia does not admit to wrongdoing with this resolution agreement, the institution’s leaders have recognized, repeatedly, that Jewish students and faculty have experienced painful, unacceptable incidents, and that reform was and is needed,” the university said in a statement announcing that it had reached a deal with the federal government.

Columbia University was one of the most active campuses involved in pro-Palestinian protests that swept the United States in 2024 in the wake of terrorist group Hamas’s attack on Israel on Oct. 7, 2023 that killed 1200 Israelis and took over 200 hostages, which triggered a war that is still ongoing.

Pro-Palestinian students and activists formed encampments, and in several instances, Jewish students were physically or verbally harassed by protestors.

Critics, including President Donald Trump’s administration, have accused the university administrators of failing to take proper action in response to these incidents of anti-Semitism.

The Department of Education sent compliance letters to over 60 universities, warning them of potential enforcement actions if they failed to make changes to protect Jewish students under Title VI of the Civil Rights Act, which bars groups that receive federal funds from discrimination on the basis of race, color, or national origin.

Students were blocking a door to an administration building where five protesters were being held by campus police for criminal trespass and resisting/obstructing. The responding officers were trying to make enough room to get these five suspects out of the building to be transported to the jail. In the ensuing confrontation, another suspect was arrested.

New Mexico State University has a student population of approximately 14,000 and less than 20 people participated in the protest. For the students who participated in the underwhelming turnout, the protest quickly petered out, and those involved got a major reality check!

If that is what one chooses. I, on the other hand, have chosen to live a life of public service,’ Kamala had claimed. But the “life of public service” led to her husband’s role at DLA Piper.

As vice president, Kamala pursued a harsher line against Israel than Biden, virulently denouncing the Jewish state over its military campaign against Hamas terrorists after Oct 7.

In recent months, Harris has been a tougher critic of Israel than President Joe Biden, who frequently describes himself as a Zionist, and as a voice more sympathetic to the suffering of Palestinians in Gaza.

What she and John Kirby want to forget is that the Palestinians voted in Hamas to lead them. Hamas has governed the Gaza Strip in Palestine since its takeover of the region from rival party Fatah in June 2007.
