Federal judge dismisses Proud Boys Jan. 6 convictions after DOJ moves to end cases permanently

A federal judge on Friday wiped away the remaining convictions of four Proud Boys members who faced some of the longest sentences handed down in connection with the January 6, 2021, Capitol breach, granting a Justice Department motion to dismiss the cases with prejudice (permanently thrown out by the court) thus permanently closing the door on prosecution.

U.S. District Judge Timothy J. Kelly approved the dismissal for Ethan Nordean, Joseph Biggs, Zachary Rehl, and Dominic Pezzola, all convicted in 2023 on multiple felony charges.

Three of the four, Nordean, Biggs, and Rehl, had been found guilty of seditious conspiracy, a charge that carried enormous political weight during the Biden administration's sprawling Jan. 6 prosecution campaign.

The ruling marks the final legal chapter for the Proud Boys defendants. Their sentences had already been commuted by President Trump. The U.S. Court of Appeals had previously vacated the convictions. And in April, the DOJ filed a motion asking the trial court to formally dismiss the indictment.

Judge Kelly granted that motion Friday, but not without making clear he wasn't endorsing the outcome, only recognizing the constitutional boundaries of his own authority.

Justice Department asks appeals court to erase seditious conspiracy convictions of Oath Keepers and Proud Boys leaders

The Justice Department on April 14 asked a federal appeals court to vacate the seditious conspiracy convictions of top Oath Keepers and Proud Boys leaders, a move that would wipe some of the most consequential January 6 criminal verdicts from the books and bar prosecutors from ever refiling the same charges.

Prosecutors filed unopposed motions with the U.S. Court of Appeals for the D.C. Circuit seeking to throw out the convictions and send the cases back to the trial court for dismissal with prejudice.

That legal term means the government could never bring those specific charges again against the same defendants. The filings cover a roster of high-profile January 6 figures, including Oath Keepers founder Stewart Rhodes, Kelly Meggs, Jessica Watkins, and Proud Boys members Ethan Nordean, Joseph Biggs, Zachary Rehl, and Dominic Pezzola.

The step goes well beyond the commutations and pardons President Trump issued to January 6 defendants in January 2025. Commutations shortened sentences but left the underlying convictions intact. Pardons forgave the offenses but did not necessarily erase the court record.

What the DOJ now seeks is a full vacatur of the jury verdicts themselves, followed by permanent dismissal of the indictments.

Proud Boys Leaders Sue DOJ for $100M Over Their Jan 6 Prosecution

Five leaders of the Proud Boys are suing the Department of Justice after the Biden administration found them guilty of engaging in a seditious conspiracy related to the Jan. 6, 2021 riot at the US Capitol.

The lawsuit, filed by Henry “Enrique” Tarrio, Ethan Nordean, Joseph Biggs, Zachary Rehl and Dominic Pezzola, seeks $100 million, and claims that federal authorities violated the Constitution in an effort "to punish and oppress political allies of President Donald Trump, by any and all means necessary, legal, or illegal," WaPo reports.

Leftist academics (at least one) are freaking out over the suit, suggesting that it would vindicate Jan. 6 rioters in the court of public opinion.

Representative Clay Higgins (R-LA) believes there may have been “over 200” undercover FBI agents posing as supporters of Donald Trump inside the Capitol before the riot on January 6th, 2021.

Higgins, who serves on the U.S. House Committee on Homeland Security, made the startling claim in an interview with Newsmax on Wednesday.

“The FBI was not only involved in the actions on January 6 from within, they had, I suspect, over 200 agents embedded within the crowd, including agents or as they would call, human assets inside the Capitol dressed as Trump supporters before the doors were opened,” he asserted.

The New York Times reported that the FBI had as many as eight informants embedded with the “Proud Boys” group in the months leading up to the Capitol riot.

This comes along with another report that the FBI had a well-placed informant within the Oath Keepers.

“When you track the text threads and the communications within those groups and find the origins of suggestions of potential violence or an active occupation of the Capitol on January 6, you’ll find that those messages were led by members of the groups that ended up to be the FBI agents that had infiltrated the group,” Higgins claimed.

In February of this year, Cara Castronuovo of The Gateway Pundit reported a surprising revelation in the US government’s case against the Proud Boys.

Evidence presented in court confirmed that the FBI was responsible for creating and authoring a 9-page document titled “1776 Returns,” which detailed plans to take control of US government buildings on January 6, 2021.

Prior to January 6th, a document of unknown origin was sent via Telegram to Enrique Tarrio, Chairman of Proud Boy. The sender was identified as an individual named Erika Flores, who allegedly described the author of the document as a government official from both the FBI and CIA.

“It appears that the government itself is the author of the most incriminating and damning document in this case, which was mysteriously sent at government request to Proud Boy leader Enrique Tarrio immediately prior to January 6 in order to frame or implicate Tarrio in a government- created scheme to storm buildings around the Capitol.

Enrique Tarrio announced two DOJ officials who were in the room during this meeting: Partisan Department of Justice Lead Prosecutor Jocelyn Ballantine and Assistant US Attorney Jason McCullough.

Enrique was no where near the Capitol on January 6 but the corrupt DOJ sentenced him to 22 years.

Tarrio said that sitting through the three-month trial has opened his eyes to the overreach of the criminal justice system. Tarrio — along with Joe Biggs, Ethan Nordean, Dominic Pezzola and Zachary Rehl — are facing nine counts, including the rare charge of seditious conspiracy for their actions on Jan. 6.

The Biden Department of Justice disclosed that they had at least 40 undercover operatives with the Proud Boys on that day. It is worth noting that the FBI also admitted to having 8 informants inside this organization in November 2022, which pushed their tally of agents up to an estimated 50 or more.

To make matters worse, a whistleblower recently testified under oath that the FBI would not allow 11,000+ hours of footage taken on January 6th to be released because it might reveal undercover agents committing crimes inside the Capitol building.

This lends credence to claims that not only was this event a federal set up but, furthermore, that FBI is now actively trying to cover it up.

The controversy erupted recently after an attorney for Ethan Nordean, a Proud Boys member facing charges over the events of Jan. 6, 2021, said “hidden” messages between FBI agents had been found in a document presented to the court by FBI Special Agent Nicole Miller, according to Newsweek.

“[A] close examination of the agent’s sheet revealed over one thousand hidden Excel rows of messages,” a court document said. Leaked chat logs from an FBI agent revealed that her boss ordered her to “destroy evidence” in the Department of Justice’s case against Proud Boys charged with seditious conspiracy for their alleged participation in the breach of the U.S. Capitol on Jan. 6, 2021.

The government and the unconstitutional J6 committee maintain that the Proud Boys were conspirators in the storming of the Capitol on January 6th, which they allegedly planned during a Zoom call.

But, a funny thing happened when a video of that meeting was released by a J6 defendant. The video shows that the alleged planning meeting never mentioned anything other than they wanted to be ready to defend themselves should Antifa attack and a discussion on how to avoid getting into trouble.

Beyond those two subjects, the rest of the call was just a BS session, and no conspiracy or plans to enter the Capitol were ever discussed. The meeting on Zoom was a huge nothing burger.

But, Liz Cheney could always call serial liar Cassidy Hutchinson back to the stand and relate how President Trump met with the Proud Boys and the Oath Keepers to plan ways to overthrow the government. I’m sure there is no lie that she is above telling. Just hand her a script and stand back.
