Albany is not merely being “compassionate.” It is obstructing federal immigration enforcement after local government has already arrested the defendant.
The Supremacy Clause is not optional, and state judges have a direct command written into the Constitution: “the Judges in every State shall be bound thereby.” New York cannot gag jailers, sabotage ICE handoffs, outlaw cooperation Congress authorized, and then pretend federal law is a polite suggestion.
