Message from Commissioner McVoy to City of Lake Worth Beach

Jamie and Lake Worth Staff,

Please see photo attached below. The Town of Palm Beach’s proposal to drive trucks of sand along the length of our beach hinges on the ability of the trucks to pass safely under the Lake Worth Pier—while driving *only* on the 10’ wide strip owned by the ToPB.

Safe passage includes multiple issues—not damaging pier, ensuring human safety, not eroding our beach, etc., etc.—but at a minimum it requires sufficient height to pass the proposed truck type under the pier. This obviously must include a safety margin, without excavation of the sand underneath the pier, and while passing only on the 10’ strip owned by the ToPB. (Note that the state-owned foreshore area eastward of the MHW is under City of Lake Worth responsibility as part of our swimming area.)

Establishment of the exact location of this strip relative to the supports of the pier is therefore critical.

The eastern edge of this strip is the MHW line; the western edge 10’ to the west of the MHW line. As the Lake Worth Pier is a federal tidal station, the vertical elevation of MHW is well-established at the location of the pier.

During recent days, the tidal high water line was just east of the pier supports corresponding to the eastern edge of Benny’s (see photo). If the MHW line is close or landward of the recent high water line, then these pier supports would fall within the ToPB strip and truck passage would not be possible.

In light of these concerns, please ask the ToPB to provide a scale drawing of the section of the pier shown in the attached photo. The scale drawing needs to be a vertical cross-section, aligned with the pier center line, running approximately east-west and parallel to the pier, and must include the following:

• the locations and dimensions of all pier supports visible in the photo
• the location of the MHW line,
• the location of the western edge of the 10’ strip
• the vertical elevation of the MHW line (NAVD88)
• the vertical elevation of the western edge of the 10’ strip (NAVD88)
• The elevation of the lowest portion of the lower edge of the pier (NAVD88)

The horizontal locations need not be to the level of surveyed accuracy but can instead be measured relative to one set of pier supports, most logically those corresponding to the eastern edge of Benny’s. The drawing must nevertheless be to scale.

Please also ask the ToPB to include with the scale drawing a cutsheet or other independent document showing the height of the trucks the Town proposes to use.

I would encourage staff to make it clear to the Town of Palm Beach that the City of Lake Worth Beach cannot legally give permission to ToPB to drive on our beach nor can we allow them on state land for which we have safety responsibility.

I urge every single person reading Lynn's blog and seeing Chris McVoy's diligence and good intentions in optimal representation of the residents of Lake Worth--to immediately begin sharing this news to all other residents of Lake Worth that they know.... Chris is exemplifying the kind of Government Lake Worth desperately needs--there is no doubt he cares deeply about this issue and the injustice that our residents are faced with.........but Chris will need OUR HELP if he is to be able to succeed in this fight between a powerful town protecting the wrongly entitled, AND the people of Lake Worth--who are having their resources raped and their RIGHTS trespassed on as if they were non-persons..................... We are all busy and it is hard to find time to join a political fight; Each of us needs to find the time-- We are being "pissed on" by the town of Palm Beach, and either each of you can take this and say thank you, we know we are beneath you...or..... we can help Chris, and put in the time to protect Lake Worth, to protect our beach under this destructive and catastrophic attack.....AND... to protect our neighbors that will be trying to enjoy our LW beach without being threatened and run over by Palm Beach dump trucks. I believe that the Mayor and the other commissioners will follow the lead Chris is providing, IF enough of us show that we are treating this as a line in the sand that has been crossed, and a fight we all place above the other commission items filling the schedules but not protecting this most basic obligation. I also think that a majority of us should make time to ask Mayor Betty Resch to put aside the personal animosity she has for McVoy and so constantly conveys in front of all of us---ask her to put this aside for the good of the town. I believe she wants what is good for us also, but the Town will be stronger if she can bury the hatchet and work like a "teammate" with Chris.

70 % of the people of Lake Worth passed a CHARTER AMENDMENT to say no to this absolute CRAP that TOPB is trying to pull. Gee, what could go wrong with this desperate "hail Mary " idiocy that weasels in the bureaucracy of Lake Worth and TOPB have cooked up? Spitting on the will of the people is nothing new when all you think matters is money. Trying to thread this ridiculous made up needle with a 500 lb $hit of a plan-again WTF could go wrong RIGHT? Soooooo when disaster strikes this dumb plan and the fallout starts to rain down on everyone involved like bird poop, what are they going to say? Grab your popcorn. And Join Commish Mcvoy in a huge "We told you idiots not to do this".

What's really sad, is that in District 4, we can only vote for District 4 Candidates. What is also sad, is that instead of being able to vote for Lori Berman, we have to vote for Bobby Powell. Imagine that Bobby Powell, who has Rivera Beach and Singer Island would have time to think about Lake Worth Beach is a Bridge to far. This is what happens when you don't pay attention
to the affairs of your Local Government.

Madam Mayor & Commissioners,
Good afternoon and happy new year! I just wanted to remind everyone of our pre-agenda meeting tomorrow morning at 9:00am and also pass along the email I sent over to the Town of Palm Beach at 5:00am this morning. As previously mentioned, I’ll keep you posted as I receive information from the Town. FYI - the survey stakes that were placed along the beach over the past two weeks have now disappeared… due to the tide.

I called Lori Berman about Condo Legislation. She assured me the legislators were working on it. This was last year. Bobby Powell never returned my call. That is what my comment was based on.
What's been done to the Condo Owners, is a crime of immense proportion. Only the legislators can fix it. They broke it!
