Lawsuit against the City of Lake Worth

VICKY GRANT, an individual, and RAD EL DUB COMMUNITY LAND TRUST, INC., a not-for-profit Florida Corporation vs City of Lake Worth Beach

"A Writ of Certiorari was filed on September 17. It asserts that the City did not follow their own code when they granted the approval for the DecoGreen and it asks the court to throw out the approval. If the court agrees, DecoGreen will have to come back for another hearing. It is also possible the Court will not agree, but our lawyers feel there is decent proof that the City did not follow the Code to the letter which should negate the approval.

The judge issued an order on October 4th to the City of LWB ordering that "Respondent(s) shall SHOW CAUSE within thirty (30) days from the date of this Order why the prayed for relief in the Petition for Writ of Certiorari should not be granted." This is a good sign that the judge sees merit in our request. So, now we are waiting for the City to reply. Once they reply we will have 20 days to respond to whatever the City says.

NEXT STEPS Once the City submits their response the lawyers will meet with the petitioners to decide how to move forward. We will update this group and welcome your thoughts. We are hoping the Court agrees with us and sends the project back. At that point we will need to mobilize our community to come out strong at possible a re-hearing for the DecoGreen project. This is an important time to defend our neighborhoods from inappropriate upzoning."
