New York City jury sides with Daniel Penny

In May 2023, former marine Daniel Penny and his fellow subway riders nearly became the next victims of a horrible crime after career criminal Jordan Neely threatened to hurt them.

A clearly disturbed Neely made continued threats to the people around him that forced Daniel Penny to take action, putting Neely in a chokehold until they arrived at the next station. However, given Jordan Neely’s crippling drug addiction and poor health, the career criminal died on the scene.

Rather than siding with the marine, New York’s woke District Attorney Alvin Bragg charged Penny with one count of second-degree manslaughter and one count of criminally negligent homicide.

In New York City, second-degree manslaughter carries a maximum sentence of 15 years while criminally negligent homicide carries a maximum sentence of four years. However, a New York City jury found Daniel Penny not guilty of the crime of criminally negligent homicide. This comes after the judge in this case tossed out the higher charge of second-degree murder due to a hung jury.
