King, Nieves & Zacks is pleased to announce that the Supreme Court of the State of Washington has cited Florida foreclosure attorney Dustin Zacks' Quinnipiac Law Review article in the case of Bain v. Metropolitan Mortgage Group, Inc. In that pro-homeowner opinion, the Court held that Mortgage Electronic Registration Systems, Inc. cannot be deemed a beneficiary to deeds of trust (the equivalent to mortgages in Florida) when it never held the original promissory note secured by those deeds of trust.

In the opinion, which can be found by clicking here, the Washington Supreme Court twice cited Zacks' Quinnipiac Law Review Article discussing Mortgage Electronic Registration Systems' standing in foreclosure litigation. The Court even cited Zacks' article as substantiation of the fact that foreclosure servicers and lenders sometimes issue incorrect or fraudulent assignments.

  1. Looks like you were wrong about your relentless negative attacks on Zacks too. Turns out he's a good guy after all.
Do you ever get tired of being wrong?

  2. I wasn't wrong about his attacks. He did a hatchet job on Waterman that was unfair and uncalled for...bad personal political attacks...just like a rabid dog.

And no, I don't get tired, only of people who come here from time to time to do nothing but harass, poke or get downright dirty and mean and not have the guts to even use their name. The delete key is great.

When there is something positive to write about someone, I do it. When there is something for which I disagree, I will write about that too.
