Greater Bay's final screw

It's impossible to write about what went down at city hall last night. One thing that was perfectly clear to me was, we hired the wrong attorney. Little did I know or ever expect, that tough dealing, azz kicking Brian Joslyn would cop out and give ridiculous excuses for reasons to settle. After all, Joslyn was the lawyer who wrote the contract FOR Greater Bay. He knew all the nuances and legalities of it. I guess it took the reading of 70,000 documents that got him to acquiesce.

Joslyn was the attorney who was behind the city suing its own citizens in We Love Lake Worth PAC.  Incidentally, the PAC got ALL of the required signatures on three petitions that were certified by the Supervisor of Elections. If Cara Jennings did anything wrong regarding Greater Bay, it was voting against the petition going to ballot which would have kept the zoning PROS. The fear was possibly having to build a new building which would have ended the businesses considered as accessory under PROS. If the city did anything wrong, it hired an attorney with a definite conflict of interest.

Mr. Joslyn mentioned the zoning last night and that all those merchants who had been there were illegal based on the zoning. What the opposition failed to tell him was that all our merchants were accessory to the beach experience and "grandfathered in." The 1922 casino was built for business and has been a business enterprise since 1922. The PROS zoning did not have to change to BAC which was only changed to accommodate Greater Bay and the further commercialization of our beach. Mr. Joslyn should have asked anyone other than the opposition or even the former P and Z board that was politically removed recently if he was seeking the other side of the story or wanted correct information.


PROS (Public Recreation and Open space):

23.18.02.00. use restrictions in the PROS public recreation and open space district.

23.18.02.01. Principal uses permitted by right in PROS district.

A.  Parks and other outdoor open space areas intended for active use
B.  Essential services

23.18.02.02. Principal uses permitted as special land uses in PROS district. No uses are permitted as special land uses in the PROS public recreation and open space district.

23.18.02.03. Accessory uses permitted by right in PROS district.  Any use accessory to and customarily incidental to a principal use permitted by right.  (In other words, Mr. Joslyn, the merchants were always allowed there, were "grandfathered in" and were there since the casino opened in 1922.

Yes, we did have a case. Greater Bay NEVER performed. This article from lakeworthmedia.com, Greater Bay's Peter Willard - background check 2 years late is about a guy who I said in a previous blog, would charm the pants off my Grandmother and she has been dead for 50 years!  Brian Joslyn fell for all the politics of those who have been screaming about a public/private partnership with Greater Bay for years, blaming all the wrong people:  citizens, bloggers, false statements (not giving one example) and two commissioners who did the right thing. It wasn't they who signed the contract with an unqualified company.  The entire commission (including Retha Lowe) voted to end the Contract with Greater Bay for non-performance.

This commission had no choice but to make the settlement decision of $1.6 million to Greater Bay. They wanted to take the easy way out and support a flim flam artist. This was Greater Bay and Willard's objective from inception--to get its hands on our 19 acres in some way shape or form. For a company that didn't have a pot, they now have one filled with Lake Worth green. Greater Bay had a great attorney in Brian Joslyn.

  1. Did not understand our attorney last night. When there is a law suit, there is always the possibility that you will lose. Whey bother then? Just let everyone sue us and settle like the billboard deal? Is that the new strategy?

  2. Joslyn is a total ass. He screwed Lake Worth as bad as the con men of Greater Bay did! Joslyn took Lake Worth's money and represented Greater Bay with it! SCREWED AGAIN!!! Mcvoy had it right-every time our elected officials stubbornly refuse to listen to the people who elected them,everyone pays the price!

  4. Politics is VERY SICK in this city. And you just made it sicker. The only way anyone will OWN THIS, are those politicians who can't stand the opposition or anyone disagreeing with them. Re4tha Lowe NEVER should have signed the contract to begin with. let's start at the very beginning of the scam.

  10. Has anyone reported Jocelyn to the bar association for conflict of interest? How can people be so stupid. This attorney writes a contract for Willard and when everything goes south, the city hires the attorney to prosecute a case against Willard in which the contract the attorney wrote is the key issue.

    Willard's record shows a history of judgments against his companies. Ask the numerous individuals/companies/contractors who got judgments against Willard if they think he's a con man? Or just take a look at the joke of a pool cover he supplied the city and that's the quality of person we're talking about.

    But something much deeper is at work here and it has to do with politics at its worst. Most of those LW residents who ignored Willard's glaring record and were his close friends and staunch supporters, are the same folks who maneuvered the current commission into power and so it will become this commission's legacy that THEY were duped into robbing taxpayers of 1.6 million for the benefit of their supporters 'friend.'

  11. All has gone as planned by us. By us I mean all those who believe capitalism should not exist. First install individauls into positions of power and than dismantle the system from the inside. Burn through as much money as possible,leave and move on, and the city will eventually self destruct. Chaos will follow and insurection among the people will finally show that money is the problem. To be free one must be free of all the material stuff that gets in the way of common sense and being human.

    which in collusion with former City manager Paul Boyer, eliminated the profit sharing for the City,owners of Land and Buildings,clause,for 40 years.
    These 3 former Commissioner- usurpers owe the Citizens, $1,600,000.- as they demanded that the harmful to the City,illegal Contract be signed

    Josslyn knows this, and Josslyn knows that Greater Bay,had many judgements(92) against them,and no money,after 2 years, still incapable of producing Proof of Funding,to our City, of their bank.(did they have one,a Hit-and-Run Account with Josslyn?)

    Nadine Burns is now with the Lake Worth Chamber of Commerce making money of Lake Worth,Dave Vespo with PNCB, and Retha Lowe of the fined for crooked pay -as -you play,usurped the Power of Lake Worth Mayor,Marc Drautz, ,who was present and healthy,30 years Old Law abiding life guard,as required by Law,did not want ti sign the Losslyn Contract without reading it,
    when Nadine Burns yanked the gavel out of Mayor Drautz's hand and ordered Retha Lowe and Dave Vespo(witnesses saw this) to sign the unread Contract to make Lake Worth Citizen taxpayers lose their Beach without revenue for over 40 years.
    Nadine Burns, Dave vespo and Retha Lowe, owe Greater Bay $1,600,000,- ,not the Citizens,as they insisted on signing,agreeing to accept,Josslyn's City robbery conditioned Contract.
    Our City attorney,if representing the Citizens' side(his paymasters) can start the suit for that Nadine Burns, Retha Lowe and Dave Vespo $1.600,000,000 created obligation
    to Greater Bay and Josslyn .How the City can hire the lawyer who wrote the Contract, to represent the City,shows how stupid idiots, get to our Commission seats,except Dr.C.McVoy.We hold them accountable.When will the Conflict of Interest suit for Josslyn start?City attorney,do you represent us?If you do ,get to the BAR Assoc.

  18. Lynn no disrespect but I don't have any money, if I did I would give it to you if you needed or wanted it. It means nothing to me. The money we get is used collectivly for activities to further our cause.What I have is yours and by the same token what you have I should also share. When we help each other we become one. Nothing else is needed. Call it BS if you chose but this idea is being played out thru out this city and it works pretty well.

    The people in power at the time are the ones that broke the contract. I don't think they were rallying around G.B. after breaking the contract.
    "LIKE WES BLACKMAN"? Wes unfortunately has never been and won't ever be an elected official in this town. All he did was report what turned out to be the truth.
    While it's understandable that you are all disappointed that your big fight turned out to be another house of cards but please at least try to place the blame where it belongs. The "best commission ever" turned out to be the "worst commission ever" and we'll all be paying for more of their big mistakes in the near future.

  22. Have the City manager Michael Bronstein and the City Attorney,read the illeagl Contract? Josslyn know that our Charter limits leases to 20 years,his Greater Bay lease was for 40 years -2 days/months, and UNLIMTED CONSTRUCTION TIME.
    ARE OUR CITY MANAGER AND ATTORNEY DOING ANYTHING ABOUT THIS?UNLIMITED CONSTRUCTION TIME, IS ANYBODY SO SIMPLE THAT HE OR SHE DOES NOT KNOW THAT HE HAS LAKE WORTH BEACH FOR 100 YEARS, AS LON AS HE LEAVE A FEW STONES UNCEMENTD.JOSSLYN WROTE THE CONTRACT AND IS HIRED BY LAKE WORTH COMMISSION IDIOTS TO FIGHT IT?

  23. The Best commission Ever that was a 3 to 2 vote, voted unanimously to end the contract with Greater Bay for non-performance. This was on advice from two attorneys.

    The Worst Commission Ever entered into the contract that was a bad deal for LW. Ask them why they did what they did. Ask Wes. He has all the answers. Maybe he should be accountable for working so hard against the city to lose this suit.

  25. What did Wes do to help the city lose the suit? He didn't break the contract and he didn't file the lawsuit that caused the city to lose the suit.
    The past city attorney advised the "best commission ever" to NOT break the contract. What 2 attorney's are you going by?
    Mulvehill was right there throughout the whole disaster. Where is she with the answers?

  26. When ending the contract with GB was proposed, attorneys Joslyn, Karns, and Humphreys asserted that GB's likely suit would be without merit and that the City had the right to break the contract, so that Commission acted appropriately given the advice provided by three legal professionals.
