Virginia Court Rules Democrat Redistricting Vote Unconstitutional in Major GOP Win
President Trump scored a major victory in Virginia after a judge blocked Democrats’ newly approved redistricting referendum, stopping a map that could have gutted Republican House strength in the state.The ruling handed Republicans an immediate legal win and threw Democrats’ sweeping power play into chaos just hours after voters approved it.
Virginia Circuit Court Judge Jack Hurley ruled Wednesday that the redistricting referendum was unconstitutional. The decision came one day after voters approved the Democrat-backed measure. Hurley found that all votes for or against the proposed amendment were invalid because the referendum did not meet required legal standards.
The ruling immediately froze Democrats’ effort to move the new map forward. It also showed that the legal fight over the referendum is far from over.
Republicans quickly hailed the ruling as a major breakthrough and Former Virginia Attorney General Ken Cuccinelli announced that the court had blocked certification of the election. “The Tazewell Circuit Court just ruled the referendum unconstitutional,” Cuccinelli wrote on X.

Journalist Brian Tyler Cohen noted that the Republicans have full control of the federal government and could pass a law to ban partisan gerrymandering any time they want to, as Democrats have called for, but they refuse. “Republicans aren’t mad gerrymandering exists,” Cohen notes; “they’re mad that they’re not the only ones using it.”
ReplyDeleteThe Republican National Committee, now controlled by Trump, immediately sued over the Virginia election, and a Virginia judge ruled that both the constitutional amendment and the referendum voters approved were invalid. He said that “any and all votes for or against the proposed constitutional amendment in the April 21, 2026 special election are ineffective,” and prevented officials from certifying the results.
But, as Yunior Rivas of Democracy Docket wrote, Virginia attorney general Jay Jones is challenging the decision, saying: “Virginia voters have spoken, and an activist judge should not have the power over the People’s vote. We look forward to defending the outcome of last night’s election in court.”

ReplyDeleteThe Supreme Court ruled in 2019 that partisan gerrymandering is a "political question" beyond the reach of federal courts, placing the responsibility on Congress to create laws prohibiting it. That will never pass. So this judge is a federal court judge and blocking this is most likely meaningless.
Of course you know that circuit court judges are STATE judges, right? Not federal, right? Of course you do because no one is that stupid unless, of course, that someone also doesn't know the difference between 'capitol' and 'capital.'

a U.S. Circuit Court judge is a federal judge, officially known as a Circuit Judge. They serve on the 12 regional circuits or the Federal Circuit, usually acting in three-judge panels to determine if the law was applied correctly in lower court trials.
