The Hill Opinion Writers Call for Congressional Action Against Trump's Return to Office
An opinion piece published in The Hill sparks controversy by suggesting an unprecedented congressional move to prevent President-elect Trump from assuming office.According to Fox News, columnists Evan A. Davis and David M. Schulte authored an op-ed urging Congress to invoke the 14th Amendment's disqualification clause to block Trump from taking office in January.
The columnists, both distinguished legal scholars (I sincerely doubt the "distinguished" part) with Davis being a former editor-in-chief of the Columbia Law Review and Schulte formerly heading the Yale Law Journal, (you know how woke and crazy those colleges are) based their argument on Article 3 of the 14th Amendment.
This constitutional provision bars individuals who have "engaged in insurrection" or provided "aid or comfort to the enemies" from holding public office, although this restriction can be lifted through a two-thirds vote in both houses of Congress.
The opinion piece triggered immediate and strong criticism across social media platforms, with various political figures and commentators condemning the proposal.
Trump campaign spokesman Steven Cheung characterized the suggestion as an attempt to "steal the election and invalidate the will of the American people." Eric Trump expressed his disapproval directly, calling the individuals involved "sick."

It is illegal for anyone, including journalists, to call for insurrection. Under 18 U.S. Code § 2383, inciting, assisting, or engaging in rebellion or insurrection against the authority of the United States is a serious offense. This law states that anyone who does so can be fined, imprisoned for up to ten years, or both.
ReplyDeleteA clear majority of the American public legally voted for Trump and the MAGA side in this last election. For these "journalists" to call for elements of government or the public to subvert the WILL of the American people and a legal and clear electoral choice, this is to me a clear case of insurrectionist behavior, and given it's high profile it should be immediately prosecuted and an example made to prevent more deluded leftists from "piling on".
The First Amendment protects freedom of speech, but it does not protect speech that incites imminent lawless action or violence. In other words, a journalist calling for insurrection would be crossing legal boundaries and could face significant legal consequences.
