Judge Amy Berman Jackson Upholds DC Law That Allows Non-Citizens To Vote in Municipal Elections

A federal judge has dismissed a lawsuit challenging the legality of a Washington, D.C., law that allows non-citizens to participate in local elections.The judge, U.S. District Judge Amy Berman Jackson, appointed by President Obama, ruled that the seven plaintiffs, who are all U.S. citizens and registered voters in D.C., did not demonstrate how the law had negatively impacted them.
The contested law, known as the “Local Resident Voting Rights Amendment Act of 2022,” was passed by the D.C. Council in 2022 and removes the citizenship requirement for voting in municipal elections.
Non-citizen residents are now permitted to vote exclusively in local elections, such as for local representatives and on local initiatives, referenda, recalls, or charter amendment proposals.
The law allows non-citizen residents to run for government positions in D.C. and serve on the city’s Board of Elections, as stated in court documents.
