Mask Mandate Ruling in New York

Judge Rules NY Gov. Hochul's Mask Mandate 'Unconstitutional'

Judge Thomas Rademaker gave New York Governor Kathy Hochul the middle finger in ruling that her "mask mandate" is unconstitutional.

The emergency powers granted by state legislature has expired, so Hochul thought she could get away with imposing a mandate via issuing a "declaration of emergency." After declaring emergency, she instructed New York's health department to issue a mask "guidance" under the color of law, which means the governor pretended that it had the force of law.

However, her unconstitutional maneuver was smacked down by Rademaker.
