A violation of the Constitution in Oakland

I never thought that I would ever agree with a building association.  We have seen it way too many times where their members are usually the greedy guys who stampede a community or want to build to the sky or ask for waiver after waiver of local municipalities to get their way.  Remember the Gulfstream Hotel with the last owner?  "We'll do this, that and the next thing but you Lake Worth needs to do this, that and the next thing and grant us this waiver and that waiver."

Apparently Oakland, California (the crazy state) enacted a new program where members of the Bay Area Building Industry Association are being required to pay an additional one percent of the cost of any commercial project to a city-picked artist; Residential builders would pay 1/2 a percent. It's being challenged in federal court. Don't we sort of do the same thing by granting developers an additional floor for some public amenity$
