As Commissioner Maier stated at the time, “This is completely untrue and unfounded. The woman (who made the allegations) is no friend of mine. She’s never been in my home and she’s not even my neighbor.”

Yah yah right to privacy but on the other hand some real bad stuff can be happening inside a property and yet the people we look to too enforce codes have little power. So the saying goes no proof no violation of course... Even if proof is hidden?

This is the exact reason for the 4th amendment.

...meaning - "Get a judge to issue a warrant."
No ones agrueing Maeir didnt abide by the constitution. But bc he used it instead of heading the accusations head on now there will always be speculation on what's really going on in his duplex
Delete@8:25 above--I'm rather sure that code officers must follow the laws. It shows that there is a flaw in our system when someone political can go after a politician with NO evidence. Sorry John Rinaldi, but being a former lawyer, you, of all people, should know this.
ReplyDeleteNow as far as this house over here on Wright Drive, there was a huge loophole in LW law...that is something that NEVER should have been allowed to happen. Even though the city is trying to get these ordinances foolproof, we have a way to go.

This will backfire for anyone involved in this and prove to be very negative if you continue to bring it up. You will lose a lot of votes if you do because basically people still support civil rights in this country (I realize that Obama is trying to stomp on that premise) and just plain fairness.

Anyone can make a complaint then its codes job to gather evidence but how can they when they arent allowed to? Maier got off bc lack of evidence because he inhibited his officers from gathering any.

The fact the case was closed due to lack of no evidence wasnt because code got inside and saw there wasnt a violation which would be concrete proof instead he didnt allow his code people to gather evidence. as in the mayor and same commissioner should not be communicating with same developer during the ITN process, which the developer revealed on public record recently.
as in a sitting commissioner and department director on a secret committee to bring new development to our beach should not be conspiring to manipulate an election by withholding information from the public.
as in the city manager should not be misleading commissioners in regard to the intent of a bidding process that could significantly affect public land (the beach).
as in the city attorney should not be conspiring at the request of a secret committee to sidestep a 20 year max lease term at our beach property that was approved by 90% of Lake Worth voters.
Not as in he is not allowed to have his own private space and private life.

Joining in: i dont think that whoever a few anonymouses are is stating that he didn't have rights to say no. I think he/she is only stating it may not have been in his best interestes for his persona with the people to proceed the way he did. There is a diffeence between no hard evidence and possible evidence behind a closed door. Thats all. I guess no one will ever know for sure. Maeir is a upstanding honest person just because he refused to let the code inside to gather evidence is his prerogative. He obviously has nothing to hide or he would have let rhekin right? The real one to blame is Code Officer Robinson for persuing it, sorry you didnt catch your man! Its a good thing her supervisor leashed her and instituted some sense into her. Look Robinson its closed, too bad huh. Why dont you go worry about some dog poop on someones lawn and stay away from the honest people in Lake Worth!

You do have a problem with harassment.
A code complaint doesn't go away simply b/c you don't let them in your home. I don't think any of you have had any experience with code, but I have. And, no I wouldn't let them in my rental unit to inspect it, and guess what happened, the code complaint didn't go away. Rather I had to go to a hearing and address the allegation and prove that I was right, which I did.
ReplyDeleteThere are also plenty of other ways to gather evidence besides entry. If you are running an illegal business, code could gather evidence by taking photos of deliveries or customers, etc. If something were super "shady" as some of you put it, that wouldn't be code it would be the police and they have different methods to gain entry.
Maybe we can resurrect the Gestapo...they would handle it.

Every rental in the city is required a inspection its called a use and occupancy inspection. So you to stated they took you to court and you won? ReplyDeleteThey all have their own agendas regardless of what the public or employees want. Take for example the beach... The majority of the community wants to keep the beach the way it is yet sadly HH will most likely get it. The employees havent recieved even a 1% raise in 7 years yet the CM & Departmental Heads continue to get raises, some over $10,000 a year.
When have politicians every been considered the most honorable upstanding people?
