After the complaint from this blog that Mamma Mia was not a legal corporation in the State of Florida the night it was awarded the lease at our new casino (first blog being on February 2 and the last one being on February 21), the name has now been changed to something that is legitimate. The City's web site, at this very moment, still has the original lease name, Mamma Mia, Inc. (A Florida Corporation) which we have told you did not exist on January 31, never was a Florida corporation to this day. Click here and then click on January 31 before it all goes away.
I call your attention to this because 1) the people of Lake Worth should not have to put up with cover-ups, 2) put up with dishonesty, 3) put up with long-term tenants that were railroaded off our beach who were and still are legitimate corporations as of the January 31 meeting and 4) we shouldn't have to put up with the City finding ways to dishonor Rights of First Refusal.

This is the front page of the lease that was presented the night of January 31 and was approved by the Commission. Even the Trade name that did not become legal until February 2, 2 days after the meeting, is spelled incorrectly.
This is the altered lease that is stamped January 31 in the upper right hand corner although we have no idea on what date it was changed. The mayor signed the Lease on February 23. There was to be a signed Letter of Credit along with the executed Lease but through public information, the LC was not completed nor was it signed.
The real estate broker should have done his D&D. He didn't neither did the city.
ReplyDeleteYour evaluation of the lease was accurate and correct. The lease proposal submitted by Mamma Mia etc was of a non-existant corporation not only as of the date that it was submitted, but also as of the date of the Commission meeting.
ReplyDeleteWhat is egregious is that the same people from the City who want to ignore this situation also used a technicality to deny New York Pizza its right of first refusal. In other words, if one wants to be legally proper, if New York Pizza did not have a right of first refusal, it was nonetheless the only valid and existing entity to submit a proposal and at the Commission meeting concerning that space.

ReplyDeleteHow do you get all the emails and leases you post on your Blog?? Is it City staff or a Commissioner(s)?? Do you have a completed Freedom of Information Act (FOIA) form requesting all of your posted information???

ReplyDeleteBarry and Vito got screwed. If they wanted to be at the beach so bad, are able to pay the rent and got screwed as you claim, why don't they take legal action? You know Mulvehill and Mcoy would help them out in any way possible with the case.

Vito had already spent $8,000 for his lawyer up to that point. When a landlord does NOT want you, sometimes you have to give up the fight.

ReplyDeleteVito had the right of first refusal. He was not ALWAYS late. In the last year they were in the old casino, they had no idea whether they would be operating the next day and get kicked out...or a wrecking ball...or what. They were jerked around--ALL of them.
